KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nNANAVATI, J.\n<\/p>\n<p>     The appellant, along with his son Om Prakash, was tried<br \/>\nfor the\t offence of  murder of\tPrabhakar  Kumar  Martin  in<br \/>\nSessions Trial\tNo. 130\t of 1985,  in the  court of  the 1st<br \/>\nAdditional Sessions  Judge, Arrah. The trial court convicted<br \/>\nOm Prakash  under Section  302, IPC  and the  appellant\t jag<br \/>\nnarain was  convicted under  section 302  read with  Section<br \/>\n34\/109, IPC. Both of them appealed to the High Court against<br \/>\ntheir conviction  but without any success. They then applied<br \/>\nto this\t Court for  special leave  to file an appeal against<br \/>\nthe judgment  of the High Court. This Court granted leave to<br \/>\nappellant Jag  Narain only  an dismissed  the special  leave<br \/>\npetition of Om Prakash.\n<\/p>\n<p>     The prosecution case was that on 5.9.1984 at about 8.30<br \/>\na.m. Om Prakash was seen by Shailendra going on a cycle with<br \/>\nhigh speed.  As his nephew was playing in the lane and could<br \/>\nhave been hit by the cycle, he scolded Om Prakash by telling<br \/>\nhim not\t to drive  cycle so speedily in the lane. Om Prakash<br \/>\nreplied\t by   saying  that   the  lane\tdid  not  belong  to<br \/>\nShailendra&#8217;s father.  That  led\t to  an\t exchange  of  wards<br \/>\nbetween Om prakash and Shailendra. While leaving that place,<br \/>\nOm Prakash  threatened Shailendra  that he would teach him a<br \/>\nlesson. within\tfew minutes,  Om prakash returned with a gun<br \/>\nfollowed by  his father appellant jag Narain and his younger<br \/>\nbrother chhote.\t By that  time Prabhakar and Regina had also<br \/>\ncome in the lane and they saw Om Prakash coming towards them<br \/>\nwith a\tgun. Regina tried to prevent him from coming near by<br \/>\nholing him  and his gun and it is at that point of time that<br \/>\nthe appellant  exhorted Om  Prakash not\t merely to  look  at<br \/>\ntheir faces  bu to fire his gun. Thereupon, Om Prakash fired<br \/>\na shot\twhich hit  prabhakar. Prabhakar died before he could<br \/>\nreach the hospital. All the three accused were chargesheeted<br \/>\nbut as it was noticed that the third accused Chhote was aged<br \/>\nabout 15  years only,  his case\t was separated and the trial<br \/>\nproceeded against the appellant and Om Prakash only.\n<\/p>\n<p>     In order  to prove its case, the prosecution had mainly<br \/>\nrelied upon  the evidence  of five eye-witnesses &#8211; PW- 1 Raj<br \/>\nKumar,\tPW-3   Martin  sarfin,\t PW-4  Regina  Martin,\tPW-5<br \/>\nShailendra Kumar Martin and PW-6 Agness Joseph. PW-6 did not<br \/>\nsupport the  prosecution and  she  was\tdeclared  a  hostile<br \/>\nwitness and  was also  permitted to be cross-examined by the<br \/>\nPublic Prosecutor.  The trial court believed the evidence of<br \/>\nother four  witnesses  and  convicted  Om  Prakash  and\t the<br \/>\nappellant as stated above.\n<\/p>\n<p>     The High Court was of the view that the evidence of PWs<br \/>\n3,4 and\t 5 was\tquite believable  because they were the most<br \/>\nnatural witnesses  as the  incident had\t taken place just by<br \/>\nthe  side  of  their  house  and  their\t evidence  was\talso<br \/>\nconsistent and\tconvincing. In view of the infirmity noticed<br \/>\nin the\tevidence of  PW-1, the\tHigh Court thought it fit to<br \/>\nignore his  evidence. Thus, relying upon the evidence of PWs<br \/>\n3,4 an\t5 ,  the High  Court confirmed the conviction of the<br \/>\nappellant of the Om Prakash.\n<\/p>\n<p>     What is  contended\t by  the  learned  counsel  for\t the<br \/>\nappellant is  that the evidence of the four eye-witnesses is<br \/>\nnot at\tall consistent as regards the actual words spoken by<br \/>\nthe appellant  before Om  Prakash fired\t his  gun.  He\talso<br \/>\nsubmitted that\tPWs 3  and 4  had made material improvements<br \/>\nand, therefore,\t their evidence\t should not have been relied<br \/>\nupon by\t the High  Court. He also submitted that even though<br \/>\nPWs 4  and 5  had consistently\tstated\tthat  appellant\t Jag<br \/>\nNarain had  exhorted his  son to fire a shot, their evidence<br \/>\nought not  to have  been believed  as it was improbable that<br \/>\nfor a  trivial reason like scolding by a neighbour, he would<br \/>\nhave told  his son  to\tkill  the  neighbour  and  thus\t get<br \/>\ninvolved in  a serious offence of murder. On the other hand,<br \/>\nit  was\t submitted  by\tShri  B.B.  Singh,  learned  counsel<br \/>\nappearing for  the State  that since  the  evidence  of\t the<br \/>\nprosecution witnesses has been found to be consistent and as<br \/>\ntheir evidence\thas been  believed by both the courts below,<br \/>\nthis court  should not\tinterfere merely because a different<br \/>\nview on appreciation of their evidence is possible.\n<\/p>\n<p>     As stated\tearlier, we  are now  not concerned with the<br \/>\nconviction of  Om  Prakash  and\t the  only  question  to  be<br \/>\nconsidered is  whether the appellant had really exhorted his<br \/>\nson to\tkill any one from the other side . According to PW-1<br \/>\nRaj Kumar,  the appellant had stated: &#8221; why are you watching<br \/>\ntheir faces, kill those persons&#8221;.  This\t    witness\t was<br \/>\ncontradicted by\t his police  statement wherein\the  had\t not<br \/>\nstated that  the appellant  had exhorted  his son  to fire a<br \/>\nshot. He  was also  contradicted  by  his  police  statement<br \/>\nwherein he  had not  even referred to the name\tof appellant<br \/>\njag Narain  as one of the accused present at the time of the<br \/>\nincident. PW-3\tMartin Sarfin  stated before  the court that<br \/>\nthe appellant  had given  an order  and upon  his  order  Om<br \/>\nprakash had  fired a  shot. He\tdid not\t refer to  the exact<br \/>\nwords spoken by the appellant. Moreover, we find that he had<br \/>\ntried to  make an important improvement by stating that Arun<br \/>\nhad a  pistol in  his hand  at the  time of the incident. No<br \/>\nother  witness\t had  stated   like  that.  This  deliberate<br \/>\nimprovement made by the witness indicates that he was not an<br \/>\nimpartial and  truthful witness\t and had  tried\t to  falsely<br \/>\nimplicate Arun\tby ascribing  a positive  role to    him  by<br \/>\nstating that  he was  carrying a  pistol at  the time of the<br \/>\nincident. PW-4\tRegina Martin  had stated  before the  court<br \/>\nthat the  appellant had told his son: &#8221; What are you seeing,<br \/>\nfire.&#8221; Apart  from the\tother inconsistencies as regards the<br \/>\nsequences of  the events, we find that she had also tried to<br \/>\nmake an improvement by stating that she had tried to prevent<br \/>\nOm Prakash  from firing\t his gun bu Om Prakash gave her push<br \/>\nwith the  butt of  his gun  and had them fired at Prabhakar.<br \/>\nPW-5 Shailendra\t deposed  that\tthe  words  uttered  by\t the<br \/>\nappellants were: &#8221; What are you seeing, shoot a bullet. &#8221; He<br \/>\nhad lodged  the FIR  . Therein\twhat  he had stated was that<br \/>\nthe appellant had told his son &#8220;what were they seeing and to<br \/>\nkill them&#8221;  . From the above narration of what the witnesses<br \/>\nhad stated, it clearly appears that there is not consistency<br \/>\nas regards  the words  spoken by  the  appellant  before  Om<br \/>\nPrakash had fired his gun. PW-1\t   had not stated before the<br \/>\npolice that  the appellant was present when Om Prakash fired<br \/>\na shot.\t Though there  is no evidence to show that there was<br \/>\nany previous  enmity between  the prosecution  witnesses and<br \/>\nthe appellant  and his\tsons, they  having lost one of their<br \/>\nfamily members had tried to implicate all the three accused.<br \/>\nTheir version  also appears  to be  improbable and unnatural<br \/>\nbecause the  appellant being  an aged  person would not have<br \/>\ntold his  son to  fire a  shot, kill  the neighbour  and get<br \/>\nhimself involved  in  a\t serious  offence  of  murder.\tWhat<br \/>\nappears to have happened is that having noticed that his son<br \/>\nwas going out with a gun, he followed him with a view to see<br \/>\nwhat was  happening and\t also to prevent him from committing<br \/>\nany offence. There is no evidence to show that the appellant<br \/>\nhad started  along with his son from his house. The evidence<br \/>\nalso discloses\tthat houses of the prosecution witnesses and<br \/>\nthe  accused   were  very  close  to  each  other.  Possible<br \/>\nbelieving that\tmere presence  of the  father at the time of<br \/>\nthe incident  will not\tbe regarded as sufficient to involve<br \/>\nhim, PWs  3 to\t6 who  are all family members appear to have<br \/>\nattributed certain words to him.\n<\/p>\n<p>     All these\taspects have not been considered by the High<br \/>\nCourt. We  are of  the view  that the  prosecution  has\t not<br \/>\nproved\tbeyond\treasonable  doubt  that\t the  appellant\t had<br \/>\nexhorted his  son to  kill Prabhakar  and therefore the High<br \/>\nCourt was  not right  in confirming  the conviction  of\t the<br \/>\nappellant. We,\ttherefore, allow  this appeal, set aside the<br \/>\njudgment and  order passed  by the High Court and acquit the<br \/>\nappellant of the charge levelled against him.
