Heard learned counsel for the petitioner<\/p>\n<p>                    and the State.\n<\/p>\n<p>                               2.    Petitioner   is   an   applicant   for<\/p>\n<p>                    appointment a PDS dealer in Chandi Panchayat of<\/p>\n<p>                    Purnea Block within Sub-division and District of<\/p>\n<p>                    Purnea. The case for appointment as PDS dealer in<\/p>\n<p>                    several Block of Purnea District was considered by<\/p>\n<p>                    District Magistrate on 8.3.2008 which is evident<\/p>\n<p>                    from Annexure-5. Appointment of a PDS dealer in<\/p>\n<p>                    the Chandi Panchayat could not recommended as<\/p>\n<p>                    scheduled caste candidate was not available for<\/p>\n<p>                    being appointed as a PDS dealer against reserved<\/p>\n<p>                    scheduled caste vacancy. PDS dealer(s) in other<\/p>\n<p>                    categories for which the candidates were available<\/p>\n<p>                    was recommended. It is submitted that in case<\/p>\n<p>                    scheduled caste candidate is not available in Chandi<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>          Panchayat, petitioner&#8217;s candidature could have been<\/p>\n<p>          considered as he belongs to extremely backward<\/p>\n<p>          class.\n<\/p>\n<p>                     3. Having heard counsel for the parties, I<\/p>\n<p>          direct the Collector, Purnea to consider the request<\/p>\n<p>          of the petitioner for appointment as PDS dealer for<\/p>\n<p>          Chandi Panchayat against scheduled castes vacancy,<\/p>\n<p>          as early as possible, in any case within three months<\/p>\n<p>          from the date of receipt\/production of a copy of this<\/p>\n<p>          order before the District Magistrate, Purnea.<\/p>\n<pre>Ibrar\/-                           ( V.
