M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Senior counsel Mr. R.R.Marshal assisted by Mr. Adil Mirza,<br \/>\nappearing for the appellant. Learned counsel for the appellant has<br \/>\nurged that without there being any adjudication under section 10 of<br \/>\nthe Industrial Disputes Act, (for short &#8220;Act&#8221;)<br \/>\nstraightaway, the respondent could not claim the arrears of salary,<br \/>\nbonus, overtime allowance and salary etc. in proceedings under<br \/>\nsection 33(C)(2) of the \tAct. In support of his argument, learned<br \/>\ncounsel for the appellant has placed reliance on the decision of the<br \/>\nApex Court in D.Krishnan<br \/>\nand another v.Special Officer, Vellore Cooperative Sugar Mill and<br \/>\nanother (2008) 7 SCC 22 wherein the Apex Court in para-12<br \/>\nhas held as under:\n<\/p>\n<p>&#8220;12.  We<br \/>\nhave considered the arguments advanced by the learned counsel for the<br \/>\nparties. The fact that proceedings under Section 33(C(2) are in the<br \/>\nnature of execution proceedings is in no doubt, and such proceedings<br \/>\npresuppose some adjudication leading to the determination of a right,<br \/>\nwhich has to be enforced. Concededly there has been no such<br \/>\nadjudication in the present case. It will be seen that the reliance<br \/>\nof the appellant workmen is exclusively on documentary evidence<br \/>\nplaced on record which consisted primarily of the punch time cards<br \/>\nand the representations that had been filed from time to time before<br \/>\nthe respondents. It is also true that the claim raised by the<br \/>\nappellants had been hotly disputed by the respondents. The question<br \/>\nthat arises in this situation is whether reliance only on the<br \/>\ndocumentary evidence was sufficient to prove the case.&#8221;\n<\/p>\n<p>2.\t\tLearned<br \/>\ncounsel for the appellant has also placed reliance on another<br \/>\ndecision of the Apex Court in State<br \/>\nof U.P. and another vs. Brijpal Singh (2005)8 SCC 58,<br \/>\nwherein the Apex Court in para-10 has held as under:\n<\/p>\n<p>&#8220;10.  It<br \/>\nis well settled that the workman can proceed under Section 33-C(2)<br \/>\nonly after the Tribunal has adjudicated on a complaint under Section<br \/>\n33-A or on a reference under Section 10 that the order of discharge<br \/>\nor dismissal was not justified and has set aside that order and<br \/>\nreinstated the workman. This Court in the case of Punjab Beverages<br \/>\n(P) Ltd. v.Suresh Chand held that a proceeding under Section 33-C(2)<br \/>\nis a proceeding in the nature of execution proceeding in which the<br \/>\nLabour Court calculates the amount of money due to a workman from the<br \/>\nemployer, or, if the workman is entitled to any benefit which is<br \/>\ncapable of being computed in terms of money, proceeds to compute the<br \/>\nbenefit in terms of money. Proceeding further, this Court held that<br \/>\nthe right to the money which is sought to be calculated or to the<br \/>\nbenefit which is sought to be computed must be an existing one, that<br \/>\nis to say,already adjudicated upon or provided for and must arise in<br \/>\nthe course of and in relation to the relationship between the<br \/>\nindustrial workman, and his employer&#8230;&#8221;\n<\/p>\n<p>In<br \/>\nview of the aforesaid two decisions, we find force in the submission<br \/>\nof the learned counsel for the appellant. The appellant is entitled<br \/>\nfor interim relief.\n<\/p>\n<p>3.\t\tRule<br \/>\nreturnable on 29.8.2011.
