Sandhir, Advocate\n            for the appellants.\n            ***\n\nARVIND KUMAR, J.\n<\/pre>\n<p>            The instant regular second appeal has been preferred by the<br \/>\ndefendants-subsequent purchasers against the judgments and decrees passed<br \/>\nby the Courts below holding that the sale-deed dated 15.6.1987 executed by<br \/>\nrespondent Shamsher Singh in their favour, being the attorney of his grand-<br \/>\nfather Bakhtawar Singh, not binding upon the rights of the plaintiffs-<br \/>\nrespondents No.1 and 2 and their plea of being bonafide purchaser has been<br \/>\ndisbelieved by both the Courts below and they have been directed to join<br \/>\nhands with Bakhtawar Singh to get the sale-deed executed in favour of the<br \/>\nplaintiffs, the right which accrued in their favour by dint of agreement to<br \/>\nsell dated 14.7.1984.\n<\/p>\n<p>            Having heard learned counsel for the appellants, this Court is of<br \/>\nthe considered view that there is no merit in the instant appeal. It emerges<br \/>\nout that the plaintiffs by producing over-whleming evidence on record,<br \/>\nproved the due execution of agreement to sell dated 14.7.1984 executed by<br \/>\nAmrik Singh, father of respondent Shamsher Singh, in their favour being<br \/>\nattorney of his father Bakhtawar Singh and also that they remained ready<br \/>\nand will to perform their part of the contract. The plea of the appellants that<br \/>\nthey are bonafide purchasers for valuable consideration and without notice<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 1329 of 2009                   2<\/span><\/p>\n<p>of the agreement dated 14.7.1984 in favour of the plaintiffs and thus, their<br \/>\nrights are protected by Section 41 of the Transfer of Property Act, has been<br \/>\ndisbelieved by the Courts below. Admittedly, prior to the said sale-deed, no<br \/>\nagreement to sell was entered into between the parties and straightway sale-<br \/>\ndeed was executed in favour of the appellants; admittedly the appellants and<br \/>\nthe sellers hail from the same village, leading to the inference by the Courts<br \/>\nbelow that it is not possible for them to have no knowledge of the<br \/>\nagreement to sell dated 14.7.1984 in favour of the plaintiffs and some<br \/>\nadmissions made by respondent Shamsher Singh and the appellant Rajender<br \/>\nSingh, led the Courts below to conclude that the conduct of the appellants is<br \/>\nnot bonafide and the agreement dated 14.7.1984 in favour of the plaintiffs<br \/>\nwas well within their knowledge. The above-said findings are discernible<br \/>\nfrom paras No.21, 22 and 23 of the judgment passed by the learned<br \/>\nAppellate Court, which are reproduced below:-\n<\/p>\n<blockquote><p>                   &#8220;21.        The learned counsel for the respondents<br \/>\n                   have alleged that the unusal haste have been shown by<br \/>\n                   the defendants for getting the sale deed in their favour.<br \/>\n                   They have relied upon 1997 (supplementary) CCC 111<br \/>\n                   Punjab and Haryana in case titled as Nirmal Singh and<br \/>\n                   others Vs. Gejo in which it has been held by the Hon&#8217;ble<br \/>\n                   High Court that, &#8220;subsequent purchaser vendees did not<br \/>\n                   entered into the agreement. Unusual haste with which<br \/>\n                   the sale deed was executed and registered and other<br \/>\n                   circumstances point out towards only one conclusion<br \/>\n                   that the vendees had the notice of the previous<br \/>\n                   agreement to sell&#8221;. The law laid down in this citation is<br \/>\n                   fully applicable to the facts of the case in hand.<br \/>\n                   Defendant\/ appellants have failed to rebut the law laid<br \/>\n                   down in this citation, as in the instant case also there is<br \/>\n                   no prior agreement between the subsequent vendees and<br \/>\n                   the vendor regarding the sale of the property in dispute.<br \/>\n                   Although in their written arguments the appellants have<br \/>\n                   alleged that there was oral agreement and subsequently<br \/>\n                   sale deed was executed. Even this contention is devoid of<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 1329 of 2009                 3<\/span><\/p>\n<p>                any merits. There is not an iota of evidence on the file to<br \/>\n                prove this fact. Rather acts of the appellant clearly<br \/>\n                shows that they have shown undue haste in getting<br \/>\n                executed the sale deed in their favour which clearly<br \/>\n                shows that they were fully aware about the prior<br \/>\n                agreement to sell in favour of the plaintiff\/ respondent.\n<\/p><\/blockquote>\n<blockquote><p>                22.          Defendant Shamsher Singh has admitted in<br \/>\n                his cross examination that when he came to know about<br \/>\n                the agreement executed of Bakhtawar Singh, he assumed<br \/>\n                same to be forged document, so he entered into sale deed<br \/>\n                dated 15.6.1987 with defendant No.4 to 7. He further<br \/>\n                admitted that sale deed was execute to frustrate the<br \/>\n                agreement in question in favour of the plaintiffs. He<br \/>\n                further admitted at that time Amrik Singh and Bakhtawar<br \/>\n                Singh used to reside together and after the death of<br \/>\n                Bakhtawar Singh he and Amrik Singh are residing<br \/>\n                together. Meaning thereby from whom the subsequent<br \/>\n                purchasers have purchased the property was fully<br \/>\n                knowing about the previous agreement to sell in favour<br \/>\n                of the plaintiffs and he intentionally executed sale deed<br \/>\n                to frustrate the prior agreement to sell executed by<br \/>\n                Amrik Singh in favour of the plaintiffs. The learned<br \/>\n                counsel for the respondents\/ plaintiffs has relied upon<br \/>\n                2008(1) RCR 649 in case titled as Moti Ram Vs.<br \/>\n                Mohinder Singh in which it has been held by the Hon&#8217;ble<br \/>\n                High Court in para no.14 &#8220;In order to succeed under<br \/>\n                section 19(b) of the Act two conditions were required to<br \/>\n                be fulfilled i.e. the payment was made in good faith and<br \/>\n                the alienation was made without notice of the original<br \/>\n                contract. In this regard it is relevant to notice that in the<br \/>\n                plaint a specific plea was taken that the agreement to<br \/>\n                sell dated 3.6.1998 was well within the knowledge of<br \/>\n                defendant No.2. It was further pleaded that the sale deed<br \/>\n                was executed in favour of defendant No.2 in order to<br \/>\n                create or cause wrongful loss to the plaintiff. This<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 1329 of 2009                4<\/span><\/p>\n<p>                specific plea was supported by the evidence led by the<br \/>\n                plaintiff whereas defendants after denying the same<br \/>\n                chose not to appear in the witness box. In view of what<br \/>\n                has been stated above, the appellant cannot drive any<br \/>\n                benefit from the provisions of Section 19(b) of the<br \/>\n                Specific Relief Act as he has failed to prove on record<br \/>\n                that the sale consideration was made without notice of<br \/>\n                agreement. Rather the evidence led by the plaintiff<br \/>\n                respondent that the sale deed was executed to defeat his<br \/>\n                right went unrebutted as the appellant chose not to<br \/>\n                appear in support of the case set up by him. The<br \/>\n                authorities relied upon by the appellant, therefore, does<br \/>\n                not in any way advance the case sought to be pleaded by<br \/>\n                the learned counsel for the appellant. The plaintiff<br \/>\n                respondent had taken a specific plea that the sale deed<br \/>\n                was not bonafie&#8221;. Although in the written arguments the<br \/>\n                appellants have alleged that they are not bound by the<br \/>\n                statement made by DW-4 Shamsher Singh but this<br \/>\n                contention is devoid of any merits. It clearly shows that<br \/>\n                appellants are trying to wriggle out of the statement<br \/>\n                made by Shamsher singh. Rather evidence of Shamsher<br \/>\n                Singh makes it clear that he was fully aware about the<br \/>\n                prior agrerement to sell and he intentionally executed<br \/>\n                the sale deed in connivance with defendant no.4 to 7 just<br \/>\n                to frustrate the prior agreement to sell. As such<br \/>\n                defendant no.4 to 7 cannot be termed as bonafide<br \/>\n                purchasers and their rights are not protected under<br \/>\n                Section 41 of Transfer of Property Act.\n<\/p><\/blockquote>\n<blockquote><p>                23.Defendants\/ appellants have not made proper inquiry<br \/>\n                  before getting the sale deed executed in their favour<br \/>\n                  and thus their rights are not protected under Section<br \/>\n                  41 of the Transfer of Property Act.
