.lpa11dac_.affection and loss of estate, filed this appeal for<\/p>\n

deserted her and never turned up to file the petition andiitayis<\/p>\n

\nevidence by the claimants to the effect that deceased had
\ndeserted her husband 15 years back and she was residing<\/p>\n
with claimants as one of the family member and this aspect of<\/p>\n
the matter has been not challenged by rebuttal <\/p>\n
cannot be said that the petitioners are not the  <\/p>\n
and also the claim petition is not ma’in\u00a3;a:\ufb01’ap1e. l<\/p>\n
12. So far as the deperidexjgv it is not in
\ndispute that  sisters of the
\ndeceased    the claimants were
\nalso the earning the family. What is to be
\nconsidered is  was earning and whether
\nthewearnirrgifyl  some other purpose or towards<\/p>\n
mai’ntena’r1cye–\u00bb._ofi thefamily. When admittedly claimants are<\/p>\n
 toWb”cl the’.l–V’TbrotVhers and sisters of the deceased and<\/p>\n
_\ufb021eq1ia1.ly the earnings of the deceased was contributing to the<\/p>\n
  of the family, that contribution necessarily<\/p>\n
. l\ufb01have been made towards the maintenance of the<\/p>\n

2. Appeal filed by the Insurance Comparigia.<\/p>\n
is dismissed.\n<\/p>\n
3. The amount awarded by the  .\n<\/p>\n
in a sum of Rs.2,64,C}O0\/4′ is <\/p>\n
