Justice V.GIRI\n\n Dated :19\/05\/2008\n\n O R D E R\n                           V.GIRI, J\n                         -------------------\n                    W.P.(C).14068\/2008\n                        --------------------\n            Dated this the 19th day of May, 2008\n\n                        JUDGMENT\n<\/pre>\n<p>      Petitioner, along with the fourth respondent, was<\/p>\n<p>appointed, as per Ext.P1 order, as Junior Instructor<\/p>\n<p>(Wireman), on a provisional basis.             Apparently, the<\/p>\n<p>petitioner is now proposed to be sent away, as a regular<\/p>\n<p>hand, the fifth respondent, who was on leave for taking up<\/p>\n<p>employment abroad has joined             duty. According to the<\/p>\n<p>petitioner,    he had joined duty prior to the fourth<\/p>\n<p>respondent and he should have been retained.<\/p>\n<p>2.    When the matter is taken up today, learned counsel<\/p>\n<p>for the petitioner Mr.Kaleeswaram Raj, submits that the<\/p>\n<p>petitioner&#8217;s services have been dispensed with. There are<\/p>\n<p>three other vacancies in the same post and the details of<\/p>\n<p>the same are given in I.A.5973\/2008. He has brought this<\/p>\n<p>to the notice of the third respondent under Ext.P2.<\/p>\n<p>3.    I heard learned Government Pleader also.<\/p>\n<p>W.P.(C).14068\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>4.   In the circumstances,      it is appropriate that the<\/p>\n<p>third respondent considers Ext.P2 within a short time,<\/p>\n<p>taking note of the fact that the petitioner has to go out of<\/p>\n<p>service even though PSC hands are yet to report for<\/p>\n<p>duty.\n<\/p>\n<\/p>\n<p>5.   In the result, writ petition is disposed of directing<\/p>\n<p>the third respondent to consider and take appropriate<\/p>\n<p>decision on Ext.P2 within a period of two weeks from the<\/p>\n<p>date of receipt of a copy of this judgment.
