Justice ANTONY DOMINIC\n\n Dated :29\/10\/2010\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ================\n                  W.P.(C) NO. 29821 OF 2010 (c)\n                  =====================\n\n           Dated this the 29th day of October, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioners 1 and 2 claim that they are in possession of 4<\/p>\n<p>cents and 3 cents of land respectively in Sy.No.912 of KDH Village<\/p>\n<p>where according to them, they are residing with their families. It<\/p>\n<p>is stated that by making Ext.P9 application to the 2nd respondent,<\/p>\n<p>they sought assignment of the property to them in the light of<\/p>\n<p>Ext.P8 Government Order. Orders on the application are not<\/p>\n<p>passed and in the meantime, they expect coercive action to drive<\/p>\n<p>them out of the property.      It is with this grievance, the writ<\/p>\n<p>petition is filed.\n<\/p>\n<p>      2.    I heard the learned Government Pleader also on behalf<\/p>\n<p>of the respondents.\n<\/p>\n<p>      3.    If as stated by the petitioners, they have made<\/p>\n<p>applications for assignment of properties, necessarily, it is a<\/p>\n<p>matter for the 2nd respondent to consider.<\/p>\n<p>      4.    Therefore, taking note of the case of the petitioners<\/p>\n<p>that Ext.P9 application made by them is pending before the 2nd<\/p>\n<p>respondent, without expressing anything on the merits of the<\/p>\n<p>WPC No. 29821\/10<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>claim raised, I dispose of this writ petition directing the 2nd<\/p>\n<p>respondent to consider the said application in the light of Ext.P8.<\/p>\n<p>Orders on Ext.P9 shall be passed as expeditiously as possible, at<\/p>\n<p>any rate within 3 months of production of a copy of this judgment<\/p>\n<p>along with a copy of this writ petition.
