SIRI JAGAN, J.\n                 -----------------------------------\n                    W.P.(C) No.38289 OF 2010\n               ---------------------------------------\n          Dated this the 23rd day of December, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>     The petitioner is a driver appointed on daily wages in the<\/p>\n<p>third respondent Panchayat. According to the petitioner, there is<\/p>\n<p>no permanent post of driver in the Panchayat and therefore, the<\/p>\n<p>Panchayat is engaging a driver on daily wage basis. He would<\/p>\n<p>therefore submit that it is unjust and illegal to terminate his<\/p>\n<p>service to engage another person on daily wage basis. According<\/p>\n<p>to the petitioner, he was selected after a selection process and<\/p>\n<p>therefore, except for accommodating a regular hand after<\/p>\n<p>sanctioning of the post of driver in the Panchayat the petitioner&#8217;s<\/p>\n<p>service cannot be terminated, which is proposed by the<\/p>\n<p>Panchayat. The petitioner, therefore, seeks the following reliefs:<\/p>\n<blockquote><p>         &#8220;(i)   Declare that the petitioner&#8217;s service cannot be<br \/>\n         terminated from the post of Jeep Driver on daily wage<br \/>\n         basis by the respondents based on Ext.P7 Government<br \/>\n         Order or based on the change of governing council of the<br \/>\n         3rd respondent Grama Panchayath in the recent election.\n<\/p><\/blockquote>\n<blockquote><p>         (ii)   Declare that Ext.P7 Government Order is not<br \/>\n         applicable in the case of the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>         (iii)  Declare that petitioner is appointed as Jeep Driver<br \/>\n         on daily wage basis by the 3rd respondent through a duly<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.38289\/10                    2<\/span><\/p>\n<p>          conducted selection process known to law.\n<\/p><\/blockquote>\n<blockquote><p>          (iv)   To issue a writ of mandamus or any other<br \/>\n          appropriate writ, order or direction commanding the<br \/>\n          respondents not to terminate the service of the<br \/>\n          petitioner on the basis of Ext.P7 or on the basis of the<br \/>\n          change of governing council of the 3rd respondent<br \/>\n          Grama Panchayath in the recent election until a<br \/>\n          regular hand is appointed after sanction of the post of<br \/>\n          Driver and selection by the Kerala Public Service<br \/>\n          Commission     or  the   3rd  respondent    Panchayath<br \/>\n          continues to require the service of drivers.&#8221;<\/p><\/blockquote>\n<p>      2.    Employment to the post of driver in a Panchayat<\/p>\n<p>even if temporary is a public employment. All eligible persons<\/p>\n<p>are entitled to be given an opportunity to compete for<\/p>\n<p>appointment to that post.               Therefore, for such public<\/p>\n<p>appointment a selection process known to law is mandatory,<\/p>\n<p>failing which the same would violate the fundamental rights of<\/p>\n<p>those eligible persons under Articles 14 and 16 of the<\/p>\n<p>Constitution of India.\n<\/p>\n<p>      I am unable to accept Ext.P1(a) as a proper selection<\/p>\n<p>process, in so far as that notice has been admittedly published<\/p>\n<p>only in the Notice Board of the Panchayat and other<\/p>\n<p>Government Offices.         I do not think that, that would be<\/p>\n<p>sufficient publication of the notice inviting applications, in so<\/p>\n<p>far as one cannot except the eligible persons to visit those<\/p>\n<p>offices daily to be informed about such a notice. Therefore,<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.38289\/10               3<\/span><\/p>\n<p>properly the notification should have been published in one of<\/p>\n<p>the newspapers having circulation in the locality. In so far as<\/p>\n<p>that has not been done, the same cannot be accepted as a<\/p>\n<p>selection process. That being so, the petitioner cannot hope to<\/p>\n<p>continue the present daily wage employment. The Panchayat<\/p>\n<p>is bound to engage further persons after a selection process<\/p>\n<p>known to law namely, by publication of the notice in<\/p>\n<p>newspapers and considering all applicants in accordance with<\/p>\n<p>their merit.       The same having not been done while<\/p>\n<p>appointing the petitioner, I am not inclined to entertain this<\/p>\n<p>writ petition and accordingly, the same is dismissed.<\/p>\n<p>                                   S.
