Petition No. 50 of 2000 and the other decree is for<br \/>\nrecovery of Rs. 17,70,015.58 ps.\n<\/p>\n<p>     and   interest  and   is   dated   9.7.2003  passed   in   Misc.<br \/>\nPetition   No.   81   of  2000.     Both  the<\/p>\n<p>     decrees were passed  ex-parte as none appeared for the appellant<br \/>\non the date of hearing<\/p>\n<p>     before the <\/p>\n<p>     Special   Court.   In   Misc.   Petition   No.   81   of   2000<br \/>\n(M.A.   No.   243\/2003)   application   was<\/p>\n<p>     moved   for   setting   aside   ex-parte   decree   and   seeking<br \/>\nre-hearing   on   merits.   The<\/p>\n<p>     application has <\/p>\n<p>     been   rejected   vide   order   dated   17.9.2003   by   the<br \/>\nSpecial   Court,   as   in   its   opinion,<\/p>\n<p>     sufficient cause for default in appearance by the appellant or its<br \/>\ncounsel was not made<\/p>\n<p>out. Feeling aggrieved,C.A.No.10280\/2003 has been filed. The ex-parte<br \/>\ndecree passed in<\/p>\n<p>Misc.Petition   No.50   of   2000   dated   3.7.2003   is   directly<br \/>\nchallenged   in   Civil   Appeal   No.<\/p>\n<p>10281\/2003.\n<\/p>\n<p>             Having  heard   the  learned   counsel   for the<br \/>\nparties,  we  are  satisfied   that   the<\/p>\n<p>approach adopted by the Special Court in rejecting the application for<br \/>\nsetting aside the<\/p>\n<p>ex-parte   decree   moved   by   the   appellant   has   been   too<br \/>\nrigid.   It   is   well   settled   that,<\/p>\n<p>ordinarily, a litigant should not be denied a hearing on merits unless<br \/>\nsomething akin to<\/p>\n<p>gross  negligence  or misconduct  on  his  part in  contesting  the<br \/>\nproceedings  is  made out.\n<\/p>\n<p>Admittedly, in the present case, the appellant is a company  having<br \/>\nits corporate office<\/p>\n<p>at Kolkata. According to it, it had instructed its solicitors at<br \/>\nKolkata who, in their turn,<\/p>\n<p>had instructed solicitors in Bombay to appear and plead for the <\/p>\n<p>appellant. It is pointed out that, initially, there was an <\/p>\n<p>appearance   by   the   Bombay   solicitors   but,   later   on,<br \/>\nthere   was   a   default   in   the<\/p>\n<p>appearance and sometime  before  the matters were taken up for hearing<br \/>\nby the Special<\/p>\n<p>Court, one of the members of the firm of solicitors for the appellant<br \/>\nat Kolkata, who was<\/p>\n<p>looking   after   the   appellant&#8217;s   cases,   had   suffered   a<br \/>\nserious   accident   and   remained<\/p>\n<p>immobilized   for  a  period  of about  nine  months.  In such<br \/>\ncircumstances,  we  agree with<\/p>\n<p>the learned senior counsel for the appellant that a liberal view ought<br \/>\nto have been taken<\/p>\n<p>by the Special  Court and  the ex-parte decree  should  have been set<br \/>\naside. We place on<\/p>\n<p>record the plea vehemently  raised by the learned senior counsel  for<br \/>\nthe appellant that<\/p>\n<p>it is the  same claim which forms part of two proceedings and  there<br \/>\nhas been in effect a<\/p>\n<p>double   decree   for   the   same   amount   passed   against   the<br \/>\nappellant   and     if   only   the<\/p>\n<p>appellant   would   have   been   given   an   opportunity   of<br \/>\ndefending   itself,   it   would   have<\/p>\n<p>demonstrated   that   the   payments   made   by   the   appellant<br \/>\nhave   more  than   satisfied   the<\/p>\n<p>respondents&#8217; claim. We note the pleas, but we are not expressing any<br \/>\nopinion thereon.\n<\/p>\n<p>                 In   the   totality   of   the   facts   and<br \/>\ncircumstances   of   the   two   cases,     we   are<\/p>\n<p>satisfied   that   the   appellant   deserves   to   be   allowed   an<br \/>\nopportunity   of   hearing   and<\/p>\n<p>contesting the two cases on merits.\n<\/p>\n<p>                 The   appeals   are   allowed   as   per   the<br \/>\ncondition   expressed   hereunder.   The<\/p>\n<p>impugned   order   dated   17.9.2003   rejecting   the   application<br \/>\nfor   setting   aside   ex-parte<\/p>\n<p>decree dated 9.7.2003 is set aside and the ex-parte decree dated<br \/>\n9.7.2003 is set aside. The<\/p>\n<p>ex-parte decree dated 3.7.2003 is also set aside.\n<\/p>\n<p>                 Both   the   cases   shall   stand   restored   to<br \/>\nthe   file   of   the   Special   Court.\n<\/p>\n<p>                 The appellant is allowed the  liberty of filing<br \/>\nwritten statements in both the<\/p>\n<p>cases   and   contesting   on   merits   but   subject   to   the<br \/>\ncondition   that   the   appellant   shall<\/p>\n<p>within a period  of  four  weeks  from  today  deposit  an  amount  of <\/p>\n<p>Rs.14,53,327.23 ps with the Special Court which amount shall be<br \/>\nretained in deposit by<\/p>\n<p>the  Special   Court.   The   Court   may  invest   the   amount   in<br \/>\nan   interest   bearing   account<\/p>\n<p>with   any  Scheduled   Bank.  The   amount   shall   be   available<br \/>\nto  be   disbursed   subject  to<\/p>\n<p>final decision  in the cases by the Special Court. Failing compliance<br \/>\nwith the above-said<\/p>\n<p>direction, the decrees passed by <\/p>\n<p>the Special Court shall stand and these appeals shall be deemed to have<br \/>\nbeen dismissed.\n<\/p>\n<p>                 The   parties   through   their   respective   counsel<br \/>\nare   directed   to  appear   before<\/p>\n<p>the Special  Court on  12.9.2005.
