Indu       Bala     Pandey,<\/p>\n<p>                   learned           Additional          Public            Prosecutor<\/p>\n<p>                   appearing on behalf of the State.<\/p>\n<p>                               The      petitioners,             while       invoking<\/p>\n<p>                   inherent      jurisdiction          of    this        Court    under<\/p>\n<p>                   Section       482     of      the        Code     of     Criminal<\/p>\n<p>                   Procedure, have prayed for quashing of order<\/p>\n<p>                   dated       15.2.2007       passed       by     Sub     Divisional<\/p>\n<p>                   Judicial       Magistrate,          Masaurhi      in      Masaurhi<\/p>\n<p>                   P.S. Case No.19 of 2006, Tr. No.1625 of 2007.<\/p>\n<p>                   By    the    said    order,     learned         Sub    Divisional<\/p>\n<p>                   Judicial Magistrate has taken cognizance of<\/p>\n<p>                   the     offence       under     Section          3(x)     of     the<\/p>\n<p>                   Scheduled           Caste      and        Scheduled             Tribe<\/p>\n<p>                   (Prevention           of      Atrocities)Act                  besides<\/p>\n<p>                   Sections      341,     323\/34       of    the     Indian       Penal<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>Code.\n<\/p>\n<p>          Learned          counsel       for    the     petitioners<\/p>\n<p>has confined on the petition to challenge the<\/p>\n<p>order in respect of cognizance under Section<\/p>\n<p>3(x)    of     the        S.C.    and     S.T.        Act.    It    was<\/p>\n<p>submitted       by     the       learned       counsel        for   the<\/p>\n<p>petitioners that though F.I.R. was registered<\/p>\n<p>under Section 3(x) of the S.C. and S.T. Act<\/p>\n<p>and other sections of the Indian Penal Code,<\/p>\n<p>the    police,        after       investigation,             submitted<\/p>\n<p>final    form       only     in    respect       of    the     offence<\/p>\n<p>under     Indian          Penal     Code.       It     was     further<\/p>\n<p>argued that during the entire investigation,<\/p>\n<p>nothing       was    collected       suggesting            commission<\/p>\n<p>of offence under Section 3(x) of the S.C. and<\/p>\n<p>S.T. Act. It was further submitted that since<\/p>\n<p>from    very        beginning,       police          was     satisfied<\/p>\n<p>that no offence under the provisions of S.C.<\/p>\n<p>and S.T. Act was made out, the case was not<\/p>\n<p>investigated         by     the    officer       duly        competent<\/p>\n<p>under    the        rules    of     S.C.       and     S.T.    Rules.<\/p>\n<p>However, the learned Magistrate, contrary to<\/p>\n<p>the     record,       had        taken    cognizance          of    the<\/p>\n<p>offence even under Section 3(x) of the S.C.<\/p>\n<p>and    S.T.    Act.       The     Police       Officer,       who   had<\/p>\n<p>conducted investigation in the present case,<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>was not authorized to conduct investigation<\/p>\n<p>as per Rule-7 of the S.C. and S.T. Rules,<\/p>\n<p>1995.    Accordingly,               learned          counsel    for     the<\/p>\n<p>petitioners has prayed for quashing of order<\/p>\n<p>of    cognizance             to    the     extent       of    cognizance<\/p>\n<p>taken under Section 3(x) of the S.C. and S.T.<\/p>\n<p>Act.\n<\/p>\n<p>           Mrs.           Indu           Bala        Pandey,     learned<\/p>\n<p>Additional Public Prosecutor, while opposing<\/p>\n<p>the prayer of the petitioners, submits that<\/p>\n<p>said provision has already been amended and<\/p>\n<p>now even Assistant Sub Inspector of Police is<\/p>\n<p>competent           to         conduct           investigation           of<\/p>\n<p>offences       committed            under       the     provisions       of<\/p>\n<p>S.C. and S.T. Act. It was further submitted<\/p>\n<p>that     in    this           case,       cognizance          order     was<\/p>\n<p>passed long back on 15th February, 2007 and<\/p>\n<p>as     such    it        would        not       be    appropriate       to<\/p>\n<p>interfere          with       the     order      of     cognizance      at<\/p>\n<p>this     stage.              Accordingly,             learned         State<\/p>\n<p>counsel       has        prayed          for     rejection       of    the<\/p>\n<p>present petition.\n<\/p>\n<p>           Besides            hearing          learned       counsel    for<\/p>\n<p>the    parties,           I       have    perused        the    impugned<\/p>\n<p>order as well as the F.I.R. So far the point<\/p>\n<p>raised        by     the          learned        counsel        for    the<br \/>\n<span class=\"hidden_text\">                      4<\/span><\/p>\n<p>petitioners          that           the      case           was      not<\/p>\n<p>investigated by a competent authority, I am<\/p>\n<p>of     the    view        that       after       the        order     of<\/p>\n<p>cognizance,         such        point       is        not    at     all<\/p>\n<p>available. Moreover, during hearing, it was<\/p>\n<p>submitted      by    the       learned       counsel         for    the<\/p>\n<p>petitioners         that        case      has      already          been<\/p>\n<p>committed to the court of Sessions. However,<\/p>\n<p>charges have not been framed till date.<\/p>\n<p>             Keeping in view the fact that order<\/p>\n<p>of    cognizance         was    passed      long      back    in     the<\/p>\n<p>year    2007,    the       court       is    not       inclined      to<\/p>\n<p>interfere       with       the      order        of     cognizance.<\/p>\n<p>However,       since       learned          counsel          for    the<\/p>\n<p>petitioners has vehemently argued that during<\/p>\n<p>the     entire           investigation,               nothing        was<\/p>\n<p>collected      indicating           commission          of    offence<\/p>\n<p>under the provisions of S.C. and S.T. Act, it<\/p>\n<p>would be appropriate to grant liberty to the<\/p>\n<p>petitioners to raise all those points at the<\/p>\n<p>stage of charge. If such plea is taken at the<\/p>\n<p>time    of    charge,          it   is      expected        that     the<\/p>\n<p>learned trial court will examine the same on<\/p>\n<p>the basis of materials available in the case<\/p>\n<p>diary and he will pass a reasoned order on<\/p>\n<p>the petition. It is true that at the time of<br \/>\n<span class=\"hidden_text\">                          5<\/span><\/p>\n<p>        rejection of discharge        petition   as per the<\/p>\n<p>        provisions contained in either Sections 227,<\/p>\n<p>        239 or 245 of the Code of Criminal Procedure,<\/p>\n<p>        there is no requirement to assign reason but<\/p>\n<p>        in   view   of        the    peculiar    facts        and<\/p>\n<p>        circumstances    of    the   present    case,    it   is<\/p>\n<p>        required that learned trial Judge will pass a<\/p>\n<p>        reasoned order.\n<\/p>\n<p>                With above observation and direction,<\/p>\n<p>        the petition stands rejected.\n<\/p>\n<\/p>\n<p>                                         ( Rakesh Kumar,J.)<br \/>\nN.H.\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Goldan Singh @ Goltan Singh &amp;Amp; &#8230; vs State Of Bihar on 28 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
