Justice S.SIRI JAGAN\n\n Dated :31\/08\/2010\n\n O R D E R\n                            S.SIRI JAGAN, J.\n\n                     ==================\n\n                      W.P.(C).No. 19698 of 2004\n\n                     ==================\n\n              Dated this the 31st day of August, 2010.\n\n                            J U D G M E N T\n<\/pre>\n<p>      The petitioner is working as a part-time sweeper in the office<\/p>\n<p>of the 2nd respondent continuously from October 1999 onwards.<\/p>\n<p>Originally, the petitioner was     paid monthly salary of Rs.110\/-<\/p>\n<p>which was enhanced to Rs.600\/- per month. Petitioner was also<\/p>\n<p>being paid bonus every year at the rate of Rs.500\/-. Petitioner<\/p>\n<p>filed a representation for permission to continue as part time<\/p>\n<p>sweeper and for regularisation of the service of petitioner. On<\/p>\n<p>receipt of Ext.P2, the first respondent terminated the service of<\/p>\n<p>the petitioner. It is under the above circumstance petitioner has<\/p>\n<p>filed this writ petition seeking the following reliefs:-<\/p>\n<blockquote><p>       &#8220;I. issue a writ in the nature of mandamus<br \/>\n       commanding the respondents not to discharge<br \/>\n       the service of the petitioner as part time<br \/>\n       sweeper in the 2nd respondent&#8217;s office and not<br \/>\n       replace her with a temporary hand.\n<\/p><\/blockquote>\n<blockquote><p>       I (a). declare that in view of Ext.P3, the<br \/>\n       petitioner is entitled to be regularized in the<br \/>\n       post of part time contingent employee,<br \/>\n       created in the office of the 2nd respondent, on<br \/>\n       the basis of the actual sweeping area<br \/>\n       available in the 2nd respondent&#8217;s office.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C).No. 19698 of 2004        2<\/span><\/p>\n<blockquote><p>        II. issue a writ in the nature of mandamus<br \/>\n        commanding        the   respondents       not    to<br \/>\n        terminate the service of the petitioner<br \/>\n        without following the statutory proceedings.\n<\/p><\/blockquote>\n<blockquote><p>        III. issue a writ in the nature of mandamus<br \/>\n        commanding the 1st respondent to consider<br \/>\n        and pass orders on Ext.P2 within such time as<br \/>\n        may be fixed by this Hon&#8217;ble Court.\n<\/p><\/blockquote>\n<blockquote><p>        IV. Issue such other orders, writs or directions<br \/>\n        as are deemed fit by this Hon&#8217;ble Court;\n<\/p><\/blockquote>\n<pre>        V.    Award cost of     this proceeding to the\n        petitioner.\"\n\n\n<\/pre>\n<blockquote><p>      2. A counter affidavit has been filed wherein the contention<\/p>\n<p>taken by the first respondent is that by Ext.R1(a) the District<\/p>\n<p>Employment Officer, Thrissur, informed the first respondent that<\/p>\n<p>the engagement of the petitioner is in violation of the<\/p>\n<p>Employment Exchange Compulsory Notification Act 1959 and,<\/p>\n<p>therefore, the service of the petitioner has to be terminated and<\/p>\n<p>the vacancy notified to the Employment Exchange.         The first<\/p>\n<p>respondent therefore seeks to justify the action taken by the first<\/p>\n<p>respondent in terminating the service of the petitioner.<\/p><\/blockquote>\n<p>      3. Petitioner would contend that petitioner was also<\/p>\n<p>originally engaged by undergoing a selection process, since no<\/p>\n<p>candidate were available with the Employment Exchange, which<\/p>\n<p>was certified by       Local Employment Exchange.     She further<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No. 19698 of 2004        3<\/span><\/p>\n<p>contends that in view of Ext.P3 Government Order,             she is<\/p>\n<p>entitled to be continued to be engaged and also for regularisation<\/p>\n<p>in service.\n<\/p>\n<p>      4. I have considered the rival contentions in detail. By virtue<\/p>\n<p>of the interim order       passed in this case the petitioner is<\/p>\n<p>continuing in service.    In Ext.P3 Government Order passed in<\/p>\n<p>respect of engagement and regularisation of casual sweepers it<\/p>\n<p>is directed thus in paragraph 8:-\n<\/p>\n<blockquote><p>        &#8220;8.For the regularisation of the existing casual<br \/>\n      sweepers (where the sweeping area exceeds<br \/>\n      100 sq.mtrs.), creation of posts of part-time<br \/>\n      contingent       employees     depending      on    the<br \/>\n      sweeping area has to be made. The sweeping<br \/>\n      area will be calculated in accordance with the<br \/>\n      guidelines       given in the Appendix.         If, on<br \/>\n      fixation, the area is seen to exceed 100 sq.<br \/>\n      mtrs. and if there is no post of part-time<br \/>\n      sweeper sanctioned for the office in question,<br \/>\n      but there is a casual sweeper being engaged<br \/>\n      the Head of the Office shall immediately take up<br \/>\n      with the Government for creation of a post of<br \/>\n      part-time contingent sweeper. Copies of the<br \/>\n      certificate of the PWD Engineer and full details<br \/>\n      of the case in the pro forma in the Annexe shall<br \/>\n      be furnished along with the proposal.               The<br \/>\n      Administrative Department in Government shall<br \/>\n      then issue orders (within a period of 4 months<br \/>\n      from the date of this order), in consultation<br \/>\n      with the Finance Department, for the          creation<br \/>\n      of the post of part-time sweeper in relaxation of<br \/>\n      the economy orders and absorbing the existing<br \/>\n      Casual Sweeper by giving the remuneration of<br \/>\n<span class=\"hidden_text\">      Rs.1,250\/- plus D.A. p.m (for area of               100<\/span><br \/>\n      sq.mtrs. and above but below 400 sq. mtrs.)<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No. 19698 of 2004        4<\/span><\/p>\n<p><span class=\"hidden_text\">      and Rs.1500 plus D.A. p.m.(for area of            400<\/span><br \/>\n      sq.mtrs. and above but below 800 sq. mtrs.).<br \/>\n      The posts shall be created only with prospective<br \/>\n      effect and all absorption\/regularisation also<br \/>\n      shall be done with prospective effect only. No<br \/>\n      back arrears shall be        payable.      The period<br \/>\n      spent prior to regularisation being casual<br \/>\n      service shall not count for any purpose.&#8221;<\/p><\/blockquote>\n<p>      I am satisfied that petitioner is entitled to the benefit of<\/p>\n<p>the said Government Order.       In the above circumstances, this<\/p>\n<p>writ petition is disposed of directing the first respondent to take<\/p>\n<p>steps in accordance with the above said Government Order in the<\/p>\n<p>matter of engagement and regularisation of the petitioner as a<\/p>\n<p>sweeper. Needless to say, in view of my above findings, the<\/p>\n<p>petitioner has to be continued to be engaged as part-time<\/p>\n<p>sweeper till final orders are passed in accordance with Ext.P3<\/p>\n<p>Government Order which shall be done           as expeditiously as<\/p>\n<p>possible, at any rate within 2 months from the date of receipt of<\/p>\n<p>a copy of this judgment.\n<\/p>\n<\/p>\n<p>                                        S.SIRI JAGAN, JUDGE<\/p>\n<p>mns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court T.T.
