Justice P.S.GOPINATHAN\n\n Dated :03\/01\/2011\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN &amp;\n                      P.S.GOPINATHAN, JJ.\n                   -------------------------------------------\n                    W.P(C).No.38251 OF 2010\n                  -------------------------------------------\n              Dated this the 3rd day of January, 2011\n\n                              JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>1.This writ petition is filed by the Palakkad District Committee of<\/p>\n<p>  the   Kerala    Headload         Workers          Welfare    Fund Board,<\/p>\n<p>  represented by the Chairman of the District Committee. Going<\/p>\n<p>  by the provisions of the Kerala Headload Workers Act and<\/p>\n<p>  Rules, and the schemes framed there under, the Kerala<\/p>\n<p>  Headload workers Welfare Fund Board is a statutory board. It<\/p>\n<p>  carries out statutory duties under the Act. It is also bestowed<\/p>\n<p>  with certain power to give effect to carry out the scheme.<\/p>\n<p>2.The complaint of the petitioner in its gist is that while the area<\/p>\n<p>  in question is covered by Ext.P1 scheme, there are certain<\/p>\n<p>  persons with criminal backgrounds who forcefully deprive the<\/p>\n<p>  registered headload workers of their legitimate work.               The<\/p>\n<p>  case as projected before us during arguments is that when<\/p>\n<p>  loads of different materials, including agricultural inputs come<\/p>\n<p>WPC.38251\/10<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p> to the market, the persons who are not registered headload<\/p>\n<p> workers forcefully take over the unloading operations. The<\/p>\n<p> Board stand to espouse the cause of the registered headload<\/p>\n<p> workers and says that those workers, in terms of the<\/p>\n<p> provisions of the Act and scheme, have the exclusive right to<\/p>\n<p> be involved in headload work in relation to establishments<\/p>\n<p> covered by the scheme since the area in question is covered by<\/p>\n<p> the statutory scheme.    We are clear in our mind that the<\/p>\n<p> liability under the Act and the scheme gets fastened, at the<\/p>\n<p> first instance on establishments which permit or require<\/p>\n<p> unregistered workers to do the work. At the same time, the<\/p>\n<p> situation pointed out may lead to different law and order<\/p>\n<p> situation between the registered workers and those persons<\/p>\n<p> who have not registered under the Kerala Headload Workers<\/p>\n<p> Act and Rules and scheme. In such event, there could be a<\/p>\n<p> confrontation which would be against public interest. Having<\/p>\n<p> regard to the powers of the Board in terms of the Act and<\/p>\n<p> scheme, the Board has necessarily to be only a spectator to<\/p>\n<p> such a situation and     should proceed   through appeals or<\/p>\n<p>WPC.38251\/10<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>  proceedings before the competent court only in relation to<\/p>\n<p>  establishments governed by the provisions of the scheme.<\/p>\n<p>3.The grievance voiced by the writ petitioner Board needs to be<\/p>\n<p>  attended to by the police only to ensure that there is no law<\/p>\n<p>  and order problem. The Board or the registered workers will<\/p>\n<p>  be entitled to work out any remedies as may be required in<\/p>\n<p>  terms of the Act and scheme against any establishment which<\/p>\n<p>  permits or requires any unregistered workers to carry out the<\/p>\n<p>  loading and unloading works.     Learned Government Pleader<\/p>\n<p>  submits that one picket of police has been posted in the entire<\/p>\n<p>  pool area and law and order will be strictly maintained.
