SURENDRA MOHAN, JJ.\n            -------------------------------------------------\n             Arbitration Appeal No.25 of 2010-E\n            -------------------------------------------------\n         Dated this the 18th day of January, 2011\n\n                            JUDGMENT\n<\/pre>\n<p>Basant,J.\n<\/p>\n<\/p>\n<p>     The learned counsel for the appellants submits that there<\/p>\n<p>has been some settlement of disputes between the parties and<\/p>\n<p>the respondent has already issued a letter dated 15\/7\/10<\/p>\n<p>accepting the request of the appellants.              That letter dated<\/p>\n<p>15\/7\/10 has been placed before us. It says:<\/p>\n<blockquote><p>                &#8220;We have examined your request in<\/p>\n<p>          detail and I am directed to inform that your<\/p>\n<p>          case will be considered by the Committee<\/p>\n<p>          constituted for the one time settlement of<\/p>\n<p>          dues under Equity Participation Scheme.&#8221;<\/p>\n<\/blockquote>\n<p>Arbitration Appeal No.25 of 2010<br \/>\n<span class=\"hidden_text\">                               -: 2 :-<\/span><\/p>\n<p>Inasmuch as the committee has been constituted, the appellants<\/p>\n<p>accept that the matter can be left to the Committee for decision<\/p>\n<p>on the one time settlement of dues under the Equity<\/p>\n<p>Participation Scheme.     In these circumstances,    we find no<\/p>\n<p>merit in the appeal continuing. The appeal filed as early as on<\/p>\n<p>01\/2\/08 has been continuing to be pending before this Court for<\/p>\n<p>various reasons now.    As it is reported that a Committee shall<\/p>\n<p>be constituted for the one time settlement of dues, the<\/p>\n<p>appellants accept and we are satisfied that this appeal can now<\/p>\n<p>be dismissed.\n<\/p>\n<p>      2. We do, however, note that it is reported that the<\/p>\n<p>Committee has not actually been constituted. The appellants<\/p>\n<p>accept the statement in the letter dated 15\/7\/10 that such<\/p>\n<p>Committee shall be constituted and does not seek any further<\/p>\n<p>relief in this appeal.\n<\/p>\n<p>      3. We accept the submission of the learned counsel for the<\/p>\n<p>appellants that the matter can be left to the decision of the said<\/p>\n<p>Committee to be constituted for one time settlement of dues<\/p>\n<p>under the       Equity Participation Scheme.     We accept the<\/p>\n<p>submission of the respondent as reflected in the letter dated<\/p>\n<p>15\/7\/10 that such Committee shall be constituted.<\/p>\n<p>Arbitration Appeal No.25 of 2010<br \/>\n<span class=\"hidden_text\">                              -: 3 :-<\/span><\/p>\n<p>    4.
