Case of the petitioner in brief is as follows.<\/p>\n<p>      As a collateral security to the loan availed by M\/s.Star<\/p>\n<p>Refineries Pvt. Ltd. and M\/s.Star Agro and Wheat Roller Flour<\/p>\n<p>Mills Pvt. Ltd., the 3rd respondent created an equitable<\/p>\n<p>mortgage in favour of the petitioner by depositing the title deed.<\/p>\n<p>The petitioner is aggrieved by the proceedings initiated at the<\/p>\n<p>instance of the additional 4th respondent, namely KSIDC, to sell<\/p>\n<p>the very same property for recovering all the amounts due to<\/p>\n<p>the KSIDC. Case of the petitioner is that there is no jurisdiction<\/p>\n<p>and the 1st respondent has not ascertained the details of the<\/p>\n<p>property including the existing charge over the property. The<\/p>\n<p>existing mortgage in favour of the petitioner was not<\/p>\n<p>considered. Learned counsel for the additional 4th respondent<\/p>\n<p>does not dispute that in the light of the mortgage created in<\/p>\n<p>WPC.31678\/08<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>favour of the petitioner by the 3rd respondent, it may not be open to<\/p>\n<p>the additional 4th respondent to proceed against the very same<\/p>\n<p>property ignoring the mortgage.
