Dabhi, Ld. APP appears and waives service of notice of Rule on<br \/>\nbehalf of the opponent &#8211; State.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3.\t\tBy<br \/>\nfiling instant application under Section 389 [2]  of the Code of<br \/>\nCriminal Procedure (&#8216;Cr. P.C.&#8217; for short), the applicant  &#8211; convict<br \/>\nprisoner, who vide<br \/>\njudgment and order rendered  in Sessions Case No. 39\/2008 dated<br \/>\n26\/3\/2010, by the Ld. Addl. Sessions Judge and Presiding Officer,<br \/>\nF.T.C. No. 3, Rajkot at Morbi, by which the applicant has been<br \/>\nconvicted<br \/>\nfor the  offence under sections 304 Part-I, etc. of the Indian Penal<br \/>\nCode and sentenced to rigorous imprisonment of 10 years and fine of<br \/>\nRs.3,000\/-, in default of fine, RI of 3 months, has prayed for<br \/>\nsuspension of sentence  and to enlarge him  on regular bail during<br \/>\npendency and final hearing of the above numbered Criminal Appeal, on<br \/>\nthe grounds stated in the application.\n<\/p>\n<p>4.\t\tAt<br \/>\nthe time of hearing of the application, Mr. A.R.<br \/>\nChauhan,  learned advocate for the applicant, does not press this<br \/>\napplication and seeks leave to withdraw the same.\n<\/p>\n<p>5.\t\tMr.\n<\/p>\n<p>L.B. Dabhi, Ld. APP has no objection if leave as prayed for is<br \/>\ngranted.\n<\/p>\n<p>6.\t\tHence,<br \/>\nleave to withdraw the application is granted.
