Ext.P2 is an order passed<\/p>\n<p>by the Magistrate, granting permission.\n<\/p>\n<p>     2. Heard the learned counsel for the petitioner and learned<\/p>\n<p>counsel appearing on behalf of third respondent, besides learned<\/p>\n<p>government Pleader and standing counsel. Though service has<\/p>\n<p>been completed on third and fourth respondents, no appearance<\/p>\n<p>for additional 5th respondent.\n<\/p>\n<p>     3. Two proposals were made. Apparently, the first proposal<\/p>\n<p>was found inconvenient and causing loss.                     Then the second<\/p>\n<p>proposal involves drawing of line through the pathway of the<\/p>\n<p>property of the petitioner and through the boundary of Falcon<\/p>\n<p>Polymers, property of sri T.P.Mathew. It is specifically stated<\/p>\n<p>that only the pathway portion of the property of the petitioner is<\/p>\n<p>to be crossed and thereafter it passes through the side of the<\/p>\n<p>property of Falcon Polymers and then through the compound wall<\/p>\n<p>of the two properties. It is stated that in the eastern side, a<\/p>\n<p><span class=\"hidden_text\">Wp(c)31476\/2008                    2<\/span><\/p>\n<p>small portion passes through the property of T.P.Mathew. Falcon<\/p>\n<p>Polymers, represented by third and fourth respondents, has<\/p>\n<p>stated that they orally agree to the proposal. The said proposal<\/p>\n<p>is found to be most convenient and suitable. Therefore both<\/p>\n<p>proposals are seen considered and reasons are given for not<\/p>\n<p>accepting the first proposal. In such circumstances, in judicial<\/p>\n<p>review, I do not think it is for this court to substitute its view with<\/p>\n<p>that of the authority.      Learned counsel for third and fourth<\/p>\n<p>respondents reiterates on behalf of Falcon Polymers that they<\/p>\n<p>have no objection. In such circumstances, I find no reason to<\/p>\n<p>interfere with the writ petition. Writ petition fails. The same is<\/p>\n<p>dismissed.
