No.42464 of 2010\n                   GANESH MAHTO SON OF LATE SHIVSHANKAR MAHTO\n                                           Versus\n                                    STATE OF BIHAR\n\n2   22.12.2010<\/pre>\n<p>            Heard both sides.\n<\/p>\n<p>                          Petitioner seeks bail in a case instituted under diverse<\/p>\n<p>                 sections of Indian Penal Code including Section 307 IPC.<\/p>\n<p>                          As per allegation in the First Information Report, he is<\/p>\n<p>                 said to have assaulted by lathi on his elbow causing some<\/p>\n<p>                 injury. This is what the petitioner has stated in paragraph 9 :<\/p>\n<blockquote><p>                          &#8220;9. That, as regard the allegation against the<br \/>\n                           petitioner it would be clear from the F.I.R. that he<br \/>\n                           simply gave a Lathi blow on the right elbow of the<br \/>\n                           informant as also on the right hand of the son of<br \/>\n                           the informant but both the injuries were simple in<br \/>\n                           nature, the injury alleged to have been sustained<br \/>\n                           by the informant and his son were not on the vital<br \/>\n                           part of the body so offence under section 307 has<br \/>\n                           not been attracted.&#8221;<\/p><\/blockquote>\n<p>                          Learned counsel for the petitioner, referring to<\/p>\n<p>                 Annexure-2, submits that because of the aforesaid complaint<\/p>\n<p>                 having been lodged by the petitioner with the authority, he has<\/p>\n<p>                 been named in the present case with certain allegations. It is<\/p>\n<p>                 next submitted that allegation of commission of theft, in the<\/p>\n<p>                 facts and circumstances of the case, seems to be ornamental. It<\/p>\n<p>                 is next contended that he is in custody since 17.9.2010.<\/p>\n<p>                          In the facts and circumstances of the case, let<\/p>\n<p>                 petitioner above named be released on bail on furnishing bail<\/p>\n<p>                 bond of Rs. 10,000\/- (ten thousand) with two sureties of the like<\/p>\n<p>                 amount each to the satisfaction of learned Chief Judicial<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>      Magistrate, Jehanabad in connection with Makhdumpur P.S.<\/p>\n<p>      case no. 243\/2010     subject to the condition that one of the<\/p>\n<p>      bailers will be own\/close family member of the petitioner.<\/p>\n<pre>pkj                       (Kishore K.
