     The petitioners are the appellants.     They challenge the<\/p>\n
order vacating the interim stay granted in their favour. The<\/p>\n
appellants were employees of the Revenue Department before<\/p>\n
they joined the Rural Development Department.         There was<\/p>\n
some dispute as to whether the change in seniority in the<\/p>\n
Revenue    Department     should   be   carried  to   the  Rural<\/p>\n
Development Department also. This Court, by Annexure R2(a)<\/p>\n
judgment, produced in the Writ Petition, declared that any<\/p>\n
change in the seniority in the Revenue Department as a result of<\/p>\n
amendment of the Special Rules governing appointment to the<\/p>\n
posts in that Department will not have any effect on the<\/p>\n
seniority position of the employees in the Rural Development<\/p>\n
Department.     The matter was carried in appeal.     During the<\/p>\n
pendency of the Writ Appeal there was an interim order and on<\/p>\n

the strength of it, the existing seniority list was followed for<\/p>\n
promotion. Based on the seniority position in that list, Exts.P7<\/p>\n
and P7(a) lists prepared by the Departmental Promotion<\/p>\n
Committee were also published.          Persons named therein,<\/p>\n
including the appellants herein were promoted, subject to the<\/p>\n
result of the Writ Appeal. The Writ Appeal was finally dismissed<\/p>\n
by Ext.R2(b) judgment dated 14.1.2009. In implementation of<\/p>\n
Annexure R2(a) judgment, which was affirmed in Annexure R2<\/p>\n
(b) judgment, revised seniority list Annexure R2(d) was<\/p>\n
published.   Relying on Annexure R2(d), a fresh DPC list was<\/p>\n
published in the official gazette dated 14.10.2009. Now, based<\/p>\n
on that, persons included in that list are promoted. As a result,<\/p>\n
the appellants will be facing reversion. Since the learned Single<\/p>\n
Judge vacated the stay already granted, now they will be<\/p>\n
reverted. Hence this appeal.\n<\/p>\n
     2. The learned senior counsel Sri.K.Ramakumar submitted<\/p>\n
that the appellants are continuing in their promoted post since<\/p>\n
2008. They are entitled to sit back. The learned senior counsel<\/p>\n
also submitted that during the pendency of the Writ Appeal, the<\/p>\n

earlier list was operated and they were promoted. The said fact<\/p>\n
was not brought to the notice of the Division Bench at the time<\/p>\n
of   dismissal of the appeal. The select list was also not<\/p>\n
challenged.\n<\/p>\n
     3.     If we say something on the merits of the points<\/p>\n
canvassed by the learned senior counsel, the same will affect<\/p>\n
one side or the other. But, having regard to the principles of<\/p>\n
balance of convenience, prima facie, we are of the view that the<\/p>\n
persons now promoted should be allowed to continue in the<\/p>\n
promotion post in preference to the appellants. Further, what is<\/p>\n
challenged is only an interim order.        Therefore, unless that<\/p>\n
order is shown to be plainly arbitrary or perverse, the appellate<\/p>\n
court is not supposed to interfere with the same.<\/p>\n
     4.     In view of the above position, the Writ Appeal is<\/p>\n
dismissed. But, it is clarified that the learned Single Judge, who<\/p>\n
is hearing the Writ Petition, shall consider the grounds urged by<\/p>\n
the appellants uninfluenced by the prima facie view taken by us<\/p>\n
WA No.1825\/2009\n<\/p>\n
