He\nhas  certain shares and the\nresponclents  After his retirement,\n\npetitioner4\"4\"'is:V residiing\ufb01 at Bangalore and during the\n\n. V.  Cours\u00e9\"i'iof'\"'the serifice and thereafter the petitioner had\n\n Vinvested._i\"n Sh-ares of Various Companies. At that point\n\noAf\"t.imefa -representative of the respondent-Company had\n\n  requested him to become their Client. Accordingly, the\n\n\"petitioner became the client of the respondent and\n\nit \" \"certain terms were agreed upon between the petitioner\n\nand the respondent, which is reduced in writing, which\n\n\/'\n\n_\/X\n\n\n\n-3-\n\nis styled as \"Agreement between a participant and a\n\nperson seeking to open a beneficial owner's account\".\n\n2. A perusal of the said agreement \nthere is an arbitral clause. The  b \npetitioner is that without \nrespondents have sold .Vce__rtain\u00bb.V_\"shareg3}7-  \nresulted in loss to the tune of\nRs.40,00,000\/~ (Rupees  only). The\ngrievance of thevgpetitioner transaction has\nbeen dong   notice has been\nissued  calling upon them to have the\ndispute an arbitrator. The\n\nres.pon'dent ha-sinotgresponded to the said notice.\n\n   it  heard the learned counsel appearing for\n\nthe peti_tioner as well as counsel appearing for\n\nV respondent.\n\n4. Learned counsel appearing for the petitioner\n\nsubmits that notwithstanding the fact that one of the\n\nterms of the agreement is that arbitrai proceedings are \/Q\n\nC\/\/\/K\n\n\n\n-4-\n\nto be held at Mumbai. Nevertheless, having regard to\nSection 20 of the Arbitration and Conciliation Act, 1996,\nparties are free to choose the place of arbitratio:n;..V' He\nfurther submits that the petitioner is a \nand is besotted with various aiirrients  \ndisease of Cancer for  \nSt.Johns Medical College,'\u00ab--..__l3arig.alore'.  \nsubmits that the  oi  is at\nMumbai and they  at Bangalore.\n\nHence. this Court als'o\"'i1as  to deal with\n\nthe rriatten g in\n\n5; \"Learned  appearing for the respondent\n\n thati~..l:h_aying regard to the terms of the\n\n\u00bbv:agree1ir1ent.,;\"'-- arbitral proceedings are to be held at\n\nthe petition is not maintainable.\n\n'C \u20ac5.11 have perused the terms of the agreement.\n\n7. Apparently, respondents have also a branch\n\noffice at Bangalore. indeed, the petitioner is also\n\nresiding in Bangalore. It is no doubt true that the \/3;\n\n..\/\/1\".\/'\n\n\n\n-5-\n\nagreement would contain an arbitral c1ause,'___which\nwould speak about the place of arbitration;f..l_V\"But\nhowever, a perusal of Section 20 of \nindicate that the parties are freeto.agreel'\u00a7'\ufb01:l{ti:eV'pllacQ'of ' ; ll\narbitration. Snb--Section (2) wo'ug1ci'..'_A'aLi'so\nthe parties do not agree  the placedni\"VV':arbitration;'L\narbitral proceedings;-'shall be' to the\nconvenience of the    of the said\nprovision clearly  the\nplace of   the agreement, it is\nalways'opei\u00a7vi,:for:7'tfie:l:partiesliuto'agree upon the place of\n\narbitration. V\n\n 'V8'; In thevcase on hand, it is to be noticed that the\n\n\u00bb has its branch office at Bangalore and\n\n. 'having to the fact that the petitioner is a senior\n\ncitizen'' and is also suffering from various ailments, I am\n\n'A  l\"the view that petition is maintainable in this Court.\n\nSince a dispute has arisen between the petitioner and\n\nrespondent in respect of terms of the agreement as well\n\nas sale of shares, I am of the view that the matter is ff;\n\n_,:\/72\"'\n\n\n\n-6-\n\nrequired to be resolved by appointing an arbitrator.\n\nHence, the following order is passed:\n\n(1) Petition is allowed.
