Prasad<\/div>\n<pre>                           IN THE SUPREME COURT OF INDIA   REPORTABLE\n\n           CIVIL APPELLATE JURISDICTION\n\n           CIVIL APPEAL NO.5130 OF 2009\n\n\n\nState of Uttarakhand &amp; Another                 ..Appellants \n\n                             versus\n\nArchana Shukla &amp; Others                        ..Respondents\n\n                    WITH\n\n           CIVIL APPEAL NO.1474 OF 2007\n\n                    O R D E R\n<\/pre>\n<p>  Civil Appeal No.5130 of 2009<\/p>\n<p>  Heard learned counsel for the parties.<\/p>\n<p>  This Appeal has been filed against the impugned judgment <\/p>\n<p>and order dated 06th March, 2006 passed by the High Court of <\/p>\n<p>Uttarakhand at Nainital in Writ Petition No. 140\/2005.<\/p>\n<p>  The facts have been set out in the impugned judgment and <\/p>\n<p>hence   we   are   not   repeating   the   same   here   except   wherever <\/p>\n<p>necessary.\n<\/p>\n<p>  The   respondents   herein   were   appointed   on   adhoc <\/p>\n<p>officiating post in the year 1988 for a fixed term which was <\/p>\n<p>continued.  They were regularised in the year 2004 under the <\/p>\n<p>Uttaranchal   Regularization   of   Ad   Hoc   Appointments   (Posts <\/p>\n<p>under the purview of Public Service Commission) Rules, 2002 <\/p>\n<p>( for short &#8216;the Rules&#8217;).   The respondents claimed benefit <\/p>\n<p>of   their   service   from   1988   to   2004   for   the   purpose   of <\/p>\n<p>seniority   and   this   has   been   granted   by   the   High   Court. <\/p>\n<p>Hence, this appeal.\n<\/p>\n<p>\nCIVIL APPEAL NO.5130 OF 2009 etc.<\/p>\n<p><span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>   We are afraid, we cannot agree with the view taken by the <\/p>\n<p>High Court.\n<\/p>\n<p>   Rule 7(1) of the Rules states as under:<\/p>\n<blockquote><p>              &#8220;A person appointed under these rules shall<br \/>\n             be entitled to seniority only from the date<br \/>\n             of   order   of   appointment   after   selection   in<br \/>\n             accordance   with   these   rules   and   shall,   in<br \/>\n             all   cases,   be   placed   below   the   persons<br \/>\n             appointed   in   accordance   with   the   relevant<br \/>\n             service   rules   or   as   the   case   may   be,   the<br \/>\n             regular   prescribed   procedure,   prior   in   the<br \/>\n             appointment   of   such   person   under   these<br \/>\n             rules.&#8221;\n<\/p><\/blockquote>\n<p>   Admittedly,   the   respondents   were   appointed   after   a <\/p>\n<p>selection under the Regularization Rules in the year 2004. <\/p>\n<p>Hence,   in   our   view,   they   can   get   seniority   only   from   the <\/p>\n<p>year 2004 and not from 1988.  The rule is clear and hence we <\/p>\n<p>cannot debar from the clear meaning of the rule.<\/p>\n<p>   It   has   been   held   in  <a href=\"\/doc\/603123\/\">Raghunath   Rai   Bareja   &amp;   Another   vs. <\/p>\n<p>Punjab   National   Bank   &amp;   Others<\/a>   (2007)   2   SCC   230  that   when <\/p>\n<p>there is a conflict between law and equity, it is the law <\/p>\n<p>which   has   to   prevail   in   accordance   with   the   latin   maxim <\/p>\n<p>&#8216;dura lex sed lex&#8217; which means &#8216;the law is hard but it is <\/p>\n<p>the law&#8217;. Equity can only supplement the law, but it cannot <\/p>\n<p>supplant or override it.   This view was followed in Civil <\/p>\n<p>Appeal No.2684 of 2007 titled <a href=\"\/doc\/421654\/\">B.Premanand &amp; Others vs. Mohan <\/p>\n<p>Koikal &amp; Others<\/a> decided on 16th March, 2011.<\/p>\n<p>        In the present case, Rule 7 is very clear and hence the <\/p>\n<p>CIVIL APPEAL NO.5130 OF 2009 etc.<\/p>\n<p><span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>respondents are not entitled to the benefit of their service <\/p>\n<p>from 1988 to 2004 for the purpose of their seniority.<\/p>\n<p>     Accordingly,   this   appeal   is   allowed   and   the   impugned <\/p>\n<p>judgment of the High Court is set aside.  No costs.<\/p>\n<p>Civil Appeal No.1474 of 2007<\/p>\n<p>     In   view   of   our   order   passed   today   in   Civil   Appeal   No. <\/p>\n<p>5130 of 2009, this appeal is also allowed and the impugned <\/p>\n<p>judgment of the High Court is set aside.
