Justice P.BHAVADASAN\n\n Dated :31\/03\/2010\n\n O R D E R\n<\/pre>\n<p>                     P.BHAVADASAN, J.\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                WP(C) No.10826 of 2010-O\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                   Dated 31st March 2010<\/p>\n<p>                           Judgment<\/p>\n<p>          Aggrieved by the order dated 10.02.2010 in IA<\/p>\n<p>No.122\/10 in OP No.432\/06, the petitioner before the Court<\/p>\n<p>below has come up before this Court.\n<\/p>\n<p>          2. The petitioner claims to be in absolute<\/p>\n<p>possession and enjoyment of a property comprised in RS<\/p>\n<p>No.399\/1 of Kunnamangalam village. During the year<\/p>\n<p>2001, the respondent Board utilised a portion of the<\/p>\n<p>property owned by the petitioner for drawing a 110 KV DC<\/p>\n<p>line. Towards the value of the trees cut and removed, the<\/p>\n<p>respondent awarded a sum of Rs.58,654\/- to the petitioner.<\/p>\n<p>Since the petitioner was dissatisfied with the amount<\/p>\n<p>awarded by the Board, she approached the District Court<\/p>\n<p>as contemplated under the Indian Telegraph Act, for<\/p>\n<p>enhanced compensation. Copy of the said OP is produced<\/p>\n<p>as Ext.P1.     After filing counter statement by the<\/p>\n<p><span class=\"hidden_text\">WPC 10826\/10                       2<\/span><\/p>\n<p>respondent,     the   petitioner   filed   an    application for<\/p>\n<p>amendment of the OP, incorporating the value of the<\/p>\n<p>property and the extent of land rendered useless as a<\/p>\n<p>result of the drawing of line. The said amendment was<\/p>\n<p>allowed. Thereafter, she again filed an amendment<\/p>\n<p>application seeking a prayer for additional compensation of<\/p>\n<p>Rs.2,60,000\/- towards diminution in land value. Ext.P4 is<\/p>\n<p>the copy of the said application. That was rejected by the<\/p>\n<p>Court below on the ground that it was highly belated. The<\/p>\n<p>learned counsel for the petitioner pointed out that the Court<\/p>\n<p>below was not justified in dismissing the amendment<\/p>\n<p>application.\n<\/p>\n<p>            3. The learned counsel for the respondent, on<\/p>\n<p>the other hand, justified the dismissal of the amendment<\/p>\n<p>application and submitted that it was the second<\/p>\n<p>amendment application filed by the petitioner and it was<\/p>\n<p>filed only to drag on the proceedings. He submitted that the<\/p>\n<p>petitioner is not entitled to any reliefs in this Petition.<\/p>\n<p><span class=\"hidden_text\">WPC 10826\/10                        3<\/span><\/p>\n<p>           4. As rightly pointed out by the learned counsel<\/p>\n<p>for the petitioner, one fails to understand what is the<\/p>\n<p>prejudice caused to the respondent by allowing the<\/p>\n<p>application for amendment. Going through the facts of the<\/p>\n<p>case, it cannot be said that the amendment sought for, is<\/p>\n<p>not necessary for the proper adjudication of the issue<\/p>\n<p>involved in this case. It is felt that the Court below ought not<\/p>\n<p>have    dismissed     the     application    for    amendment.<\/p>\n<p>Accordingly, this Petition is allowed. Ext.P4 IA stands<\/p>\n<p>allowed.
