These two appeals by the insurer <\/p>\n
claimants are directed against the  ”<\/p>\n
judgment and award dated 20.62006′   V<\/p>\n
No.545i \/2002 on the \ufb01le of the   <\/p>\n
Small Causes, Member,  “Area, it<\/p>\n
Bangalore [SCCH NVo’..1×2) ihereinaafter referred to as<\/p>\n
‘Tribunal’ for short).\n<\/p>\n
award 180\/– with interest at 6%<\/p>\n
p.a. fromrthieg date\ufb01glof petition till realisation, as<\/p>\n
 against the  of the claimants for a sum of<\/p>\n
  e__ on account of the death of the deceased<\/p>\n
 the road traffic accident.\n<\/p>\n
 -3.””v7l’hex_insurer claimed that though the Tribunal<\/p>\n
it V’ hasidiscussed in the body of the judgment regarding the<\/p>\n
‘  contributory negligence on the part of the deceased at<\/p>\n
 25%, it has awarded compensation to the claimants<\/p>\n
without deducting any amount towards contributoiy<\/p>\n
\u00e9w<\/p>\n
to the right side of lorry, he has dashed against<\/p>\n
offending vehicle and therefore contributory<\/p>\n
has to be fixed at 50% on the deceased._.H,et   l <\/p>\n
our notice that though the <\/p>\n
the body of the judgmer1t\u00bbe’regardin_’g” the <\/p>\n
negligence on the part of the4l”‘deceased”a:t_ ‘.2150\/(Vii, it has<\/p>\n
awarded compensatieui’ _to_ gthhe’*V–_’ggel:airnants without<\/p>\n
deducting any amount’V-towards_”\u00bbco’nt_ribiitory negligence

\nthe recitals  rnahazar, it discloses
\nthat the  been parked properly on<\/p>\n
the left side or tVV1″lC.’4VITtQEL4C\u20ac1:’_.if’1″‘OII1 the middle line marking.<\/p>\n
 That \u00a7:i.ridi*catedl it-was’ ‘parked towards the left side of the<\/p>\n
 road..at.,_ft. On account of the rash and negligent<\/p>\n
drnririg  by the deceased without properly<\/p>\n
‘.V.maki’ngVlu:se4of the rest of the road which had been left<\/p>\n
it ‘Xfiox_Vthe right side of lorry, he has dashed against<\/p>\n
  offending vehicle and therefore the contributory<\/p>\n
 negligence has to be \ufb01xed at 50% on the deceased.<\/p>\n

He further contended that the quantL:ni*.o. of<\/p>\n
Compensation awarded to the claimants is on:wtliet’Vh_i_gher<\/p>\n
side and it has to be reduced. Therefore.,__hjeprays   i <\/p>\n
modification of the impugned <\/p>\n
the tribunal.\n<\/p>\n
7. As against this,  for the
\nclaimants, interaiiag:_,,._..l:”Cor’ite3’_idle’d.Aland vehemently
\nsubmitted that negligence on the
\npart of   Tribunal is not
\nsustainable   offending vehicle was
\nparkedgin   road loaded with iron beams<\/p>\n
protruding._outsidellt.hebody of the trailer, unattended<\/p>\n
 and..iyithout any .s__1’g_n..al or indication or caution to the<\/p>\n
 other 1<oad:4usve.rs. The fact that the place where the<\/p>\n
xl\/ehicle  parked was dark and the vehicles or any<\/p>\n
T_othe:r .ob}ects in the front was not Visible are not in<\/p>\n
A  From the recitals in the panchanarna it is clear<\/p>\n
  that the deceased has applied brakes in order to avoid<\/p>\n
 accident and that is fortified by 50 ft. tyre marks found<\/p>\n
on the road. This aspect of the matter has not been<\/p>\n

I0<\/p>\n
looked into, considered by the Tribunal in fmin:g"*.the<\/p>\n
contributory negligence. Further, he contended <\/p>\n
compensation awarded to the claimants  of  i <\/p>\n
dependency and conventional heladsis cj:.n1the.'iovvenisidre.'<\/p>\n
and it requires enhancement modifying the <\/p>\n
impugned judgment and award: <\/p>\n<\/p>\n
8. After careful suhmissions
\nof the counsel on both arise for
\nour    follows :~\n<\/p>\n
i)  fixed on the<\/p>\n
p’art–.oi; at ”25% and on the driver of<\/p>\n
the offeiiding  at 75%, is just and proper?<\/p>\n
  ii)  ._%:\u00ab:.Wr:etherV”t’l’ie ,quantum of compensation awarded to<\/p>\n
” ‘V .. vtheclairtnants is just and reasonable?<\/p>\n
  point No.1 : After careful perusal of<\/p>\n
 ;’Exs,P1.  P5, what emerges is that, charge sheet as per<\/p>\n
   has been \ufb01led against the driver of the offending<\/p>\n
T  “vehicle which is not in dispute. Further, it is crystal<\/p>\n
it clear from the perusai of Ex.P2–sketch and _Ex.P4~<\/p>\n

perusal of the evidence on record, both oralldand<\/p>\n
documentary, what emerges is that, had <\/p>\n
driven his car slowly he could have avoided.    <\/p>\n
since it is evident from the records:.that;’–_on_’seeing’ the<\/p>\n
truck being parked, he had triedlto ‘apply”b1fal;e  is <\/p>\n
evident from the tyre marks road’  extent of
\nabout 50 ft. The T1’ibi_rnal ivrightlylooked into this
\naspect of the matter andhas pthvellll\ufb01nding of fact
\nholding    the part of the<\/p>\n
deceasedp__ValsQl”‘tn;:the\u00bb.,_e:\u00a7tleAn’t\u00ab.oiVV_2:S%, which is just and<\/p>\n
proper; Afterlr’freaplpreciation of the oral and<\/p>\n
documentary evider1ce,.’.’_i;rJe also concur with the said<\/p>\n
  of the Tribunal while fixing the contributory<\/p>\n
 negligencey :at\u00b0*2\\5% on the deceased and 75% on the<\/p>\n
driver   offending vehicle and therefore,<\/p>\n
C_interteren_ce by this Court is not cailed for.<\/p>\n

The occurrence of the accident and the resultant<\/p>\n
it death of the deceased are not in dispute. The deceased<\/p>\n
was aged about 35 years working as a Development<\/p>\n

\napplying    appropriate multiplier

  i’~Accordingly,y.we award a sum of ?34,23,360\/-<\/p>\n

ll ”   is not in dispute that the deceased was<\/p>\n
Igthe solelllrlgrelad winner in the family. On account of the<\/p>\n
it lffuntimely death of the deceased, the first claimant, wife<\/p>\n
  ofggdeceased, has lost her life partner at the young age<\/p>\n
 and claimants 2 and 3, parents, have lost the love and<\/p>\n
affection of their son and their security, future hopes<\/p>\n
