V. Claim Tribunal, Valsad at<br \/>\nNavsari in M. V. Claim Petition No.256 of 1982, are before this Court<br \/>\nwith a submission that the learned Tribunal below erred in awarding<br \/>\nless compensation in view of the evidence brought on the record.\n<\/p>\n<p>2.\t\tAs<br \/>\nno cross appeal or cross objections has\/have been filed by the other<br \/>\nside, this Court is not required to enter into the question of<br \/>\nrashness, negligence and liability of the respondents to pay the<br \/>\namount.\n<\/p>\n<p>3.<br \/>\n\t\t\tAfter taking me through the evidence available on the record, Shri<br \/>\n\tDeep Vyas, learned Counsel for the appellants, submitted that the<br \/>\n\tlearned Tribunal below erred in deducting a sum of Rs.800\/- from the<br \/>\n\tyearly agricultural income of Rs.2,000\/- and erred in deducting a<br \/>\n\tsum of Rs.300\/- from the monthly income of Rs.650\/- earned by the<br \/>\n\tdeceased from his factory business. According to him, when the<br \/>\n\tfamily consists of six persons, then, deduction of 40% to 46% under<br \/>\n\tthe different heads would be on the higher side and the Court should<br \/>\n\tnot lose sight of the fact that the person would not have the lion&#8217;s<br \/>\n\tshare when he has to maintain the youngs in the family.\n<\/p>\n<p>4.\t\tMs.\n<\/p>\n<p>Archana Acharya, learned Counsel for the respondent-Insurance<br \/>\nCompany, on the other hand, submitted that the award made by the<br \/>\nlearned Tribunal below is in accordance with law and does not call<br \/>\nfor any interference.\n<\/p>\n<p>5.\t\tSo<br \/>\nfar as the yearly income from agricultural operations, etc. is<br \/>\nconcerned, this Court does not find any difficulty in finding that<br \/>\nthe learned Tribunal below was justified in assessing the said<br \/>\nagricultural income to be Rs.2,000\/- per year and in deducting an<br \/>\namount of Rs.800\/- out of the same under the head of personal<br \/>\nexpenses of the deceased.\n<\/p>\n<p>6.\t\tSo<br \/>\nfar as the income from the diamond cutting factory is concerned, the<br \/>\nlearned Tribunal below, after holding that the monthly income could<br \/>\nbe Rs.650\/-, firstly deducted a sum of Rs.100\/- under the head of<br \/>\npersonal expenses and thereafter, again deducted a sum of Rs.200\/-<br \/>\nunder the head of personal expenses of the deceased for the articles<br \/>\nlike food, clothes, etc. <\/p>\n<p>7.\t\tIn<br \/>\nthe opinion of this Court, such double deductions were not<br \/>\npermissible. The deceased was required to maintain the family of six<br \/>\npersons (including his own self). If a sum of Rs.300\/- is kept aside<br \/>\nfor the personal expenses of the deceased and only a sum of Rs.350\/-<br \/>\nis left for five persons, then, each of them would be getting a sum<br \/>\nof Rs.2.40 per day. It would be impossible for a man to survive with<br \/>\nan amount less than Rs.2.50 per day.\n<\/p>\n<p>8.\t\tTaking<br \/>\ninto consideration the totality of the circumstances, I hold that the<br \/>\ndependency can be well assessed at Rs.500\/- per month, that is, a sum<br \/>\nof Rs.150\/- in addition to what the learned Tribunal has already<br \/>\nassessed. The yearly dependency would be Rs.1,800\/-. Applying the<br \/>\nmultiplier of 15 (fifteen), as applied by the learned Tribunal below,<br \/>\nI hold that the appellants would be entitled to an additional amount<br \/>\nof Rs.27,000\/-. Each of the respondents shall be held liable jointly<br \/>\nand severally to pay the additional amount with 6% interest per annum<br \/>\nfrom the date of the claim petition till realisation.\n<\/p>\n<p>9.\t\tThe<br \/>\nappeal is accordingly allowed to the extent indicated above.
