(C) No. 1751 of 2004) <\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by learned<br \/>\nSingle Judge of the Allahabad High Court allowing the writ<br \/>\npetition filed by respondent no.1.\n<\/p>\n<p>3.\tBackground facts as projected by the appellant are as<br \/>\nfollows:\n<\/p>\n<p>On 16.9.1983 the Sub-Divisional Magistrate,<br \/>\nMaharajganj allotted the disputed plot No.1734 bearing area of<br \/>\n0.053 hectare in the name of respondent no.1.  The appellant,<br \/>\na co-villager, noticed that the land was earlier being used as a<br \/>\npassage to Kali Mandir and that respondent no.1 was not<br \/>\nentitled to be allotted any land by the Government.  The<br \/>\nprocedure prescribed for allotment of land was not followed.<br \/>\nAs respondent no.1 was not a landless person, the allotment<br \/>\nin his favour was illegal.  Appellant filed a petition before the<br \/>\nDistrict Magistrate, Maharajganj under Section 198(4) of the<br \/>\nU.P. Zamindari Abolition Act, 1950 (in short the &#8216;Act&#8217;). The<br \/>\nDistrict Magistrate on receiving the complaint called for the<br \/>\nallotment file and on examination found that due procedure<br \/>\nwas not adopted and was done clandestinely. By order dated<br \/>\n7.11.2002, the Collector cancelled the allotment and further<br \/>\ndirected that the land be taken over by the Gaon Sabha.<br \/>\nAggrieved by the said order respondent no.1 had filed a<br \/>\nrevision petition before the Commissioner, Gorakhpur, in<br \/>\nwhich the respondent no.1 took the plea that order passed by<br \/>\nthe Collector, Maharajganj, is illegal as there was no report<br \/>\ncalled from the Lekhpal and no spot inspection was done.  The<br \/>\nCommissioner dismissed the revision petition on the ground<br \/>\nthat the same was not maintainable.  In January 2003, the<br \/>\nrespondent no.1 filed a writ petition No.1004\/2003 before the<br \/>\nHigh Court.  The primary stand taken was that there was<br \/>\ndelay in filing the application under Section 198 (4) of the Act<br \/>\nby the appellant.  Initially the High Court issued notice.<br \/>\nAppellant filed his counter-affidavit.  Learned Single Judge by<br \/>\norder dated 11.9.2003 by a practically non-reasoned order<br \/>\nallowed the writ petition.  The said order is the subject-matter<br \/>\nof challenge.\n<\/p>\n<p>4.\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that since the order is non-reasoned and<br \/>\nno discussion has been made as to why the orders passed by<br \/>\nthe Collector and the Commissioner were to be interfered with,<br \/>\nthe order cannot be maintained.\n<\/p>\n<p>5.\tLearned counsel for the respondent no.1 on the other<br \/>\nhand submitted that the order does not suffer from any<br \/>\ninfirmity.\n<\/p>\n<p>6.\tWe find that the learned Single Judge has not indicated<br \/>\nany basis for interfering with the orders of the Collector and<br \/>\nthe Commissioner.  The only reason appears to be by reference<br \/>\nto the Annexure SA5 filed along with the supplementary<br \/>\naffidavit, which shows that the plot bearing no.735 does not<br \/>\nconnect in any manner the road which goes to the Kali<br \/>\nMandir, rather it is on the backside of the road.\n<\/p>\n<p>7.\tThe basic question was about the eligibility of the<br \/>\nrespondent no.1 for allotment of the land.  The specific stand<br \/>\nbefore the authority was that respondent no.1 was not a<br \/>\nlandless person and, therefore, he was not entitled to be<br \/>\nallotted any land. There is no reference to this aspect in the<br \/>\norder.\n<\/p>\n<p>8.\tReasons introduce clarity in an order. On plainest<br \/>\nconsideration of justice, the High Court ought to have set forth<br \/>\nits reasons, howsoever brief, in its order indicative of an<br \/>\napplication of its mind, all the more when its order is<br \/>\namenable to further avenue of challenge. The absence of<br \/>\nreasons has rendered the High Court&#8217;s judgment not<br \/>\nsustainable.\n<\/p>\n<p>9.\tEven in respect of administrative orders Lord Denning<br \/>\nM.R. in Breen v. Amalgamated Engineering Union (1971 (1) All<br \/>\nE.R. 1148) observed &#8220;The giving of reasons is one of the<br \/>\nfundamentals of good administration&#8221;. In Alexander Machinery<br \/>\n(Dudley) Ltd. v. Crabtree (1974 LCR 120) it was observed:<br \/>\n&#8220;Failure to give reasons amounts to denial of justice&#8221;. Reasons<br \/>\nare live links between the mind of the decision taker to the<br \/>\ncontroversy in question and the decision or conclusion arrived<br \/>\nat&#8221;. Reasons substitute subjectivity by objectivity. The<br \/>\nemphasis on recording reasons is that if the decision reveals<br \/>\nthe &#8220;inscrutable face of the sphinx&#8221;, it can, by its silence,<br \/>\nrender it virtually impossible for the Courts to perform their<br \/>\nappellate function or exercise the power of judicial review in<br \/>\nadjudging the validity of the decision. Right to reasons is an<br \/>\nindispensable part of a sound judicial system, reasons at least<br \/>\nsufficient to indicate an application of mind to the matter<br \/>\nbefore Court. Another rationale is that the affected party can<br \/>\nknow why the decision has gone against him. One of the<br \/>\nsalutary requirements of natural justice is spelling out reasons<br \/>\nfor the order made, in other words, a speaking out. The<br \/>\n&#8220;inscrutable face of a sphinx&#8221; is ordinarily incongruous with a<br \/>\njudicial or quasi-judicial performance.\n<\/p>\n<p>10.\tAbove being the position, we set aside the impugned<br \/>\norder of the High Court, remit the matter to it for fresh<br \/>\ndisposal.  We make it clear that we have not expressed any<br \/>\nopinion on the merits of the case.
