Intermediate\tEducation  Act,\t 1921,--Whether\t the\n\tbasic section of a college is within the scope of.\n\n\n\nHEADNOTE:\n\t    The\t respondent, an assistant teacher in the basic\tsec-\n\ttion of the Colvin Taluqdar's college, Lucknow, was suspend-\n\ted and then removed from service, by the managing  committee\n\tof the college.\t She flied a writ petition in the High Court\n\tchallenging her dismissal order, contending that it violated\n\tthe regulations framed under the (U.P.) Intermediate  Educa-\n\ttion  Act, 1921. The appellants\t contended  that  the\tcol-\n\tlege   was   running  the  basic Section  independently\t and\n\twithout\t any affiliation or grants  from the  Government  or\n\tany local body, and that the said Act did not apply.\n\t    The\t Single Judge of the High Court dismissed  the\tWrit\n\tpetition  as none of the opposite parties was a\t public\t au-\n\tthority.   An appeal  was allowed by a Division Bench of the\n\tHigh  Court  on\t the ground that the basic  Section  was  an\n\tintegral  part\tof  the college and was run  by\t a  Managing\n\tCommittee constituted under the Intermediate Education Act.\n\tAllowing the appeal the Court,\n\t    HELD:  The\tprovisions of the Act relate  to  recognized\n\tinstitutions; recognition is by the Board for the purpose of\n\tpreparing  candidates for admission to the Board's  examina-\n\ttion; Board means the  Board of High School  and  lntermedi-\n\tate Education.\tThe basic section of a college cannot there-\n\tfore be part of a recognised institution.  It is not correct\n\tto  think  that\t since\tSection 16A of the  Act\t requires  a\n\tcollege\t to  have a committee of  management,\t a  managing\n\tcommittee that looks after the affairs of the basic  section\n\tof the college must also be functioning as a statutory\tbody\n\tdischarging duties under the Act and governed by the regula-\n\ttions  framed thereunder.  An institution by  extending\t its\n\toperation  to fields beyond that covered by the Act   cannot\n\textend\tthe ambit of the Act to include in its sweep,  these\n\tnew  fields of education which are. outside its scope.\t[959\n\tC-G]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\tCIVIL APPELLATE JURISDICTION: Civil Appeal No. 343 of 1974.<br \/>\n\t    (Appeal  by\t special leave from the Judgment  and  Order<br \/>\n\tdated  11-9-1973  of  the  Allahabad  High  Court   (Lucknow<br \/>\n\tBench) in Spl. Misra,  for\t the<br \/>\n\trespondent<br \/>\n\tThe Judgment of the Court was delivered by<br \/>\n\t    GUPTA, J.&#8211;Colvin Taluqdars&#8217; College  in Lucknow, run by<br \/>\n\ta  society registered under the Societies Registration\tAct,<br \/>\n\timparts education at the following different stages:\n<\/p>\n<p>\t(i) Pre-basic i.e., nursery classes.\n<\/p>\n<p>\t(ii) Junior basic, called primary stage, from class I to V.\n<\/p>\n<p>\t(iii)  Senior basic i.e., Junior high  school\tstage\tfrom<br \/>\n\tclass VI to VIII, and<br \/>\n<span class=\"hidden_text\">\t958<\/span>\n<\/p>\n<p>\t(iv)  Higher   secondary  stage, called high  school  stage-<br \/>\n\tclasses IX and X.\n<\/p>\n<p>\t(b) Intermediate stage&#8211;Classes XI and XII<br \/>\n\t    In the beginning the college had no pre-basic or  junior<br \/>\n\tbasic classes and started with class VI; classes I to V\t and<br \/>\n\tnursery\t classes    were opened later.\tThe  respondent\t was<br \/>\n\tappointed  an assistant teacher in the basic section of\t the<br \/>\n\tcollege\t in  1961.   Following certain\tincidents  involving<br \/>\n\ther,  she  was suspended on or about August  20,  1970.\t and<br \/>\n\tultimately  her\t services were terminated  by  the  managing<br \/>\n\tcommittee  of the college some time in October\t1970.\t She<br \/>\n\tflied  a writ petition in the High Court at Allahabad  (Luc-<br \/>\n\tknow  Bench) alleging inter alia that the order\t terminating<br \/>\n\ther  services was mala fide and made   in violation  of\t the<br \/>\n\tregulations  framed under the (U.P.) Intermediate  Education<br \/>\n\tAct, 1921.  She asked for a writ of certiorari\tquashing the<br \/>\n\torder of suspension and the order terminating her  services,<br \/>\n\tand a writ of mandamus directing the opposite parties to pay<br \/>\n\tthe  full salary and emoluments due to her.   The  president<br \/>\n\tof the managing committee of the college, the principal, the<br \/>\n\thead  mistress\tof the basic section and  the  committee  of<br \/>\n\tmanagement were impleaded as opposite parties 1, 2, 3, and 4<br \/>\n\trespectively.\t The  writ  petition was  dismissed  by\t   a<br \/>\n\tsingle Judge of the High Court on a preliminary ground\tthat<br \/>\n\tnone of the opposite parties was a public authority and\t the<br \/>\n\timpugned orders suspending her and terminating her  services<br \/>\n\twere  not made in   the exercise of any statutory  function.<br \/>\n\tOn appeal a Division Bench  of the High Court took the\tview<br \/>\n\tthat  the basic section of the college was an integral\tpart<br \/>\n\tof  the college and held that the managing committee of\t the<br \/>\n\tcollege was a statutory body constituted under the  Interme-<br \/>\n\tdiate  Education Act and governed by the regulations  framed<br \/>\n\tthereunder.    The Division Bench therefore found  the\twrit<br \/>\n\tpetition  maintainable and remanded the case to\t the  single<br \/>\n\tJudge to be decided on merits.\n<\/p>\n<p>\t    The\t Intermediate  Education  Act,\t1921,  as  its\tlong<br \/>\n\ttitle-shows,  is an Act for the establishment of a Board  of<br \/>\n\tHigh  School and Intermediate Education.  The preamble\tsays<br \/>\n\tthat it was enacted because it was expedient to establish  a<br \/>\n\tBoard  to  take\t the place of the  Allahabad  University  in<br \/>\n\tregulating and supervising  the\t system\t of  High school and<br \/>\n\tIntermediate   education  in the United\t Provinces,  and  to<br \/>\n\tprescribe courses therefore.  Section 2 of the Act  defines,<br \/>\n\tamong  other terms, Board.   Institution,  and\tRecognition.<br \/>\n\tBoard  means\tthe Board of High  School  and\tIntermediate<br \/>\n\tEducation.  Institution means the whole of an institution or<br \/>\n\ta  part\t thereof,  as the case may   be.  Recognition  means<br \/>\n\trecognition  for  the purpose of  preparing  candidates\t for<br \/>\n\tadmission  to the Board&#8217;s examination.\t Admittedly,  Colvin<br \/>\n\tTaluqdars&#8217;  College is a recognised institution.  Section  7<br \/>\n\twhich\tdefines the powers of the Board,  after\t enumerating<br \/>\n\tcertain specific powers, states that the Board will have the<br \/>\n\tpower &#8220;to do all such other acts and things as may be requi-<br \/>\n\tsite in order to further the objects of the Board as a\tbody<br \/>\n\tconstituted  for regulating and supervising High School\t and<br \/>\n\tIntermediate Education&#8221;.   The powers mentioned in section 7<br \/>\n\tall  relate to High school and Intermediate classes.\tSec-<br \/>\n\ttion 16-A lays<br \/>\n\tdown that for every recognised institution there shall be  a<br \/>\n\tscheme\tof  administration which must provide,\tamong  other<br \/>\n\tmatters, for the constitution of a committee of\t management.<br \/>\n\tSection\t 16-B and section 16-C deal with the preparation  of<br \/>\n\tthe  scheme of administration.\tSection 16-D authorises\t the<br \/>\n\tDirector  of Uttar Pradesh to cause inspection of  a  recog-<br \/>\n\tnized  institution from time to time and order\tthe  removal<br \/>\n\tof any defect found on inspection. Sections 16E, 16F and 16G<br \/>\n\tprovide for the qualifications and the conditions of service<br \/>\n\tof  the\t teachers Of  a recognized institution.\t   Thus\t all<br \/>\n\tthese  sections are confined in their application to  recog-<br \/>\n\tnized  institutions  only.   Regulations have\tbeen  framed<br \/>\n\tunder the Act in respect of matters covered by section\t16-A<br \/>\n\tto  section 16-G.   Regulations 31 to 45 in Chapter  III  of<br \/>\n\tthe Regulations deal with the subject of punishment, enquiry<br \/>\n\tand suspension of the employees of a recognized institution.<br \/>\n\tIt is said that the suspension and dismissal of the respond-<br \/>\n\tent was not in accordance with these regulations.<br \/>\n\t    It\tseems clear from the provisions set out\t above\tthat<br \/>\n\tthey  all relate to recognized institutions; recognition  is<br \/>\n\tby  the\t Board for the purpose of preparing  candidates\t for<br \/>\n\tadmission to the Board&#8217;s   examination, and Board means\t the<br \/>\n\tBoard of High School and Intermediate Education.  The  basic<br \/>\n\tsection of a school cannot therefore be part of a recognized<br \/>\n\tinstitution.\tWe are unable to agree with the\t view  taken<br \/>\n\tby  the\t Division  Bench of the High Court  that  the  basic<br \/>\n\tsection\t is  an integral part of the institution and  there-<br \/>\n\tfore must be governed by the provisions of the\tIntermediate<br \/>\n\tEducation  Act, 1921.\tA school by extending its  operation<br \/>\n\tto  fields beyond that covered by the Act cannot extend\t the<br \/>\n\tambit of the Act to include in its sweep these new fields of<br \/>\n\teducation  which  are outside its scope.  The  case  of\t the<br \/>\n\tappellants on this point appears from the  counter-affidavit<br \/>\n\tfiled  by them in answer to the writ petition.\t It is\tsaid<br \/>\n\tthat &#8220;the college is running the Basic Section independently<br \/>\n\tand  is neither registered by the Government nor  affiliated<br \/>\n\tby  any\t local body-and neither any grant in  aid  is  being<br \/>\n\ttaken  by  the department to run this  section\taccordingly.<br \/>\n\tThe college has its own rules and regulations to conduct the<br \/>\n\tBasic Section.&#8221;\t  It is not correct to think that since\t the<br \/>\n\tcollege has to have a committee of management as required by<br \/>\n\tsection\t 16-A,\ta managing committee that  looks  after\t the<br \/>\n\taffairs\t of  the Basic Section of the college must  also  be<br \/>\n\tfunctioning as a statutory body discharging duties under the<br \/>\n\tIntermediate  Education Act and governed by the\t Regulations<br \/>\n\tframed\tthereunder.   The Division Bench sought support\t for<br \/>\n\tthe view it had taken from some provisions in the Education-<br \/>\n\tal  Code  of Uttar Pradesh but, as pointed  by\tthe  learned<br \/>\n\tsingle Judge, the Code is only a compilation of the  various<br \/>\n\tadministrative\trules  and orders  relating  to\t educational<br \/>\n\tinstitutions in the State and has no statutory force.\t For<br \/>\n\tthe  reasons stated above, it must be held that\t the  appel-<br \/>\n\tlants were not discharging any statutory function in  making<br \/>\n\tthe  impugned orders affecting the respondent.\t The  appeal<br \/>\n\tis accordingly allowed, the Judgment of\t the Division  Bench<br \/>\n\tis set aside and that of the Single Judge   restored.
