Justice J.M.JAMES\n\n Dated :13\/10\/2006\n\n O R D E R\n                             J.M.JAMES, J.\n\n                                --------------\n\n                            B.A. 6148\/2006\n\n                              ------------------\n\n   DATED THIS THE 13TH DAY OF OCTOBER, 2006\n\n\n\n\n                                O R D E R\n<\/pre>\n<p>              The   petitioners,   accused   1   to   13,     are   before<\/p>\n<p>this   Court,     under   Section   439   Cr.P.C.,     in   crime<\/p>\n<p>No.275\/2006   of   Mathilakam   Police   Station,   Thrissur<\/p>\n<p>District,     for   the   offence   punishable   under   Sections   143,<\/p>\n<p>147, 148, 448, 324, 307 and 302 IPC read with Section 34<\/p>\n<p>IPC   and   also   under   Section   27   of   the   Arms   Act.     The<\/p>\n<p>petitioners   are   in   judicial   custody,     having   arrested   on<\/p>\n<p>different   dates.     The   learned   counsel   for   the   petitioners<\/p>\n<p>submits   that   ninety   days   are   over   and   therefore,   prayed<\/p>\n<p>for bail.\n<\/p>\n<\/p>\n<p>       2.     The learned Public Prosecutor submits that the<\/p>\n<p>petitioners   are   belonging   to   a   particular   gunda   group   of<\/p>\n<p>the locality and there was the death of a person, belonging<\/p>\n<p>to   the   opposite   gunda   group.     If   the   petitioners   are<\/p>\n<p>released on bail,  they would repeat the same offence and<\/p>\n<p>there   is   also   threat   to   their   lives,   from   the   group   of   the<\/p>\n<p>B.A.6148\/2006<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>person,   who   died.     In     such   circumstances   of   the   case,<\/p>\n<p>the   learned   Public   Prosecutor   submits   that   bail   may   be<\/p>\n<p>refused, as the final report had already been filed.<\/p>\n<p>        3.    As the investigation is being complete and the<\/p>\n<p>final report having filed,  I direct the learned Magistrate<\/p>\n<p>to   immediately   commit   the   case   to   the   Sessions   Court,<\/p>\n<p>and  the prosecution  shall  ensure  that the  witnesses are<\/p>\n<p>produced  on  summons  from the  Sessions  Court  and  the<\/p>\n<p>learned   Sessions   Judge   shall   complete   the   trial   at   the<\/p>\n<p>earliest,   in any case within three months from the date<\/p>\n<p>of receipt of the committal records, to that Court.<\/p>\n<p>              The application is dismissed as above.<\/p>\n<p>                                              J.M.JAMES<\/p>\n<p>                                              JUDGE<\/p>\n<p>mrcs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Satheesan vs State Of Kerala on 13 October, 2006 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6148 of 2006() 1.
