SHAH)<\/p>\n<p>\t\tAppeal<br \/>\nadmit.\n<\/p>\n<p>\t\tMr.M.T.M.Hakim,<br \/>\nlearned Advocate who is on caveat waives service of notice of<br \/>\nadmission on behalf of the respondent No.1 \u00fd  original claimant.<br \/>\nMr.Sunil Parikh, learned Advocate waives service of notice of<br \/>\nadmission on behalf of respondent No.3. As there is consensus between<br \/>\nthe learned Advocates appearing on behalf of respondent No.1-<br \/>\noriginal claimant and learned Advocate appearing on behalf of<br \/>\nrespondent No.3 \u00fd  Insurance Company who are main contesting party<br \/>\nfor remanding the matter to the Tribunal, respondent No.2 is not<br \/>\nrequired to be heard at this stage, as main contesting party would be<br \/>\nrespondent No.1 herein \u00fd  original claimant. With the consent of the<br \/>\nlearned Advocates appearing on behalf of the respective parties, the<br \/>\nappeal is taken up for final hearing today, printing and paper-book<br \/>\nis dispensed with.\n<\/p>\n<p>2.\t\tPresent<br \/>\nappeal is by the appellant \u00fd  respondent No.2 in M.A.C.P.No.27 of<br \/>\n1991 challenging the judgment and award dated 05.07.2005 passed by<br \/>\nthe learned M.A.C.T.(Auxi.), 5th Fast Track Court,<br \/>\nPanchmahals at Godhra and also challenging the judgment and order in<br \/>\nMisc.Civil Application (M.A.C.P.) No.540 of 2005 passed by the<br \/>\nlearned M.A.C.T.(Main), Panchmahals dated 27.03.2006 reviewing the<br \/>\njudgment and award dated 05.07.2005 passed in M.A.C.P.No.27 of 1991<br \/>\npassed by the M.A.C.T.(Auxi.), Panchmahals at Godhra. The appellant<br \/>\nhas also challenged the judgment and order dated 25.06.2007 passed by<br \/>\nthe M.A.C.T(Main), Panchmahals at Godhra passed in Misc.Civil<br \/>\nApplication (M.A.C.P). No.51 of 2006 in rejecting the said<br \/>\napplication which was filed for quashing and setting aside the<br \/>\nex-parte order passed in Misc.Civil Application (M.A.C.P.)No.540 of<br \/>\n2005.\n<\/p>\n<p>3.\t\tWe<br \/>\nhave heard Mr.Rajni Mehta, learned Advocate appearing on behalf of<br \/>\nthe appellant; Mr.M.T.M.Hakim, learned Advocate appearing for<br \/>\nrespondent No.1 herein \u00fd  original claimant and Mr.Sunil Parikh,<br \/>\nlearned Advocate appearing on behalf of respondent No.3 \u00fd  Insurance<br \/>\nCompany.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe peculiar facts and circumstances of the case, there is consensus<br \/>\namongst the learned Advocates appearing on behalf of the respective<br \/>\nparties that all the aforesaid three orders be quashed and set aside<br \/>\nand the matter be remanded to the learned M.A.C.T., Panchmahals at<br \/>\nGodhra for deciding M.A.C.P.No.27 of 1991 afresh with a liberty to<br \/>\neither \/ any of the parties to the claim petition to request for<br \/>\nfurther evidence if they so choose.\n<\/p>\n<p>5.\t\tMr.Rajni<br \/>\nMehta, learned Advocate appearing on behalf of the appellant;<br \/>\nMr.M.T.M.Hakim, learned Advocate appearing for respondent No.1 \u00fd<br \/>\noriginal claimant and Mr.Sunil Parikh, learned Advocate for Insurance<br \/>\nCompany have stated at Bar that they have got full authority from<br \/>\ntheir clients to make above statement for quashing and setting aside<br \/>\naforesaid orders and to remand the matter to the Tribunal.<br \/>\nMr.R.V.Shah, learned Advocate who has appeared on behalf of the<br \/>\noriginal claimant before the Tribunal is also personally present in<br \/>\nthe Court and aforesaid statement is made in his presence and also<br \/>\nunder his instructions.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the consensus amongst the learned Advocates appearing on<br \/>\nbehalf of the respective parties, impugned judgment and award dated<br \/>\n05.07.2005 passed in M.A.C.P.No.27 of 1991 passed by the learned<br \/>\nM.A.C.T.(Auxi.), 5th Fast Track Court, Panchmahals at<br \/>\nGodhra; judgment and order dated 27.03.2006 passed by the<br \/>\nM.A.C.T.(Main), Panchmahals at Godhra in Misc.Civil Application<br \/>\n(M.A.C.P.) No.540 of 2005 and judgment and oarder dated 25.06.2007<br \/>\npassed by the M.A.C.T(Main), Panchmahals at Godhra passed in<br \/>\nMisc.Civil Application (M.A.C.P). No.51 of 2006 are hereby quashed<br \/>\nand set aside. The matter is remanded to the learned M.A.C.T.(Main),<br \/>\nPanchmahals at Godhra for deciding the M.A.C.P.No.27 of 1991 afresh<br \/>\nin accordance with law and on its own merits. However, it is observed<br \/>\nthat whatever evidence is already recorded same may be considered by<br \/>\nthe learned Tribunal and it is further observed that it will be open<br \/>\nfor any of the parties to the claim petition to request for adducing<br \/>\nfurther evidence if they so choose and as and when such application<br \/>\nis made, same shall be considered and parties may be permitted to<br \/>\nlead further evidence. It is made clear that this Court has not<br \/>\nexpressed any opinion on merits of the case and it will be for the<br \/>\nlearned Tribunal to pass an appropriate order on remand in accordance<br \/>\nwith law and on its own merits upon evidence which is already on<br \/>\nrecord and that may be further adduced by any of the parties to the<br \/>\nclaim petition.  As the original claim petition is of 1991, the<br \/>\nlearned Tribunal is directed to give priority in early disposal of<br \/>\nthe aforesaid claim petition and the learned Tribunal is directed to<br \/>\nsee that the claim petition on remand is decided and disposed of as<br \/>\nearly as possible but not later than 31st March, 2009. All<br \/>\nconcerned are directed to cooperate the learned Tribunal in early<br \/>\ndisposal of the aforesaid claim petition.  In the facts and<br \/>\ncircumstances of the case, it is also directed that aforesaid claim<br \/>\npetition No.M.A.C.P.No.27 of 1991 shall not be heard by learned<br \/>\nM.A.C.T.(Main), Panchmahals at Godhra who passed the order in<br \/>\nMisc.Civil Application No.540 of 2005 dated 27th March,<br \/>\n2006 and in Misc.Civil Application No.51 of 2006 dated 25.06.2007.<br \/>\nAforesaid order is with consent of the learned Advocates appearing on<br \/>\nbehalf of the respective parties.\n<\/p>\n<p>7.\t\tMr.Sunil<br \/>\nParikh, learned Advocate for respondent No.3 \u00fd  Insurance Company<br \/>\nhas stated that the Insurance Company shall withdraw Appeal From<br \/>\nOrder No.285 of 2007 which has been filed challenging the aforesaid<br \/>\norders at the earliest.\n<\/p>\n<p>8.\t\tLooking<br \/>\nto the aforesaid orders and the manner in which impugned judgment and<br \/>\norders are passed by the aforesaid two Tribunals, we propose to pass<br \/>\nan appropriate order for placing all the aforesaid orders before the<br \/>\nHon&#8217;ble Chief Justice \/ Hon&#8217;ble Acting Chief Justice and concerned<br \/>\nAdministrate Judge for their kind consideration and if necessary to<br \/>\ntake appropriate action, for which a separate order is being passed.\n<\/p>\n<p>9.\t\tWith<br \/>\nthese present appeal is allowed with above order and directions. The<br \/>\nMACP is remanded. In the facts and circumstances of the case, there<br \/>\nshall be no order as to costs.
