Even<br \/>\n\tthe Official Liquidator has also confirmed the same.\n<\/p>\n<p>\tIn<br \/>\n\tview of this clarification, directions issued by this Court on<br \/>\n\t25.08.2008 to the respondent Nos.2 and\/or 3 to deposit the amount of<br \/>\n\tRs.1,50,000\/- with the Registry of this Court are not required to be<br \/>\n\tcomplied with. However, at the same time, the order of the Labour<br \/>\n\tCourt and\/or Industrial Court in the T. application as well as<br \/>\n\trecovery application are in his favour and it is also an admitted<br \/>\n\tposition that he has not been paid any amount till this date.  A<br \/>\n\tdispute has been raised on behalf of the Official Liquidator that<br \/>\n\tearlier, he has moved this Court and this Court has directed the<br \/>\n\tapplicant to approach the Official Liquidator by lodging his claim<br \/>\n\tand the said claim was directed to be examined on its own merits and<br \/>\n\tin accordance with law.  Pursuant to the said directions, the matter<br \/>\n\twas referred to the Chartered Accountant and the Chartered<br \/>\n\tAccountant has submitted his report.  In this view of the matter,<br \/>\n\tthe claim of the present applicant is required to be examined on<br \/>\n\tmerits and the fund position of the Company in liquidation is also<br \/>\n\tto be taken into consideration.  The Official Liquidator is,<br \/>\n\ttherefore, directed to file his report indicating the fund position<br \/>\n\tof the Company in liquidation.
