Justice K.T.SANKARAN\n\n Dated :21\/01\/2010\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                   B.A.Nos.185 &amp; 229 of 2010\n                  ---------------------------------------------\n             Dated this the 21st day of January, 2010\n\n\n\n\n                               ORDER\n<\/pre>\n<p>       These are applications for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. Bail Application No.185 of 2010 is<\/p>\n<p>filed by the third accused in CR No.54 of 2009 of Vamanapuram<\/p>\n<p>Excise Range.     Bail Application No.229 of 2010 is filed by<\/p>\n<p>accused Nos.1 and 2 in that crime.\n<\/p>\n<p>      2.  The offence alleged against the petitioners is under<\/p>\n<p>Section 55(a) of the Abkari Act.\n<\/p>\n<p>      3.   The prosecution case is that on 19.12.2009, the<\/p>\n<p>accused persons were found transporting 40 litres of spirit in a<\/p>\n<p>car. The petitioners were arrested on 19.12.2009 and they were<\/p>\n<p>remanded to judicial custody.\n<\/p>\n<p>      4.   The learned Public Prosecutor submitted that accused<\/p>\n<p>No.1 is involved in three other abkari cases. It is submitted that<\/p>\n<p>if accused No.1 is released on bail, it is most likely that he would<\/p>\n<p>indulge in similar criminal activities.<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p><span class=\"hidden_text\">BA Nos.185&amp; 229\/2010              2<\/span><\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to<\/p>\n<p>accused Nos.2 and 3 (Prasanth and Suresh @ Kochu). However,<\/p>\n<p>I am not inclined to grant bail to accused No.1 (Sambasivan @<\/p>\n<p>Samban) at this stage.\n<\/p>\n<p>      Accused Nos.2 and 3 shall be released on bail on their<\/p>\n<p>executing bond for Rs.25,000\/- each with two solvent sureties for<\/p>\n<p>the like amount to the satisfaction of the Judicial Magistrate of<\/p>\n<p>the First Class-I, Nedumangad, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<\/p>\n<p>a)    Accused Nos.2 and 3 shall report before the investigating<br \/>\n      officer between 9 A.M. and 11 A.M. on every Monday and<br \/>\n      Thursday for a period of two months and thereafter on<br \/>\n      every Monday, till the final report is filed or until further<br \/>\n      orders;\n<\/p>\n<p>b)    Accused Nos.2 and 3 shall appear before the investigating<br \/>\n      officer for interrogation as and when required;<\/p>\n<p>c)    Accused Nos.2 and 3 shall not try to influence the<br \/>\n      prosecution witnesses or tamper with the evidence;<\/p>\n<p>d)    Accused Nos.2 and 3 shall not commit any offence or<br \/>\n      indulge in any prejudicial activity while on bail;<\/p>\n<p><span class=\"hidden_text\">BA Nos.185&amp; 229\/2010              3<\/span><\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is dismissed in so far as it relates to<\/p>\n<p>accused No.1 and it is allowed in the manner indicated above in<\/p>\n<p>so far as it relates to accused Nos.2 and 3.<\/p>\n<p>                                              K.T.SANKARAN,<\/p>\n<p>                                                 JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Suresh @ Kiochu vs State Of Kerala Rep.
