SIRI JAGAN, J\n                ...............................................\n                 W.P(C) Nos. 35532 of 2007\n                         &amp; 18131 of 2008\n               .................................................\n          Dated this the 12th day of August, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      The petitioner in these two writ petitions are the same.<\/p>\n<p>She is challenging the select list for promotion to the posts of<\/p>\n<p>Professor and Assistant Professor in the department of Pathology<\/p>\n<p>in Medical College Service of the Government of Kerala. Prior to<\/p>\n<p>entering the Department of Pathology the petitioner had service<\/p>\n<p>in the Department of Blood Bank. Petitioner&#8217;s grievance is that<\/p>\n<p>for the purpose of seniority and promotion, the service of the<\/p>\n<p>petitioner in the blood bank is not being counted. According to<\/p>\n<p>the petitioner, several other persons who had shifted from one<\/p>\n<p>department to another had been given benefit to the service in<\/p>\n<p>the earlier department for the purpose of seniority and<\/p>\n<p>promotion. The petitioner earlier approached this court by filing<\/p>\n<p>WP(C) No. 5005 of 2003 and obtained Ext.P15 judgment to<\/p>\n<p>consider the representation filed by the petitioner in that regard.<\/p>\n<p>In compliance with that judgment, the Government has passed<\/p>\n<p>Ext.P16, again rejecting the claim of the petitioner on the ground<\/p>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                    -2-\n<\/p>\n<p>that the recruitments to blood bank and department of Pathology<\/p>\n<p>are by different Public Service Commission selections and<\/p>\n<p>therefore service in the two departments cannot be added<\/p>\n<p>together for the purpose of seniority and promotion in one<\/p>\n<p>department.      Regarding the contention of the petitioner that<\/p>\n<p>some other persons were given such benefit, the Government<\/p>\n<p>rejected the same stating that the Government finds it unhealthy<\/p>\n<p>to go after precedence and hence finds no valid reason to allow<\/p>\n<p>the request.       Petitioner submits that this stand of the<\/p>\n<p>Government is discriminatory and violative of the rights of the<\/p>\n<p>petitioner. Petitioner therefore seeks the following reliefs:<\/p>\n<blockquote><p>             &#8220;WP(C)No. 35532 of 2007<\/p>\n<\/blockquote>\n<blockquote><p>             i) issue a writ of certiorari of any other appropriate<br \/>\n       writ, order or direction calling for the records leading to<br \/>\n       Exts.P16, P20 and P21 and quash them.\n<\/p><\/blockquote>\n<blockquote><p>             ii)   issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the<br \/>\n       respondents 1 to 3 to reckon the service rendered by the<br \/>\n       petitioner between 29.8.1988 and 10.4.1990 in the<br \/>\n       Department of Blood Bank towards her qualifying service<br \/>\n       for the purpose of seniority and promotion and all other<br \/>\n       service benefits in the Department of Pathology and grant<br \/>\n       her all consequential benefits as if Ext.P16 were never<br \/>\n       issued at all.\n<\/p><\/blockquote>\n<blockquote><p>             iii) issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the 2nd<br \/>\n       respondent to pass orders on Ext.P22.<\/p><\/blockquote>\n<p>             iv) issue a writ of mandamus or any other<\/p>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                    -3-\n<\/p>\n<\/p>\n<blockquote><p>       appropriate writ, order or direction commanding the<br \/>\n       respondents 1 and 2 to review Exts.P20 and P21 by<br \/>\n       placing the petitioner above respondents 4 and 5 therein<br \/>\n       (in category of Professor) and promote her as such with<br \/>\n       effect from 12.6.2007 with all consequential benefits.\n<\/p><\/blockquote>\n<blockquote><p>             v)    issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the 1st<br \/>\n       respondent to suitably modify Exts.P11, P18 and P19 by<br \/>\n       giving credit to the petitioner&#8217;s service in the Department<br \/>\n       of Blood Bank.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>             &#8221; W.P(C) No. 18131 of 2008<\/p>\n<p>             I) issue a writ of certiorari of any other appropriate<br \/>\n       writ, order or direction calling for the records leading to<br \/>\n       Exts.P16, P20, P21 and P23 and quash them.\n<\/p><\/blockquote>\n<blockquote><p>             ii) issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the<br \/>\n       respondents 1 to 3 to reckon the service rendered by the<br \/>\n       petitioner between 29.8.1988 and 10.4.1990 in the<br \/>\n       Department of Blood Bank towards her qualifying service<br \/>\n       for the purpose of seniority and promotion and all other<br \/>\n       service benefits in the Department of Pathology and grant<br \/>\n       her all consequential benefits as if Ext.P16 were never<br \/>\n       issued at all.\n<\/p><\/blockquote>\n<blockquote><p>             iii)   issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the 2nd<br \/>\n       respondent to pass orders on Exts.P22 and P24.\n<\/p><\/blockquote>\n<blockquote><p>             iv)    issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the<br \/>\n       respondents 1 and 2 to review Exts.P20, P21 and P23 by<br \/>\n       placing the petitioner above respondents 4 to 10 therein<br \/>\n       (in the category of Professor) and promote her as such<br \/>\n       with effect from 12.6.2007 with all consequential benefits.\n<\/p><\/blockquote>\n<blockquote><p>             v)    issue a writ of mandamus or any other<br \/>\n       appropriate writ, order or direction commanding the 1st<br \/>\n       respondents to suitably modify Exts.P11, P18 and P19 by<br \/>\n       giving credit to the petitioner&#8217;s service in the Department<br \/>\n       of Blood Bank.&#8221;\n<\/p><\/blockquote>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                  -4-\n<\/p>\n<\/p>\n<p>      2. Petitioner relies on the decision of the Supreme Court in<\/p>\n<p><a href=\"\/doc\/771294\/\">Principal King George&#8217;s Medical College, Lucknow v. Dr.<\/p>\n<p>Vishan Kumar Agarwal and<\/a> another 1984(1) SCC 416 in<\/p>\n<p>which the Supreme Court held that when some persons have<\/p>\n<p>been given relaxation in the matter of qualifications for<\/p>\n<p>admission to MD course such relaxation cannot be denied to the<\/p>\n<p>petitioner in that case.     The counsel for the petitioner also<\/p>\n<p>submits that relying on this judgment this court has also taken a<\/p>\n<p>similar view in      <a href=\"\/doc\/36060521\/\">University Grant Commission v. Rajesh<\/a><\/p>\n<p>2008(4) KLT 223.\n<\/p>\n<p>      3. A counter affidavit has been filed by the 1st respondent<\/p>\n<p>wherein the stand taken is that the department of the blood bank<\/p>\n<p>and the Pathology department are two separate water tight<\/p>\n<p>departments and seniority in one department cannot be<\/p>\n<p>reckoned by adding service of the person in the department in<\/p>\n<p>which he\/she previously worked. It is submitted that selections<\/p>\n<p>to the two departments are separate and the PSC publishes<\/p>\n<p>separate rank lists for such selections.\n<\/p>\n<p>      4. I have considered the rival contentions in detail.<\/p>\n<p>      5. It is settled law that a person who enters service in one<\/p>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                 -5-\n<\/p>\n<p>department     after   undergoing   a   selection  process,   later<\/p>\n<p>undergoes     another    selection  process   and  joins   another<\/p>\n<p>department, for the purpose of seniority and promotion in the<\/p>\n<p>latter department the service in the former would not be<\/p>\n<p>counted. In fact even in inter departmental transfers a person<\/p>\n<p>who gets transfer to the new department has to forgo his<\/p>\n<p>seniority in the erstwhile department. That is so even in the case<\/p>\n<p>of inter district transfers. Therefore, if the contention of the<\/p>\n<p>petitioner is accepted as law, that would cause havoc to the<\/p>\n<p>entire service law on the subject of seniority and promotion and<\/p>\n<p>it would effect the service conditions of Government employees<\/p>\n<p>in every department.      The fact that the Government earlier<\/p>\n<p>illegally gave such benefits to some other persons is no ground<\/p>\n<p>for giving the petitioner also the benefit of the very same<\/p>\n<p>illegality. In this connection I note the contention of the learned<\/p>\n<p>Government Pleader that such benefits were given at a time<\/p>\n<p>when the two departments were not strictly considered as water<\/p>\n<p>tight departments, although he admits that at that time also<\/p>\n<p>selection to the two departments were by separate rank list of<\/p>\n<p>the PSC. I am not prepared to lay down as a proposition of law<\/p>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                 -6-\n<\/p>\n<p>that the petitioner is entitled to the benefit, she is seeking now.<\/p>\n<p>For the above said reasons, I am of opinion that the decision<\/p>\n<p>relied upon by the petitioner is clearly distinguishable on facts.<\/p>\n<p>The decision of the Supreme Court in Agarwal&#8217;s case (supra) was<\/p>\n<p>in a case where the Supreme Court found that a particular<\/p>\n<p>condition in the eligibility criteria was not invariably insisted<\/p>\n<p>upon by the University or by the College and they did not<\/p>\n<p>consider those conditions as mandatory.         In the decision in<\/p>\n<p>Rajesh&#8217;s case also what was in contemplation was grant of<\/p>\n<p>relaxation from UGC qualification when qualifications were<\/p>\n<p>relaxed for another candidate. The Division Bench held that<\/p>\n<p>such relaxation should not be denied to the petitioner in that<\/p>\n<p>case. I am of opinion that there the court was considering the<\/p>\n<p>power of relaxation and here there is no question of any<\/p>\n<p>relaxation at all. Therefore the facts of those cases are clearly<\/p>\n<p>distinguishable on facts. I am satisfied that the petitioner is not<\/p>\n<p>entitled to the reliefs prayed for despite the fact that earlier<\/p>\n<p>other persons were given benefit of such an illegality.<\/p>\n<p>      6.  I am disturbed to find that many cases are coming<\/p>\n<p>before me, particularly in respect of matters under the Kerala<\/p>\n<p>W.P(C) Nos. 35532 of 2007<br \/>\n&amp; 18131 of 20089                -7-\n<\/p>\n<p>Education Rules, and service matters wherein the Government<\/p>\n<p>gives illegal benefits to certain teachers by passing orders or<\/p>\n<p>circulars and when those orders or circulars are sited by another<\/p>\n<p>petitioner they simply take the stand that the earlier decision is<\/p>\n<p>incorrect. That would show the disinclination of the Government<\/p>\n<p>to go by the Rule of law. The Government should not forget that<\/p>\n<p>we are still living in a country ruled by rule of law and if they<\/p>\n<p>flout law in the case of some individuals and refuse to follow the<\/p>\n<p>same in respect of others, that would ultimately result in<\/p>\n<p>anarchy. It should be prevented at all costs. Therefore the<\/p>\n<p>Government would do well to see that at least in future, they<\/p>\n<p>refrain from giving benefits against rules in individual cases<\/p>\n<p>illegally. With the solemn hope that wisdom would dawn on the<\/p>\n<p>Government at least now, I dismiss these writ petitions.<\/p>\n<p>                                      S.
