(J)\n\nCITATION:\n 1996 AIR 1611\t\t  JT 1996 (5)\t566\n 1996 SCALE  (3)65\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     The prayer\t in this  writ petition\t under Article 32 of<br \/>\nthe Constitution  of India  is for  reconsideration  of\t the<br \/>\njudgment in Manohar Joshi vs.Nitin Bhaurao Patil and Another<br \/>\n(1996) 1 SCC 169. The petitioner&#8217;s contention, in substance,<br \/>\nis that the judgment is incorrect.\n<\/p>\n<p>     It\t is  sufficient\t to  say  that\tArticle\t 32  of\t the<br \/>\nConstitution is not available to assail the correctness of a<br \/>\ndecision on merits or to claim its reconsideration. This has<br \/>\nbeen clearly  reiterated in  the recent\t decision in  <a href=\"\/doc\/1718135\/\">Khoday<br \/>\nDistilleries Limited  &amp; Anr.  vs. The  Registrar    General,<br \/>\nSupreme Court  of India,<\/a>  1995\t(6)  Scale  74\twherein\t the<br \/>\ndecision in <a href=\"\/doc\/1353689\/\">A.R. Antulay vs. R.S. Nayak Anr.<\/a> 1988 (Suppl. 1)<br \/>\nSCR 1,\thas been  explained. This  alone  is  sufficient  to<br \/>\ndismiss the writ petition.\n<\/p>\n<p>     However, in  view of certain apprehensions expressed by<br \/>\nthe petitioner,\t we deem  it proper  to\t make  some  further<br \/>\nobservations now,  which we  had considered  unnecessary  to<br \/>\nincorporate in the judgment in Manohar Joshi. We may observe<br \/>\nthat the decision of this Court in <a href=\"\/doc\/60799\/\">S.R.Bommai and Others vs.<br \/>\nUnion of India and Others,<\/a> (1994) 3 SCC 1, did not relate to<br \/>\nthe construction  of, and determination of the scope of sub-<br \/>\nsections (3)  and (3A)\tof Section 123 of the Representation<br \/>\nof the\tPeople Act,  1951 and,\ttherefore,  nothing  in\t the<br \/>\ndecision in  S.R. Bommai is of assistance for construing the<br \/>\nmeaning and  scope of  sub-sections (3)\t and (34)-of Section<br \/>\n123 of\tthe Representation  of the  People Act. Reference to<br \/>\nthe decision  in S.R.  Bommai is,  therefore, inapposite  in<br \/>\nthis context.\n<\/p>\n<p>     We may also add that the challenge in the writ petition<br \/>\nto the correctness of the decision in Manohar Joshi is based<br \/>\non a  misreading of  that decision.  In\t the  judgment,\t the<br \/>\ndecision  on  the  question  of\t law  is  based\t on  earlier<br \/>\nConstitution Bench  decisions of  this Court by which we are<br \/>\nbound; and  the observation  therein which  is challenged as<br \/>\nincorrect in  this writ\t Petitions is  not the\tbasis of the<br \/>\ndecision but  an opinion  expressed on\tan assumption if the<br \/>\nmaking of  the alleged\tstatement of the hope of Maharashtra<br \/>\nbecoming a  Hindu State, in the speech is held to be proved,<br \/>\nwithout recording  a finding  that it  was so  proved.\tThis<br \/>\nallegation was\tbased on  a police  report and Manohar Joshi<br \/>\ndid not\t admit the making of such a statement in his speech.<br \/>\nMoreover,  strong   disapproval\t was  expressed\t of  such  a<br \/>\nstatement, if actually made. This is clear particularly from<br \/>\nparas 62  to 67 of the decision in Manohar Joshi reported in<br \/>\n1996 (1)  SCC 169. Specific reference has been made for this<br \/>\npurpose in paras 64 to 67 (SCC) to the decision in <a href=\"\/doc\/356651\/\">Jamaat-E-<br \/>\nIslami Hind  vs. Union\tof  India,<\/a>  1995  (1)  SCC  428,  to<br \/>\nindicate the  standard\tof  proof  required  for  proving  a<br \/>\ncorrupt practice  which had  not been  satisfied in  Manohar<br \/>\nJoshi in  view of the absence of legal evidence to prove the<br \/>\ncorrupt practice alleged in the case.\n<\/p>\n<p>     A careful\tand dispassionate  reading of  the  decision<br \/>\nwould show that eh apprehensions and misgivings expressed in<br \/>\nthe writ  petition, are\t imaginary and baseless. There is no<br \/>\noccasion to read in the judgment in Manohar Joshi, something<br \/>\nwhich is  not said  or to  say that  it conflicts  with\t the<br \/>\nconcept of  secularism in  S.R. Bommai\twhere this  question<br \/>\nrelating to  the meaning  of sub-sections  (3) and  (3A)  of<br \/>\nSection 123  of the Representation of the People Act neither<br \/>\narose, nor  was decided.  The application of the decision in<br \/>\nManohar Joshi  in cases like <a href=\"\/doc\/925631\/\">Dr. Ramesh Yeshwant Prabhoo vs.<br \/>\nShri Prabhakar\tKashinath Kunte\t &amp; Others,<\/a> 1996 (1) SCC 130,<br \/>\n<a href=\"\/doc\/916242\/\">Shri Suryakant Venkatrao Mahadik vs. Smt. Saroj Sandesh Baik<br \/>\n(Bhosale),<\/a> 1996\t (1) SCC  384, and  <a href=\"\/doc\/957991\/\">Mohan vs.  Bhairon Singh<br \/>\nShekhawat,<\/a>  1996  (1)  Scale  SP3,  is\tanother\t pointer  to<br \/>\nindicate that  there is\t nothing in  the judgment in Manohar<br \/>\nJoshi to  give rise  to any  such apprehension\tthat it\t can<br \/>\nenable misuse  of religion for making appeal for votes in an<br \/>\nelection.\n<\/p>\n<p>     We\t may  add  that\t the  deficiency,  if  any,  in\t the<br \/>\nstatutory  prohibition\tenacting  the  corrupt\tpractice  in<br \/>\nSection 123  of the Representation of the People Act, has to<br \/>\nbe cured  by legislation and that deficiency cannot be cured<br \/>\nby reading  into a  penal provision  something which  is not<br \/>\nenacted therein.  The proposal\twas  made  at  one  time  to<br \/>\nperform the  legislative exercise of enacting a provision to<br \/>\nprevent any  possible misuse  of religion  during elections,<br \/>\nbut it\twas, unfortunately,  abandoned. We  do hope  that at<br \/>\nleast now  there would remain no misapprehension in the mind<br \/>\nof anyone.\n<\/p>\n<p>     The writ Petition is, therefore, dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mohd.
