Lodha, J.\n<\/p>\n<p>            Leave granted in SLP ) Nos.18030-18031\/01 and SLP<\/p>\n<p>) Nos.18231-18232\/2001.\n<\/p>\n<p>2.          This judgment will dispose of a group of fourteen civil<\/p>\n<p>appeals by special leave. Since common questions of law have been<\/p>\n<p>involved in all these appeals, it is appropriate to deal with and decide<\/p>\n<p>them by a common judgment.\n<\/p>\n<p>3.          We will confine ourselves only to the facts of Civil<\/p>\n<p>Appeals 4117-4118\/2001 for the facts of this appeal are similar to the<\/p>\n<p>facts of the other appeals comprised in this group.<\/p>\n<p><span class=\"hidden_text\">                                                                      3<\/span>\n<\/p>\n<p>4.          Rajinder Singh (1st appellant) is the owner of the land<\/p>\n<p>comprising in Khewat No. 609\/793 Khasra No.125\/21\/3(0-9), 127\/1\/2<\/p>\n<p>(2-4), 2(8-0), 3(8-18), 8(5-0), 9\/1(6-12), 125\/2(8-0), 23(8-0), 24(4-10)<\/p>\n<p>total admeasuring 51 kanals 3 marlas.          Arkinder Pal Singh (2nd<\/p>\n<p>appellant) owns the land in Khewat No. 610\/794 Khasra No.125\/2\/3<\/p>\n<p>(1-5), 3\/2(2-9), 7\/2(2-0), 8(8-0), 9\/1(1-0),13(8-0), 14(8-0), 15(4-10),<\/p>\n<p>17(8-8), 18(8-0) total admeasuring 51 kanals 12 marlas. They also<\/p>\n<p>jointly own land comprising in          Khewat No.611\/795 Khasra<\/p>\n<p>No.124\/14\/2(5-16), 15\/2(5-11), 30\/2(0-8), 31(0-8), 125\/9\/2(6-4),<\/p>\n<p>11\/1\/2\/(1-7), 19(8-0), 20(7-19), 21\/1(4-4), 124\/16\/1(3-10), 16\/4(1-16),<\/p>\n<p>125\/1\/2(4-8), 12(8-0) total admeasuring 57 kanals 6 marlas.        The<\/p>\n<p>total land owned by the appellants is 160 kanals 16 marlas situate<\/p>\n<p>in Jagadhri, District Yamuna Nagar, Haryana.<\/p>\n<p>5.          The government of Haryana through Urban Estate<\/p>\n<p>Department, at the instance of Haryana Urban Development<\/p>\n<p>Authority (`HUDA&#8217;) sought to acquire the land ( 326.43 acres) in<\/p>\n<p>Sector 20, Jagadhri, for the public purpose namely; the development<\/p>\n<p>and utilization of land for residential, institutional, commercial,<\/p>\n<p>communication, transport and wholesale market etc. A preliminary<\/p>\n<p>notification under Section 4 of the Land Acquisition Act, 1894 (for<\/p>\n<p>short `the Act&#8217;) was issued in this regard that was published in the<\/p>\n<p><span class=\"hidden_text\">                                                                      4<\/span><br \/>\nofficial gazette on March 7, 1996. The aforementioned land of the<\/p>\n<p>appellants was included therein.      The appellants filed objections<\/p>\n<p>under Section 5-A of the Act before the Land Acquisition Collector.<\/p>\n<p>The objections made by the appellants were not accepted and the<\/p>\n<p>declaration (final notification) under Section 6 of the Act was issued<\/p>\n<p>and published in the official gazette on March 6, 1997. The Land<\/p>\n<p>Acquisition Collector then issued notices under Section 9 of the Act<\/p>\n<p>calling upon the landowners to make their claim of compensation for<\/p>\n<p>all interests in the said land   that they may have.    The appellants<\/p>\n<p>filed their claim before the Land Acquisition Collector. The appellants<\/p>\n<p>were then informed by the Land Acquisition Collector to remain<\/p>\n<p>present in his office on March 3, 1999 at 11.30 A.M.      According to<\/p>\n<p>the   appellants, they remained present in the office of the Land<\/p>\n<p>Acquisition Collector on March 3, 1999 whole day but no award came<\/p>\n<p>to be announced. Since the award was not announced by the Land<\/p>\n<p>Acquisition Collector within two years of the publication of declaration<\/p>\n<p>made under Section 6, by virtue of Section 11-A of the Act, the entire<\/p>\n<p>proceedings for the acquisition of the land lapsed.<\/p>\n<p>6.           The appellants treated the lapse of the acquisition<\/p>\n<p>proceedings as withdrawal from the acquisition by the Government<\/p>\n<p>and, consequently, they filed their claim of compensation for the<\/p>\n<p><span class=\"hidden_text\">                                                                      5<\/span><br \/>\ndamage suffered by them under Section 48(2) of the Act before the<\/p>\n<p>Land Acquisition     Collector,   Urban Estate,      Panchkula.    The<\/p>\n<p>compensation was demanded on diverse grounds, inter alia, that<\/p>\n<p>their various units and establishments got affected by the proposed<\/p>\n<p>acquisition; that because of proposed acquisition they lost interest in<\/p>\n<p>the land and entered into an agreement to purchase the land<\/p>\n<p>elsewhere for establishing their industrial units, poultry farm etc.,<\/p>\n<p>that money was invested for the purchase of that land but because<\/p>\n<p>of withdrawal from acquisition, the purchase agreements were<\/p>\n<p>cancelled and the vendors forfeited the earnest money. Since the<\/p>\n<p>merits of the claim have not been examined either by the Land<\/p>\n<p>Acquisition Collector or High Court, it is not necessary to give further<\/p>\n<p>details of compensation claimed by the appellants.<\/p>\n<p>7.          The Land Acquisition Collector vide his communication<\/p>\n<p>dated September 27, 1999 informed the appellants that their claim<\/p>\n<p>under Section 48(2) of the Act was not maintainable in view of the<\/p>\n<p>judgment of this Court in the case of <a href=\"\/doc\/813599\/\">Abdul Majeed Sahib And Anr.<\/p>\n<p>vs. District Collector And Ors.,<\/a> (1997) 1 SCC 297.<\/p>\n<p>8.        The appellants challenged the order\/communication of the<\/p>\n<p>Land Acquisition Collector, Panchkula by approaching High Court of<\/p>\n<p>Punjab and Haryana. The Single Judge of that Court dismissed the<\/p>\n<p><span class=\"hidden_text\">                                                                      6<\/span><br \/>\nentire group of revision applications on November 7, 2000 and<\/p>\n<p>upheld the view of the Land Acquisition Collector, Panchkula that<\/p>\n<p>claim of compensation under Section 48 (2) of the Act was not<\/p>\n<p>maintainable.\n<\/p>\n<p>9.         The appellants sought review of the order dated<\/p>\n<p>November 7, 2000.       The review applications also came to be<\/p>\n<p>dismissed by the High Court. It is from these orders that the matters<\/p>\n<p>have reached this Court.\n<\/p>\n<p>10.        At this stage we may notice that vide Order dated May 1,<\/p>\n<p>2008, this Court directed the State of Haryana and HUDA to file an<\/p>\n<p>affidavit indicating their stand with regard to    the provisions of<\/p>\n<p>Sections 11-A, 48 &amp; 48-A of the Act.         In response thereto, an<\/p>\n<p>affidavit has been filed on behalf of these authorities. The stand of<\/p>\n<p>these authorities is that the provisions of Section 11-A and 48 of the<\/p>\n<p>Act are distinct and different. As per Section 11-A, the Collector is<\/p>\n<p>under a statutory obligation to make an award under Section 11<\/p>\n<p>within a period of two years from the date of the publication of the<\/p>\n<p>declaration under Section 6 of the Act. Failure on the part of the<\/p>\n<p>Collector to make the award within the said period, subject to the<\/p>\n<p>exclusion of the time as provided in the explanation attached to<\/p>\n<p>Section 11-A entails lapse of acquisition proceedings. On the other<\/p>\n<p><span class=\"hidden_text\">                                                                    7<\/span><br \/>\nhand, Section 48 empowers the Government to withdraw from the<\/p>\n<p>acquisition of any land of which possession has not been taken. In<\/p>\n<p>order to withdraw from the acquisition, there has to be publication of<\/p>\n<p>notification withdrawing notification under Section 4(1) and        the<\/p>\n<p>declaration published under Section 6 of the Act. As there was no<\/p>\n<p>notification issued and published under Section 48(1) of the Act<\/p>\n<p>withdrawing from acquisition of the land of the appellants covered<\/p>\n<p>under Notifications dated March 7, 1996 and March 6, 1997 under<\/p>\n<p>Sections 4 and 6 of the Act respectively, the appellants are not<\/p>\n<p>entitled to any compensation under Section 48(2) of the Act.      They<\/p>\n<p>stated that acquisition proceedings have not been withdrawn but<\/p>\n<p>lapsed for the reason that the Collector failed to make an award<\/p>\n<p>under Section 11-A of the Act relating to the land of the appellants.<\/p>\n<p>With regard to Section 48-A, it was submitted that the said section<\/p>\n<p>has not been incorporated in the Act for all intents and purposes. Its<\/p>\n<p>application is confined to the schemes framed by the Urban<\/p>\n<p>Improvement Trust under Punjab Town Improvement Act, 1922.<\/p>\n<p>11.        An additional affidavit came to be filed by the 1st appellant<\/p>\n<p>after the afore-referred response was filed by the respondents. In his<\/p>\n<p>additional affidavit, he stated that he made application under the<\/p>\n<p>Right to Information Act, 2005 and has procured (i) copy of the letter<\/p>\n<p><span class=\"hidden_text\">                                                                     8<\/span><br \/>\ndated March 5, 1999 from the Chief Administrator, HUDA; (ii) three<\/p>\n<p>pages of file notings regarding the decision not to approve acquisition<\/p>\n<p>of 326.43 acres of land in Sector 20, Jagadhri; (iii) copy of office<\/p>\n<p>memo dated January 10, 1997 and (iv) copy of letter dated March<\/p>\n<p>18, 1999 of the Estate Officer, HUDA, Jagadhri.       The 1st appellant,<\/p>\n<p>thus, stated in the additional affidavit that the aforesaid documents<\/p>\n<p>would show that the competent authority had not approved the<\/p>\n<p>acquisition of 326.43 acres of land in Sector 20, Jagadhri as the<\/p>\n<p>proposal was not viable and that the intention of the Government not<\/p>\n<p>to acquire the land amounted to withdrawal from the acquisition for<\/p>\n<p>all intents and purposes.\n<\/p>\n<p>12.         In reply to the additional affidavit, the respondents 2 to 4<\/p>\n<p>reiterated that the intention of the State Government not to acquire<\/p>\n<p>the land is not a withdrawal from acquisition under Section 48(1) of<\/p>\n<p>the Act.\n<\/p>\n<p>13.         Mr.    P.S.Patwalia,   learned   senior   counsel   for   the<\/p>\n<p>appellants submitted at the outset, and in our view fairly, that Section<\/p>\n<p>48-A has not been incorporated in the Act. He did not rely upon<\/p>\n<p>Section 48-A.     He referred to the file notings regarding the decision<\/p>\n<p>of the Government not to approve the acquisition of 326.43 acres of<\/p>\n<p>land in Sector 20, Jagadhri and communication to that effect to the<\/p>\n<p><span class=\"hidden_text\">                                                                       9<\/span><br \/>\nLand Acquisition Collector and submitted that        non-approval of<\/p>\n<p>acquisition by the State Government was nothing but a voluntary<\/p>\n<p>withdrawal from the acquisition and communication of that decision<\/p>\n<p>to the Land Acquisition Collector was sufficient publication of the<\/p>\n<p>decision of the Government to withdraw from         acquisition.   The<\/p>\n<p>learned senior counsel would submit that Section 48 does not speak<\/p>\n<p>of notification being issued for withdrawal of acquisition and,<\/p>\n<p>therefore, the decision of the State Government in not approving the<\/p>\n<p>acquisition was a decision of withdrawal from the acquisition and, the<\/p>\n<p>petition for compensation made by the appellants under Section 48<\/p>\n<p>(2) of the Act was maintainable.\n<\/p>\n<p>14.        The counsel for the respondent No.1 as well as<\/p>\n<p>respondent Nos. 2 to 4, however, urged that first proviso to Section<\/p>\n<p>11 mandates the Collector to seek approval from the appropriate<\/p>\n<p>government before making the award.         In the present case, the<\/p>\n<p>Collector sought approval of the award from the appropriate<\/p>\n<p>government but the government did not grant approval and, thus,<\/p>\n<p>award could not be made by the Collector. It was submitted by the<\/p>\n<p>learned counsel that non-grant of approval by the State Government<\/p>\n<p>is not withdrawal from acquisition. Since award was not made within<\/p>\n<p>a period of two years from the date of publication of the declaration,<\/p>\n<p><span class=\"hidden_text\">                                                                    1<\/span><br \/>\n<span class=\"hidden_text\">                                                                    0<\/span><br \/>\nthe entire proceedings for the acquisition of the land lapsed. Thus,<\/p>\n<p>according to the learned counsel, the State Government had not<\/p>\n<p>withdrawn from the acquisition and there being no notification issued<\/p>\n<p>to that effect, petition for compensation under Section 48(2) of the<\/p>\n<p>Act was not maintainable.\n<\/p>\n<p>15.         On the contentions urged, two points arise for our<\/p>\n<p>consideration:\n<\/p>\n<blockquote><p>            (one)     Whether in view of the decision of the<br \/>\n            government in not approving the award proposed<br \/>\n            by the Collector, the award could not be made<br \/>\n            within the period of two years from the date of<br \/>\n            publication of declaration (final notification under<br \/>\n            Section 6) and the acquisition of land lapsed, would<br \/>\n            such lapse of acquisition proceedings amount to<br \/>\n            withdrawal from the acquisition by the State<br \/>\n            Government under Section 48(1) of the Act ?\n<\/p><\/blockquote>\n<blockquote><p>            (two)         Whether the decision of the State<br \/>\n            Government for withdrawal from the acquisition<br \/>\n            under Section 48 (1) is mandatorily required to be<br \/>\n            published in the official gazette ?\n<\/p><\/blockquote>\n<p>re : point (one)<\/p>\n<p>16.         Section 4 of the Act provides for publication of preliminary<\/p>\n<p>notification whenever it appears to the appropriate government that<\/p>\n<p>land is needed or likely to be needed for any public purpose. Inter<\/p>\n<p>alia, such notification is required to be published in the official<\/p>\n<p>gazette.\n<\/p>\n<p>\n<span class=\"hidden_text\">                                                                      1<\/span><br \/>\n<span class=\"hidden_text\">                                                                      1<\/span>\n<\/p>\n<p>17.           The person interested in the land having been notified<\/p>\n<p>under Section 4 may file objections to the acquisition of that land and<\/p>\n<p>other aspects as provided in Section 5-A.\n<\/p>\n<p>18.           When the appropriate government is satisfied after<\/p>\n<p>considering the report from the Collector, if any, made under Section<\/p>\n<p>5-A(2) that     any particular land is needed for a public purpose, as<\/p>\n<p>per Section 6 of the Act a declaration shall be made and, inter alia,<\/p>\n<p>published in the official gazette. The said declaration is conclusive<\/p>\n<p>evidence that land is needed for a public purpose.<\/p>\n<p>19.           Section 9 makes a provision for notice to persons<\/p>\n<p>interested in the land intimating them the government&#8217;s intention to<\/p>\n<p>take possession and that they may claim compensation for their<\/p>\n<p>interest in such land.\n<\/p>\n<p>20.           Section 11 provides for an enquiry into measurements,<\/p>\n<p>value and claims and award by the Collector. It reads as follows:<\/p>\n<blockquote><p>              &#8220;11. (1) On the day so fixed, or on any other day to<br \/>\n              which the enquiry has been adjourned, the<br \/>\n              Collector shall proceed to enquire into the<br \/>\n              objections (if any) which any person interested has<br \/>\n              stated pursuant to a notice given under Section 9 to<br \/>\n              the measurements made under Section 8, and into<br \/>\n              the value of the land at the date of the publication of<br \/>\n              the notification under Section 4, sub-section (1),<br \/>\n              and into the respective interests of the persons<br \/>\n              claiming the compensation and shall make an<br \/>\n              award under his hand of &#8211;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                                        1<\/span><br \/>\n<span class=\"hidden_text\">                                                                        2<\/span><\/p>\n<pre>(i)       the true area of the land;\n\n(ii)    the compensation which in his opinion should\n        be allowed for the land; and\n\n<\/pre>\n<blockquote><p>(iii)   the apportionment of the said compensation<br \/>\n        among all the persons known or believed to<br \/>\n        be interested in the land, of whom, or of<br \/>\n        whose claims, he has information, whether or<br \/>\n        not they have respectively appeared before<br \/>\n        him:<\/p><\/blockquote>\n<p>      Provided that no award shall be made by the<br \/>\nCollector under this sub-section without the<br \/>\nprevious approval of the appropriate Government or<br \/>\nof such officer as the appropriate Government may<br \/>\nauthorise in this behalf:\n<\/p>\n<p>      Provided further that it shall be competent for<br \/>\nthe appropriate Government to direct that the<br \/>\nCollector may make such award without such<br \/>\napproval in such class of cases as the appropriate<br \/>\nGovernment may specify in this behalf.\n<\/p>\n<p>(2)     Notwithstanding anything contained in sub-<br \/>\nsection (1), if at any stage of the proceedings, the<br \/>\nCollector is satisfied that all the persons interested<br \/>\nin the land who appeared before him have agreed<br \/>\nin writing on the matters to be included in the award<br \/>\nof the Collector in the form prescribed by rules<br \/>\nmade by the appropriate Government, he may,<br \/>\nwithout making further enquiry, make an award<br \/>\naccording to the terms of such agreement.\n<\/p>\n<p>(3)    The determination of compensation for any<br \/>\nland under sub-section (2) shall not in any way<br \/>\naffect the determination of compensation in respect<br \/>\nof other lands in the same locality or elsewhere in<br \/>\naccordance with the other provisions of this Act.<\/p>\n<p><span class=\"hidden_text\">                                                         1<\/span><br \/>\n<span class=\"hidden_text\">                                                         3<\/span><br \/>\n         (4)       Notwithstanding anything contained in the<br \/>\n               Registration Act, 1908, (16 of 1908), no<br \/>\n               agreement made under sub-section (2) shall be<br \/>\n               liable to registration under that Act.&#8221;\n<\/p>\n<\/p>\n<p>21.       Section 11-A provides as follows:\n<\/p>\n<blockquote><p>          &#8220;11-A. The Collector shall make an award under<br \/>\n          Section 11 within a period of two years from the<br \/>\n          date of the publication of the declaration and if no<br \/>\n          award is made within that period, the entire<br \/>\n          proceedings for the acquisition of the land shall<br \/>\n          lapse:\n<\/p><\/blockquote>\n<blockquote><p>                 Provided that in a case where the said<br \/>\n          declaration has been published before the<br \/>\n          commencement        of   the  Land  Acquisition<br \/>\n          (Amendment) Act, 1984, the award shall be made<br \/>\n          within    a    period of two years  from such<br \/>\n          commencement.\n<\/p><\/blockquote>\n<blockquote><p>          Explanation &#8211;In computing the period of two years<br \/>\n          referred to in this section, the period during which<br \/>\n          any action or proceeding to be taken in pursuance<br \/>\n          of the said declaration is stayed by an order of a<br \/>\n          Court shall be excluded.&#8221;\n<\/p><\/blockquote>\n<p>22.       Section 48 enables the State Government to withdraw<\/p>\n<p>from the acquisition in the circumstances mentioned therein.     It<\/p>\n<p>reads:\n<\/p>\n<blockquote><p>          &#8220;48 &#8211; (1) Except in the case provided for in Section<br \/>\n          36, the Government shall be at liberty to withdraw<br \/>\n          from the acquisition of any land of which<br \/>\n          possession has not been taken.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                                 1<\/span><br \/>\n<span class=\"hidden_text\">                                                                 4<\/span><\/p>\n<p>                   (2) Whenever the Government withdraws from<br \/>\n            any such acquisition, the Collector shall determine<br \/>\n            the amount of compensation due for the damage<br \/>\n            suffered by the owner in consequence of the notice<br \/>\n            or of any proceedings thereunder, and shall pay<br \/>\n            such amount to be person interested, together with<br \/>\n            all costs reasonably incurred by him in the<br \/>\n            prosecution of the proceedings under this Act<br \/>\n            relating to the said land.\n<\/p>\n<p>                  (3)The provisions of Part III of this Act shall<br \/>\n            apply, so far as may be, to the determination of the<br \/>\n            compensation payable under this section.&#8221;\n<\/p>\n<\/p>\n<p>23.        From the perusal of Section 11, particularly first proviso<\/p>\n<p>thereto, it is apparent that the approval of the appropriate<\/p>\n<p>government to the award proposed by the Collector is mandatory. In<\/p>\n<p>other words, it is imperative for the Collector to seek previous<\/p>\n<p>approval of the appropriate government to the award that he<\/p>\n<p>proposes to make unless the case is covered by Section 11(2).         If<\/p>\n<p>an award under Section 11 is not made by the Collector within a<\/p>\n<p>period of two years from the date of the publication of the declaration,<\/p>\n<p>the entire proceedings for the acquisition of the land shall lapse<\/p>\n<p>under Section 11-A. Section 11-A provides maximum period within<\/p>\n<p>which the award from the date of the publication of the declaration<\/p>\n<p>has to be made.      In default, the consequence is that the entire<\/p>\n<p>proceedings for the acquisition would lapse. Section 48(1) empowers<\/p>\n<p><span class=\"hidden_text\">                                                                      1<\/span><br \/>\n<span class=\"hidden_text\">                                                                      5<\/span><br \/>\nthe State Government to withdraw from the acquisition of any land<\/p>\n<p>subject to two conditions namely; (i) the case is not provided under<\/p>\n<p>Section 36 and (ii) that possession has not been taken. Section 11-<\/p>\n<p>A and the consequence provided therein i.e., lapse of acquisition<\/p>\n<p>proceedings in the event of the award having not been made within<\/p>\n<p>a period of two years from the date of publication of the declaration<\/p>\n<p>under Section 6 is entirely distinct and different than the decision that<\/p>\n<p>the government may take for withdrawal from the acquisition under<\/p>\n<p>Section 48(1), provided possession has not been taken. It is only in<\/p>\n<p>a case where the Government withdraws from the acquisition under<\/p>\n<p>Section 48(1), that by virtue of Section 48(2), the claim for<\/p>\n<p>compensation for the damage suffered by the owner in consequence<\/p>\n<p>of the acquisition proceedings together with costs could be made.<\/p>\n<p>The statutory lapse of acquisition proceedings under Section 11-A<\/p>\n<p>as a result of non-grant of approval of proposed award by the State<\/p>\n<p>Government or for any other reason would not tantamount to<\/p>\n<p>withdrawal   from    acquisition   by   the   State   Government      as<\/p>\n<p>contemplated under Section 48(1).       As a necessary corollary, no<\/p>\n<p>claim for compensation could be made under Section 48(2) of the<\/p>\n<p>Act.\n<\/p>\n<p><span class=\"hidden_text\">                                                                       1<\/span><br \/>\n<span class=\"hidden_text\">                                                                       6<\/span>\n<\/p>\n<p>24.          In the context of Section 48, the word &#8220;withdraw&#8221; is<\/p>\n<p>indicative of the voluntary and conscious decision of the government<\/p>\n<p>for withdrawal from the acquisition; statutory lapse under Section 11-<\/p>\n<p>A is entirely different. The object of Section 11-A is to arrest delay in<\/p>\n<p>making award. An obligation is cast on the Collector under Section<\/p>\n<p>11-A to make the award within the time prescribed therein failing<\/p>\n<p>which statutory consequence follows namely, acquisition proceedings<\/p>\n<p>lapse automatically. This Court in Abdul Majeed said:<\/p>\n<blockquote><p>              &#8220;The word `withdraws&#8217; would indicate that the<br \/>\n            Government by its own action voluntarily withdraws<br \/>\n            from the acquisition; the Government has<br \/>\n            necessarily to withdraw from the acquisition, in<br \/>\n            other words, there should be publication of the<br \/>\n            withdrawal     of the notification published under<br \/>\n            Section 4(1) and the declaration published under<br \/>\n            Section 6 by exercising the power under Section 48<br \/>\n            (1). Sub-section (2) of Section 48 would then apply.<br \/>\n            In this case, admittedly, the Government had not<br \/>\n            exercised the power under Section 48(1)<br \/>\n            withdrawing from the notification under Section 4(1)<br \/>\n            or the declaration under Section 6. The statutory<br \/>\n            lapse under Section 11-A is distinct different from<br \/>\n            voluntary act on the part of the Government.<br \/>\n            Therefore, it must be by withdrawal of the<br \/>\n            notification by voluntary act on the part of the State<br \/>\n            under Section 48(1). Under these circumstances,<br \/>\n            the appellant is not entitled to avail of the remedy of<br \/>\n            sub-section (2) of Section 48.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                                       1<\/span><br \/>\n<span class=\"hidden_text\">                                                                       7<\/span><\/p>\n<p>25.         As a matter of fact, the Land Acquisition Collector<\/p>\n<p>followed Abdul Majeed and held that the claim of the appellants<\/p>\n<p>under Section 48(2) was not maintainable.\n<\/p>\n<p>26.         As noticed above, the Land Acquisition Collector moved<\/p>\n<p>the government seeking its approval for the proposed award. This<\/p>\n<p>was imperative as per the first proviso to Section 11.            The<\/p>\n<p>government considered the matter and did not approve the proposed<\/p>\n<p>award. When no such approval was granted by the government, the<\/p>\n<p>Collector could not have made the award and in fact he did not. As a<\/p>\n<p>result thereof, the acquisition proceedings lapsed.     The lapse of<\/p>\n<p>acquisition proceedings in the circumstances under Section 11-A<\/p>\n<p>cannot and would not amount to withdrawal from acquisition by the<\/p>\n<p>government under Section 48(1).      We answer the point (one) in<\/p>\n<p>negative.\n<\/p>\n<p>re : point (two)<\/p>\n<p>27.         The question now needs to be considered is: whether<\/p>\n<p>the decision of the Government for withdrawal of acquisition under<\/p>\n<p>Section 48(1) is required to be published in official gazette ?   It is<\/p>\n<p>true that Section 48 does not in express terms require the decision of<\/p>\n<p>the government for withdrawal of acquisition to be published in the<\/p>\n<p><span class=\"hidden_text\">                                                                    1<\/span><br \/>\n<span class=\"hidden_text\">                                                                    8<\/span><br \/>\nofficial gazette. In Abdul Majeed,     this Court has held that there<\/p>\n<p>should be publication of the withdrawal of the notification published<\/p>\n<p>under Section 4(1) and declaration under Section 6 by exercising<\/p>\n<p>power under Section 48(1).           Even on first principles, such<\/p>\n<p>requirement appears to be implicit.        The Act provides for the<\/p>\n<p>publication of notification and declaration under Sections 4 and 6 of<\/p>\n<p>the Act in official gazette. Obviously the withdrawal from land<\/p>\n<p>acquisition proceedings by taking resort to Section 48(1) of the Act<\/p>\n<p>also must be in the like manner.     As a matter of fact, this aspect is<\/p>\n<p>no more res integra. In the case of <a href=\"\/doc\/1788830\/\">Larsen &amp; Toubro Ltd. vs. State of<\/p>\n<p>Gujarat And Ors.,<\/a> (1998) 4 SCC 387, the identical contentions which<\/p>\n<p>have been advanced before us by the senior counsel were raised in<\/p>\n<p>that case. Section 21 of the General Clauses Act, 1897 was also<\/p>\n<p>pressed into service there. This Court considered:<\/p>\n<blockquote><p>           &#8220;It was submitted by Mr. Salve that Section 48 of<br \/>\n           the Act did not contemplate issue of any notification<br \/>\n           and withdrawal from the acquisition could be by<br \/>\n           order simpliciter. He said that Sections 4 and 6<br \/>\n           talked of notifications being issued under those<br \/>\n           provisions but there was no such mandate in<br \/>\n           Section 48. It was thus contended that when the<br \/>\n           statute did not require to issue any notification for<br \/>\n           withdrawal from the acquisition, reference to<br \/>\n           Section 21 of the General Clauses Act was not<br \/>\n           correct. Section 21 of the General Clauses Act is<br \/>\n           as under:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                                      1<\/span><br \/>\n<span class=\"hidden_text\">                                                                      9<\/span><\/p>\n<p>            &#8220;21. Power to issue, to include power to<br \/>\n     add to, to amend, vary or rescind,<br \/>\n     notifications, orders, rules or bye-laws.&#8211;<br \/>\n     Where by any Central Act, or Regulation, a<br \/>\n     power to issue notifications, orders, rules, or<br \/>\n     bye-laws is conferred, then that power<br \/>\n     includes a power, exercisable in the like<br \/>\n     manner and subject to the like sanction and<br \/>\n     conditions (if any) to add to, amend, vary or<br \/>\n     rescind any notifications, orders, rules or<br \/>\n     bye-laws so issued.&#8221;\n<\/p>\n<p>Mr. Salve said that Section 21 expressly referred to<br \/>\nthe powers being given to issue notifications etc.<br \/>\nunder an Act or Regulation and under this that<br \/>\npower included power to withdraw or rescind any<br \/>\nnotification in a similar fashion. It was therefore<br \/>\nsubmitted that when Section 48 did not empower<br \/>\nthe State Government to issue any notification and<br \/>\nit could not be read into that provision that<br \/>\nwithdrawal had to be issued by a notification. His<br \/>\nargument, therefore, appeared to be that on correct<br \/>\ninterpretation of Section 21 of the General Clauses<br \/>\nAct before reaching the stage of Section 48, the<br \/>\nState Government could withdraw notifications<br \/>\nunder Sections 4 and 6 of the Act by issuing<br \/>\nnotifications withdrawing or rescinding earlier<br \/>\nnotifications and that would be the end to the<br \/>\nacquisition proceedings. We do not think that Mr.<br \/>\nSalve is quite right in his submissions. When<br \/>\nSections 4 and 6 notifications are issued, much has<br \/>\nbeen done towards the acquisition process and that<br \/>\nprocess cannot be reversed merely by rescinding<br \/>\nthose notifications. Rather it is Section 48 under<br \/>\nwhich, after withdrawal from acquisition is made,<br \/>\ncompensation due for any damage suffered by the<br \/>\nowner during the course of acquisition proceedings<br \/>\nis determined and given to him. It is, therefore,<br \/>\nimplicit that withdrawal from acquisition has to be<br \/>\nnotified.\n<\/p>\n<p><span class=\"hidden_text\">                                                       2<\/span><br \/>\n<span class=\"hidden_text\">                                                       0<\/span><br \/>\n            Principles of law are, therefore, well settled. A<br \/>\n            notification in the Official Gazette is required to be<br \/>\n            issued if the State Government decides to withdraw<br \/>\n            from the acquisition under Section 48 of the Act of<br \/>\n            any land of which possession has not been taken&#8221;.<\/p>\n<p>28.         In view of the legal position exposited by this Court in the<\/p>\n<p>case of Larsen &amp; Toubro Ltd., with which we respectfully agree, we<\/p>\n<p>hold, as it must be, that decision of the government for withdrawal<\/p>\n<p>from acquisition has to be published in the official gazette.           We<\/p>\n<p>answer point (two) in affirmative.\n<\/p>\n<p>29.         In so far as present case is concerned, firstly, there is no<\/p>\n<p>decision by the government for withdrawal from the acquisition. Even<\/p>\n<p>if we assume for the argument sake that such decision was taken on<\/p>\n<p>the file, since such decision has not been published in the official<\/p>\n<p>gazette, there is no withdrawal from the acquisition by the State<\/p>\n<p>Government within the meaning of Section 48(1) of the Act. The<\/p>\n<p>application under Section 48(2) of the Act was, therefore, rightly held<\/p>\n<p>to be not maintainable.\n<\/p>\n<p>30.         In view of what we have discussed above, all these<\/p>\n<p>appeals fail and are liable to be dismissed and are dismissed with no<\/p>\n<p>order as to costs.\n<\/p>\n<p>                                                  &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..J<br \/>\n                                                           (D.K.
