Justice V.GIRI\n\n Dated :25\/09\/2008\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n       W.P ( C) Nos.27047, 27597 and 27048 of 2008\n                      --------------------------\n           Dated this the 25th September, 2008\n\n                        J U D G M E N T\n<\/pre>\n<p>      Common contentions have been taken up in these<\/p>\n<p>writ petitions and therefore they have been heard<\/p>\n<p>together and disposed of by a common judgment.<\/p>\n<p>      2.   Essentially the issue is covered in favour of the<\/p>\n<p>petitioners by earlier orders and judgments of this Court<\/p>\n<p>including Exhibits P5 and P6 in WP(C) No.27047 of 2008.<\/p>\n<p>In the circumstances, the facts in WP(C) No.27047 of<\/p>\n<p>2008 is taken as the leading case for convenience.<\/p>\n<p>      3.   Petitioner is the Manager of the Teachers<\/p>\n<p>Training Institute at Cherpu in Thrissur District. It is a<\/p>\n<p>Self Financing TTI which has been granted recognition by<\/p>\n<p>the NCTE, as evidenced by Exhibit P1.               Second<\/p>\n<p>respondent by Exhibit P2 invited applications for<\/p>\n<p>admission to the Self Financing TTC Course in the State.<\/p>\n<p>50% of seats are allotted to the Management and balance<\/p>\n<p>50%    are allotted to merit quota (Government quota).<\/p>\n<p>Management seats have already been filled up by the<\/p>\n<p>petitioner, according to him. But complete allotment to<\/p>\n<p>W.P ( C) Nos.27047, 27597 and 27048 of 2008<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>the merit seats are yet to be              made by the second<\/p>\n<p>respondent. Therefore, the institution is not in a position<\/p>\n<p>to go ahead with the classes with full strength.<\/p>\n<p>       4.    In identical situations this court considered the<\/p>\n<p>same issue and that the competent authority is bound to<\/p>\n<p>fill up the seats in the Government quota without delay.<\/p>\n<p>The said judgments have apparently become final, I do not<\/p>\n<p>find any reason to take a different view in these writ<\/p>\n<p>petitions.\n<\/p>\n<p>       5.
