          Petitioner is the accused in C.C.601\/2002 on<\/p>\n
the file of     Judicial First Class Magistrate-III,<\/p>\n
Neyyattinkara,  now      pending         as     L.P.24\/2006,   taken<\/p>\n
cognizance for the offence under Section 493 of Indian<\/p>\n
Penal Code   on Annexure-A complaint after conducting<\/p>\n
an inquiry under Section 202 of Code of Criminal<\/p>\n
Procedure. This petition is filed under Section 482 of<\/p>\n
Code of Criminal Procedure, to quash the proceedings<\/p>\n
contending that learned Magistrate                 has not conducted<\/p>\n
a proper enquiry under Section 202 of Code of Criminal<\/p>\n
Procedure. It is contended that Annexure-A complaint<\/p>\n
was filed    without any bonafides and falsely and<\/p>\n
first respondent without         filing a petition before the<\/p>\n
police,  filed     Annexure-A           complaint        before  the<\/p>\n
Magistrate directly and Magistrate without                  applying<\/p>\n
his  mind   as   per      Annexure-D           proceedings,    taken<\/p>\n
cognizance of the offence. It is contended that                when<\/p>\n
there was no marriage, as the original document of<\/p>\n

marriage mentioned     in the complaint was not filed,<\/p>\n
learned Magistrate should not have taken cognizance of<\/p>\n
the offence. It is also contended that second respondent<\/p>\n
did not prosecute O.P.94\/2002 filed by her after getting<\/p>\n
a copy of objection filed by the petitioner and the<\/p>\n
allegations in the complaint are not correct.<\/p>\n
            2.  Learned   counsel  appearing  for   the<\/p>\n
petitioner was heard. Learned counsel vehemently argued<\/p>\n
that    learned   Magistrate  should  not   have   taken<\/p>\n
cognizance of the offence and though it is alleged in<\/p>\n
the    complaint  that   petitioner had   taken   second<\/p>\n
respondent to the Sub Registrar Office for registering<\/p>\n
the marriage, in fact petitioner was illegally confined<\/p>\n
and forcibly taken to Sub Registrar’s    office and got<\/p>\n
the document    executed and registered and it was not<\/p>\n
voluntarily done and petitioner had no sexual contact<\/p>\n
with the second respondent and therefore, no offence<\/p>\n
under Section 493 of Indian Penal Code was committed.<\/p>\n
It is also argued that though cognizance was taken, as<\/p>\n
per order dated 8\/10\/2009, the order does not show that<\/p>\n
all the      materials were considered by the learned<\/p>\n
Magistrate and instead, it only shows that prima facie<\/p>\n
a case has been found without disclosing all the<\/p>\n

materials and therefore, the order is illegal. Relying<\/p>\n
on the decision of this court    in Kader   v.  State of<\/p>\n
Kerala<\/a> (1999 (3) KLT 262) it is argued that an enquiry<\/p>\n
under Section 202 of Code of Criminal Procedure       is<\/p>\n
not an empty formality and the order shows that learned<\/p>\n
Magistrate    did not conduct proper enquiry   and hence<\/p>\n
it is to be quashed.\n<\/p>\n
            3.  Records  produced by  petitioner   reveal<\/p>\n
that a     man missing case was originally registered by<\/p>\n
Puvar police, on the complaint that    second respondent<\/p>\n
lady is missing.      Second respondent along with the<\/p>\n
petitioner    were  arrested  from  the   house  of   the<\/p>\n
petitioner and produced before Judicial First Class<\/p>\n
Magistrate-III, Neyyattinkara. Annexure-E(1) statement<\/p>\n
of second respondent was recorded where she disclosed<\/p>\n
that she had gone to the house of   petitioner on her own<\/p>\n
wishes voluntarily and she is aged 18 years and she<\/p>\n
intends to live with the petitioner and she had not<\/p>\n
married him and she is to be          permitted to live<\/p>\n
according to her wishes.   As seen from Annexure-E report<\/p>\n
learned Magistrate therefore released second respondent.<\/p>\n
On the same day Annexure-F registered agreement was<\/p>\n
entered into by the petitioner and second respondent and<\/p>\n

got   it    registered   before  Sub   Registrar   office,<\/p>\n
Neyyattinkara stating the they       have been living as<\/p>\n
husband and wife and would thereafter live as husband<\/p>\n
and wife. True, the registered agreement          to live<\/p>\n
husband and wife will not create a legal marriage.<\/p>\n
Learned counsel appearing for the petitioner submitted<\/p>\n
that second respondent had in fact    reached the house of<\/p>\n
petitioner only on that morning and petitioner was taken<\/p>\n
to the Magistrate      under the pre-text     that second<\/p>\n
respondent     is to be identified     by him before the<\/p>\n
Magistrate    and  after  the    Magistrate  released  the<\/p>\n
second respondent, petitioner was     forcibly taken    to<\/p>\n
Sub Registrar office and got Annexure-F registered.<\/p>\n
            4.  On the materials produced, it cannot be<\/p>\n
said   that   second  respondent  was  not  there on   the<\/p>\n
previous night, when police took    second respondent and<\/p>\n
petitioner in custody and produced them before the<\/p>\n
Magistrate    and  the  marriage  agreement  entered  into<\/p>\n
before the Sub Registrar office was not voluntarily.<\/p>\n
These are all facts which could be decided only on<\/p>\n
evidence. Though learned Magistrate did not write a<\/p>\n
speaking order, while    taking cognizance of the offence,<\/p>\n
and   issuing   summons  under  Section  204  of  Code  of<\/p>\n

\n                               5<\/span><\/p>\n
Criminal Procedure.       Magistrate is not expected to<\/p>\n
write a detailed order as    in the case  of dismissal of<\/p>\n
the complaint under Section 203 of Code of Criminal<\/p>\n
Procedure.    Annexure-D  proceeding  paper  shows   that<\/p>\n
learned Magistrate    conducted an inquiry and statements<\/p>\n
of  complainant   and  witnesses  were  recorded  and  an<\/p>\n
investigation under Section 202(1) of Code of Criminal<\/p>\n
Procedure was ordered and a report was obtained. It is<\/p>\n
after conducting detailed enquiry under Section 202 and<\/p>\n
finding    a  prima  facie  case  Magistrate  has   taken<\/p>\n
cognizance of the offence.\n<\/p>\n
            5.  On the materials it cannot be stated<\/p>\n
that the cognizance taken was not     legal or proper as<\/p>\n
canvassed. In such circumstances, I find no reason to<\/p>\n
interfere with that order. Petitioner is at liberty    to<\/p>\n
seek an order of discharge, raising all the contentions,<\/p>\n
under Section 245 of Code of Criminal Procedure,       as<\/p>\n
necessarily the   Magistrate has to record   the evidence<\/p>\n
of second respondent    and her witnesses in the presence<\/p>\n
of   petitioner   as  provided  under  Section  244   and<\/p>\n
petitioner is at liberty to cross examine the witness,<\/p>\n
if so wishes. The Magistrate has to proceed under<\/p>\n
Section 246    of Code of Criminal Procedure  by framing<\/p>\n

\n                              6<\/span><\/p>\n
a charge only after hearing the petitioner and second<\/p>\n
respondent as provided under Section 245 of Code of<\/p>\n
Criminal Procedure .\n<\/p>\n
            Petition is dismissed.\n<\/p>\n<\/p>\n
