DAVE\n\t\t\n\t\n\n \n\nDate\n: 17\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tLearned<br \/>\nCounsel for the petitioners submits that the provisions of Gujarat<br \/>\nCivil Services(Pension) Rules, 2002 are applicable to the employees<br \/>\nof Ahmedabad Municipal Corporation and without following the<br \/>\nprocedure laid down under Rule 24, Sub-rule(2) of the said rules, no<br \/>\npunishment could have been imposed.  Besides, the petitioner, at the<br \/>\nrelevant point of time, was serving as Assistant Town Development<br \/>\nOfficer and all the actions taken by him were approved by the higher<br \/>\nauthorities and if inquiry is to be held by the respondent, the<br \/>\nofficers including the Municipal Commissioner of the Corporation,<br \/>\nincharge of such affairs of the Corporation, at the relevant point of<br \/>\ntime, are to be held responsible.\n<\/p>\n<p>2.\t\tIn<br \/>\nview of the above, learned Advocate for the petitioners is directed<br \/>\nto PRODUCE the resolution of Ahmedabad Municipal<br \/>\nCorporation adopting rules of Gujarat Civil Services(Pension) Rules,<br \/>\n2002 and further to furnish the names of the Municipal Commissioner<br \/>\nand Deputy Municipal Commissioner incharge, at the relevant point of<br \/>\ntime, when the petitioner was serving as Assistant Town Development<br \/>\nOfficer.\n<\/p>\n<p>\t\tS.O.\n<\/p>\n<p>to 8TH NOVEMBER, 2011.\n<\/p>\n<p>(ANANT<br \/>\nS.
