NO.1055 OF 2009\n\n                      -----------------------------------------\n\n                             Dated 25th May, 2009.\n\n                                  JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>       The appellants are respondents 4 to 6 in the Writ Petition.       This<\/p>\n<p>appeal is filed by them, feeling aggrieved by the interim order passed by the<\/p>\n<p>learned Single Judge on 7.4.2009. The operative portion of the said order<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>             &#8220;3. Pending further orders in the matter, it is clarified<br \/>\n       that the interim order passed in this case will not stand in the<br \/>\n       way of the 3rd respondent granting appropriate promotion to the<br \/>\n       6th respondent.   The interim order granted will continue for<br \/>\n       another two months subject to the modification shown above.&#8221;<\/p><\/blockquote>\n<p>       2. Going by the above order, we notice that no appeal will lie against<\/p>\n<p>it, in view of the principles laid down by the larger Bench of this Court in<\/p>\n<p>K.S.Das v. State of Kerala [1992(2) K.L.T. 358(FB)]. The interim order<\/p>\n<p>will remain in force only up to 6.6.2009. The learned Judge has also noticed<\/p>\n<p>the possibility of passing further orders in the matter. If the appellants are<\/p>\n<p>aggrieved by the interim order granted, they can bring it to the notice of the<\/p>\n<p><span class=\"hidden_text\">WA 1055\/2009                          2<\/span><\/p>\n<p>learned Single Judge, when the matter comes up for further extension of that<\/p>\n<p>order. In view of the above position, it is unnecessary to entertain this<\/p>\n<p>appeal. Further, going by the nature of the order impugned, no appeal will<\/p>\n<p>lie against it.
