3. By the impugned judgment and award, the Tribunal<\/p>\n
has granted compensation of Rs.80,000\/– with interest at 6%<\/p>\n
p.a. from the date of petition till the date of deposit.<\/p>\n
Aggrieved by that, the appellant” has fiied ” . <\/p>\n
seeking enhancement.\n<\/p>\n

the appellant’ The appeliant claimed
\ncompensation” of  The Tribunal has awarded<\/p>\n
compensationauof with interest at 6% p.a. from the<\/p>\n
‘VV’c};a.te ‘Cpeftition till ‘th\u00e9mdate of deposit. Aggrieved by  the<\/p>\n
.,’fi1ed”_jthis appeal, seeking enhancement.<\/p>\n

 The-iearned counsel for the appellant contended that<\/p>\n
 compensation awarded by the Tribunal towards pain and<\/p>\n
 .su\ufb01erings, loss of amenities of life, nourishing food, conveyance<\/p>\n

and attendant charges and loss of income during the period of
\ntreatment is totally inadequate. He fh\u20acg@9i%submitted that the<\/p>\n
impugned judgment and award need to be modi\ufb01ed.<\/p>\n
6. As against this, the learned Couns__ei’~..fo1′:.A_d.the 2133 d <\/p>\n
respondent submitted that, the” ‘1’riLtii*ial-I’ <\/p>\n
consideration of the material on record. has awarded just and”,<\/p>\n
reasonable compensation and therefore,  notneall for<\/p>\n

\n‘7. We have earefuilyt”considered.the”submissions made<\/p>\n
by the learnedjvthde parties.\n<\/p>\n
8.  point’ that ‘ea,r_Vi’s.e.’fo_r our consideration is, Whether<\/p>\n
the Tribunat a\\vVstarde.d”j’:;.’s’t and reasonable compensation’?<\/p>\n
   ‘nrelevantdto note, the Tribunal has awarded a<\/p>\n
 — towards pain and sufferings. The\n<\/p>\n

29.1.2005 to 31.1.2005 and has undergone operation. The<\/p>\n
head injury has resulted in permanent disability. <\/p>\n
has awarded a sum of Rs.i5,000\/– towards pain  <\/p>\n
which is inadequate. Having regard to the .1’1atui}e of: i11juzty,” =<\/p>\n
duration and nature of treatment,  our considered <\/p>\n
sum of Rs.25,000\/– would be a reasonable surn <\/p>\n
and sufferings and accordingly, it”is_awarde(i.._ ‘T l I<\/p>\n
10. The Tribunal  of Rs.15,000\/–\n<\/p>\n
towards loss of  life:  disability. The
\nappellant has.    V and has undergone
\noperatioiiil    permanent disability of
\n10%.  that the appellant will get<\/p>\n
frequen.t.Vheadache’andit  reduced his earning capacity by<\/p>\n
 igci\/0_v-is._.C’ITiew. appellantlllhas to suffer discomfort throughout his<\/p>\n
llife”.’ f’i’.ribii11.al_:.has awarded a sum of Rs.15,000\/– towards<\/p>\n
loss’   of life and permanent disability which is<\/p>\n
‘inadequate’:. Having regard to the nature of disability and the<\/p>\n
  “discorf1fort the appellant has to suffer, in our considered view,<\/p>\n
   of Rs.40,000\/– would be a reasonable sum towards loss<\/p>\n

of amenities of life and   disability and accordingly, it<\/p>\n
is awarded.\n<\/p>\n
11. The Tribunal has awarded a sum of Rs..’3;’Q(p)0\/–<\/p>\n
towards conveyance, nourishing food and attendarit cha\u00e9rges.<\/p>\n
The appellant was in–patient from 1.1.2005 to   <\/p>\n
thereafter, from 29.1.2005 to 31.1.,’2,005’uand thereaf:\u00a2r;–1’\u00ab\u00bbh.\u00e9s.<\/p>\n
taken follow up treatment. Thereforeafinl’-our co11sidered–.:1fie\u00a3Tw;~_VV<\/p>\n
the compensation awarded  it  ‘T1-ibpunalvv\u00e9llllltowardslVV<\/p>\n
conveyance, nourishing: ..foodp..1″a11rlfl’- attendant’-A charges is<\/p>\n
inadequate and a sum of —  areasonable sum<\/p>\n
and accordingl\ufb01it is::;.awarde_d. it <\/p>\n
  awarded a sum of Rs.2,000\/-\n<\/p>\n
towards lossof   the period of treatment. The<\/p>\n
 appellant has taken treaitment as inpatient from 1.1.2005 to<\/p>\n
 5.1′..20051″”a;1:1thereafter, from 29.1.2005 to 31.1.2005 and<\/p>\n
  follow up treatment. Therefore, it is<\/p>\n
 _prope’r toqalward a sum of Rs.6,000\/– towards loss of income<\/p>\n
.4 H ”   the period of treatment and accordingly, it is awarded.<\/p>\n

13. The compensation awarded by the Tribunal towards<\/p>\n
medical expenses is just and proper and therefore, it does not<\/p>\n
call for interference. I\n<\/p>\n
14. The total compensation payable to<\/p>\n
Rs. 1,21,000\/– and the break–up is as follows:\n<\/p>\n
(a) Towards pain and sufferings  p  ‘– _  it<\/p>\n
(b) Towards loss of amenities of’  ”\n<\/p>\n

 pf i<s.~i,21',ooo\/– instead of Rs.80,000\/–. with interest at 6%<\/p>\n
 from the date of petition till the date of reaslisation. The<\/p>\n

second respondent~Insurance Company shall deposit the
\namount within eight weeks from today. The entire amount<\/p>\n
