SANJAY MUSAHAR SON OF MUNSHI MUSAHAR\n            BOTH R\/O VILLAGE- PAWAI, P.S.- MUFFASSIL, DISTRICT-\n            AURANGABAD\n                                       VERSUS\n                             THE STATE OF BIHAR\n                           ----------------------------------\n<\/pre>\n<p>3   08\/11\/2011             This     matter     has     been    placed    for<\/p>\n<p>                 consideration of prayer for bail of the appellants after<\/p>\n<p>                 receipt of the lower court records.<\/p>\n<p>                           Though the appellants have been convicted<\/p>\n<p>                 under sections 396 and 376 (2) (g) of the Indian Penal<\/p>\n<p>                 Code but considering the fact that initially the first<\/p>\n<p>                 information report was not instituted under section<\/p>\n<p>                 376 IPC moreover the medical report of the rape<\/p>\n<p>                 victim- PW 6 has not been brought on record coupled<\/p>\n<p>                 with the fact that the deceased received only two<\/p>\n<p>                 injuries when the allegation of assault is against five<\/p>\n<p>                 persons and above and the appellants are in custody<\/p>\n<p>                 since 11.6.2002,     let the appellants named above,<\/p>\n<p>                 during the pendency of this appeal be released on bail<\/p>\n<p>                 on furnishing bail bonds of Rs. 10,000\/-               (ten<\/p>\n<p>                 thousand) each with two sureties of the like amount<\/p>\n<p>                 each to the satisfaction of Sri Jagdish Prasad Mishra,<\/p>\n<p>                 Additional   Sessions       Judge,   F.T.C.
