Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/01\/2007\n\n O R D E R\n                           M.SASIDHARAN NAMBIAR,J.\n\n                         --------------------------\n\n                             C.R.P.No.269 OF 2006\n\n                         -------------------------\n\n              DATED THIS THE 16th DAY OF JANUARY, 2007\n\n\n                                          ORDER\n<\/pre>\n<p>       Petitioner   is   third   judgment   debtor   in   O.S.339\/96   on   the   file   of<\/p>\n<p>Sub Court, Irinjalakuda.   As per order dated, 13.2.06, executing Court<\/p>\n<p>found that petitioner   has sufficient means to pay the decree debt and<\/p>\n<p>petitioner   willfully   refused   to   pay   same.     Executing   Court   directed<\/p>\n<p>petitioner   to   pay   the   balance   decree   debt   within   two   months.     It   is<\/p>\n<p>challenged   in   this  revision   petition   filed   under   Section   115   of   Code   of<\/p>\n<p>Civil Procedure.\n<\/p>\n<\/p>\n<p>       2.      Learned Counsel appearing for petitioner was heard.<\/p>\n<p>       3.      Arguments of learned Counsel appearing for  petitioner was<\/p>\n<p>that evidence of petitioner as RW1 establish that he has taken voluntary<\/p>\n<p>retirement   and   is   not   having   sufficient   means   to   pay   the   decree   debt<\/p>\n<p>and therefore the order is to be quashed.\n<\/p>\n<\/p>\n<p>       4.      Learned   Munsiff   on   the   evidence   considered   the   question<\/p>\n<p>whether   petitioner   has   sufficient   means.     It   was   found   that   petitioner<\/p>\n<p>received   Rs.1,17,481\/-   from   his   employer   at   the   time   of   retirement.<\/p>\n<p>Though it was contended by petitioner that he had paid that amount to<\/p>\n<p>different   creditors,   no   satisfactory   evidence   was   adduced   to   establish<\/p>\n<p>that  fact.     On   the   evidence   it   was   found   that   petitioner   has   sufficient<\/p>\n<p><span class=\"hidden_text\">C.R.P.269\/06                                2<\/span><\/p>\n<p>means.     Though   learned   Counsel   appearing   for   petitioner   sought<\/p>\n<p>remand  of the case contending that petitioner has to be permitted<\/p>\n<p>to examine the creditors to whom petitioner paid the amount, even<\/p>\n<p>in the revision petition he has no case that sufficient opportunity to<\/p>\n<p>examine   witness   was   not  granted.    In  such   circumstances,   prayer<\/p>\n<p>for  remand cannot be allowed. On appreciating the evidence, I do<\/p>\n<p>not   find   any   illegality   or   irregularity   warranting   interference   in<\/p>\n<p>exercise   of   the   revisional   jurisdiction   of   this   Court.     Evidence<\/p>\n<p>establish that petitioner  has sufficient means.   Even though it was<\/p>\n<p>contended   that   petitioner   is   only   a   surety   and   the   mortgaged<\/p>\n<p>property is not proceeded against as petitioner has joint and several<\/p>\n<p>liability.   On   those   grounds   petitioner   cannot   avoid   the   liability   or<\/p>\n<p>avoid payment.\n<\/p>\n<\/p>\n<p>       5.       Learned Counsel appearing for petitioner then submitted<\/p>\n<p>that petitioner may be granted nine months time to pay the entire<\/p>\n<p>decree  debt.
