ORAL JUDGEMENT
\n     Petitioner Pushpaben, who is the mother of detenu
\n     Raju alias Rajesh alias Kaliyo Babubhai Nayka, by way of
\n     this petition under Article 226 of the Constitution of
\n     India, has challenged the legality and validity of the
\n     detention order dated 5-1-1996 passed against her son
\n     under section 3 (1) of the Gujarat Prevention         of
\n     Anti-Social Activities Act, 1985 by the Commissioner of
\n Police, Surat City.\n<\/p>\n
The detaining authority , in the grounds of
\ndetention supplied to the detenu, after considering the
\ntwo cases registered against him for offences punishable
\nunder sections 324, 452, 504 and 114 of the the Indian
\nPenal Code and the statements of three witnesses making
\nallegations against the detenu about the anti-social and
\nnaferious activities being carried on by him,         has
\nrecorded a finding that the detenu is a ” dangerous
\nperson ” within the meaning of section 2 (c) of the said
\nAct and with a view to preventing him from acting in any
\nmanner prejudicial to the maintenance of public order, it
\nwas necessary to pass the order of detention and,
\ntherefore, the impugned order of detention has been
\npassed against the defenu which is under challenge in
\nthis petition.\n<\/p>\n
Since this petition is required to be allowed on
\nthe first contention raised by Mr. S.C.Patel, learned
\nAdvocate for the petitioner, it is not necessary to refer
\nto and deal with the other contentions raised by him.
\nMr. Patel submitted that the exercise of the power under
\nsection 9(2) of the said Act by the detaining authority
\nclaiming privilege of not disclosing the identity of the
\nwitnesses to the detenu is not genuine inasmuch as,
\naccording to Mr. Patel, material particulars, which are
\nsufficient to disclose the identity of the witnesses have
\nbeen disclosed by the detaining authority in the grounds
\nof detention supplied to the detenu.\n<\/p>\n
The submission made by Mr.      Patel about the
\ngenuineness of the exercise of the power under section 9
\n(2) of the said Act, in my opinion, is well founded.   In
\nthe copies of the statements of the witnesses supplied to
\nthe detenu, the detaining authority has kept blanks at
\nthe material places with a view to see that the identity
\nof   the witnesses is not disclosed to the detenu.
\nHowever,in the grounds of detention supplied to the
\ndetenu,   the detaining authority has given material
\nparticulars about the witnesses. The detaining authority
\nhas given the material particulars as regards the date,
\nthe time, the locality and the particular places where
\nthe incidents took place. The detaining authority has
\nalso stated with whom and for what purpose the detenu had
\ngone to the place of the witness, or at which places the
\nwitnesses met him, and has stated the specific reasons
\nfor which the witnesses were beaten. In my opinion, all
\nthese details virtually disclose the identity of the
\nwitnesses to the detenu.      On one hand the detaining
\nauthority has claimed     privilege   and   invoked   the
\n provisions of section 9 (2) withholding the identity of
\nthe witnesses and, on the other hand ,it has given
\nmaterial particulars apparently disclosing the identity
\nof the witnesses.     Thus, in my opinion, the power
\nexercised    by   the  detaining authority of claiming
\nprivilege under section 9 (2) of the said Act is not
\ngenuine.   In other words, the said power has been
\nexercised without application of mind and mechanically.
\nBy disclosing such material particulars indicating the
\ntotal identity of the witnesses , the detenu was denied
\nhis right of making an effective representation against
\nhis detention guaranteed under Article 22 (5) of the
\nConstitution    of India and therefore, the continued
\ndetention of the detenu has become illegal and is
\nvitiated.\n<\/p>\n
In the result this petition is allowed. The order
\nof detention dated 5-1-1996 is quashed and set aside. The
\ndetenu Raju alias Rajesh alias Kaliyo Babubhai Nayka is
\ndirected to be set at liberty forthwith if his detention
\nis not required for any other purpose. Rule is made
\nabsolute accordingly with no order as to costs.\n<\/p>\n
