And Anr. on 26 November, 2001<\/div>\n<\/p>\n<pre><\/pre>\n<p>ORDER<\/p>\n<p> J.K. Mehra, J. (Member)  <\/p>\n<p> 1. In this case, the Complainant&#8217;s case before the District Forum was that the Complainants were share-holders of Respondent No.1 having its registered office at a place in Madhya Pradesh outside the State of Gujarat. They received a letter of offer for 50 rights-shares at the rate of Rs. 10-each at a premium of Rs. 75\/- per share. The Complainant applied for the said rights shares as well as the additional shares and remitted the required payment of Rs. 5,000\/- in the form of stock invest of Central Bank of India. Bhavnagar dated 3.12.92. It was only in June 1993 that they came to know that the rights shares could not be issued to them as their rights had lapsed on account of not sending the application along with the required amount in full in time. The State Commission returned the compliant on the ground of lack of territorial jurisdiction. The State Commission, on appeal, went into this question and after hearing the parties dismissed the appeal. We find no infirmity in the orders of the fora below. The dismissal by the fora below will, however, not prejudice the petitioner&#8217;s right to approach the forum having jurisdiction to entertain the compliant.
