No. 175 OF 2004\n              .........................................................................\n                    Dated this the 11th February, 2009\n\n\n                                  J U D G M E N T\n<\/pre>\n<p>Basant, J. :\n<\/p>\n<\/p>\n<p>      The claimant before the Tribunal is the appellant before us.<\/p>\n<p>He had claimed an amount of Rs. 5 lakhs as compensation for the<\/p>\n<p>personal injuries suffered in an accident. The Tribunal initially<\/p>\n<p>awarded an amount of Rs.50,000\/- as compensation. Later, on<\/p>\n<p>an application to review the award filed by the claimant, the<\/p>\n<p>Tribunal reviewed the earlier award and directed payment of Rs.<\/p>\n<p>75,000\/- as compensation. The claimant\/appellant is aggrieved<\/p>\n<p>by the impugned award.\n<\/p>\n<p>      2. Learned counsel for the appellant submits that a proper<\/p>\n<p>award has not been passed in spite of acceptance of the prayer<\/p>\n<p>for review.       The Tribunal has not considered the claim<\/p>\n<p>methodically and rationally.                    The         amounts               payable under<\/p>\n<p>different heads have not been fixed. Not even an attempt has<\/p>\n<p>M.A.C.A. No. 175 OF 2004<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>been made to ascertain the amount payable under different<\/p>\n<p>heads, it is contended. A further opportunity may be granted for<\/p>\n<p>adducing evidence before the Tribunal and the Tribunal may be<\/p>\n<p>directed to dispose of the matter afresh in accordance with law,<\/p>\n<p>after giving the parties       an opportunity to adduce further<\/p>\n<p>evidence, if any, it is submitted.\n<\/p>\n<p>     3.    The third respondent, the Insurance Company has<\/p>\n<p>entered    appearance. The course suggested by the learned<\/p>\n<p>counsel for the claimant\/appellant has not been objected by the<\/p>\n<p>learned counsel for the third respondent. We are satisfied that<\/p>\n<p>the interests of justice would be eminently served by directing<\/p>\n<p>the Tribunal to dispose of the matter afresh.<\/p>\n<p>     In the result:\n<\/p>\n<p>     (a) This appeal is allowed in part.\n<\/p>\n<p>     (b) The impugned award is set aside.\n<\/p>\n<p>     (c) The Tribunal is directed to dispose of the matter afresh<\/p>\n<p>after  giving    opportunity to the parties to adduce     further<\/p>\n<p>evidence, if any, in support of their contentions.<\/p>\n<p>     (d)     The parties shall appear before the Tribunal on<\/p>\n<p>M.A.C.A. No. 175 OF 2004<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><\/p>\n<p>30.03.2009.\n<\/p>\n<p>     (e)   The Registry shall forward a copy of this judgment<\/p>\n<p>forthwith to the Tribunal.\n<\/p>\n<p>     (f)  There shall be a further direction to the Tribunal to<\/p>\n<p>make every endeavor to dispose of the claim as expeditiously as<\/p>\n<p>possible and at any rate, within a period of three months from<\/p>\n<p>30.03.2009.
