KURDUKAR\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\n     These appeals  are filed  against the  common judgement<br \/>\nand order  of the  High Court  of Andhra Pradesh Crl. A. No.<br \/>\n69\/96 and Crl. A. No. 483\/96.\n<\/p>\n<p>     The trial\tcourt convicted the appellant under Sections<br \/>\n498-A and  304-A and 304-B IPC. in Crl. Appeal No. 69\/96 the<br \/>\nappellant challenged  his conviction.  As he  was  acquitted<br \/>\nunder Section 302 IPC, the State filed Crl. A. No. 483\/96.\n<\/p>\n<p>     The High  Court  dismissed\t the  appeal  filed  by\t the<br \/>\nappellant,  allowed  the  appeal  filed\t by  the  State\t and<br \/>\nconvicted the  appellant for the offence of murder also. The<br \/>\nHigh  Court  then  observed  that  when\t the  appellant\t was<br \/>\nconvicted for  the offence punishable under Section 302 IPC,<br \/>\nthe question  whether he  should also  be convicted  for the<br \/>\noffence punishable under Section 304-B became academic.\n<\/p>\n<p>     It\t was   the  prosecution\t  case\tthat  the  appellant<br \/>\ncommitted the  death of\t his wife  and daughter. In order to<br \/>\nprove  its  case.  the\tprosecution  had  examined  10\teye-<br \/>\nwitnesses and  produced three  dying declarations.  PWs 1-10<br \/>\ndid into  support the  prosecution. The\t trial court relying<br \/>\nupon the  three dying  declarations convicted the appellant.<br \/>\nThe High  Court also  found that the three dying declaration<br \/>\nwere genuine  and truthful  and relying\t upon them  held the<br \/>\nappellant quilty.\n<\/p>\n<p>     What is  contended\t by  the  learned  counsel  for\t the<br \/>\nappellant is  that the\tdying declarations  &#8211; Ex.  P. 23 and<br \/>\nEx. P. 33 ought not to have been relied upon as they contain<br \/>\nimprovements. He  further pointed out that in the last dying<br \/>\ndeclaration a  clear attempt  was made to involve the father<br \/>\nof the\tappellant who  has now\tbeen acquitted\tby the\tHigh<br \/>\nCourt.\tBecause\t  of  some   doubt  arising   therefrom\t the<br \/>\nappellant&#8217;s father was given benefit of doubt. That does not<br \/>\nnecessarily mean  that it  was not  genuine. In any case, it<br \/>\ndoes  not   have  nay\tbearing\t upon  the  genuineness\t and<br \/>\ntruthfulness of\t the first  dying declaration  -Ex.  P.\t 26,<br \/>\nwhich was  recorded by\tthe Additional\tFirst Class Judicial<br \/>\nmagistrate  after   ascertaining  the  physical\t and  mental<br \/>\nfitness of the person making It. In that declaration she has<br \/>\nclearly stated that she was set on fire by her husband.\n<\/p>\n<p>     We see  no reason to discard that dying declaration. In<br \/>\nthat view of the matter, the conviction of the appellant has<br \/>\nto be confirmed.
