PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicants for grant of regular<br \/>\nbail under sec. 439 of the Code of Criminal Procedure after the<br \/>\ncharge sheet is filed.\n<\/p>\n<p>2.\tThe<br \/>\napplicants-accused are charged with having committed offences under<br \/>\nsections 363, 366, 376 and 114 of IPC for which FIR, being C.R. No.<br \/>\nI-7\/2010, has been registered with Waghodia Police Station.\n<\/p>\n<p>3.\tLearned advocate Mr.<br \/>\nTrivedi referred to the papers and  submitted that he has been<br \/>\nfalsely implicated and he has also referred to the statement of the<br \/>\nmother which has been notarized and submitted that the present<br \/>\napplication may be allowed.\n<\/p>\n<p>4.\tLearned APP Ms. Nair<br \/>\nresisted the application. She also referred to the statement of the<br \/>\nmother as well as the statement the Notary.\n<\/p>\n<p>5.\tIn view of rival<br \/>\nsubmissions, it is required to be considered whether the present<br \/>\napplication can be entertained or not.\n<\/p>\n<p>6.\tIt is well accepted<br \/>\nthat the court is not required to appreciate and scrutinize the<br \/>\nevidence in detail at this stage. However, for considering the prima<br \/>\nfacie case relevant aspects like the<br \/>\nnature of offence, the manner in which it is alleged to have been<br \/>\ncommitted, the role attributed, the age of the victim, medical<br \/>\nevidence etc. are required to be considered. The aspect of consent<br \/>\ncould be decided with reference to the age of the victim on the basis<br \/>\nof evidence at the trial. Therefore, without further elaboration,<br \/>\nhaving considered the papers including the statement of the mother<br \/>\nand of the Notary, the present application deserves to be allowed.\n<\/p>\n<p>7.\tThe application is<br \/>\naccordingly allowed.  The applicants are ordered to be released on<br \/>\nbail in connection with C.R. No. I-7\/2010 registered with  Waghodia<br \/>\nPolice Station,  on their executing a personal bond of Rs. 5,000\/-<br \/>\n(Rupees Five Thousand only) each with one solvent surety for the like<br \/>\namount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that they shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark their presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the trial commences.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof their residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender their<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>8.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>9.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
