                  preferred this revision application against the<\/p>\n
                  judgment and order dated 5.11.2007 passed by<\/p>\n
                  the learned Additional Sessions Judge, F.T.C.<\/p>\n
                  1, Muzaffarpur in Sessions Trial No. 572 of<\/p>\n
                  2002 by which the accused Tulsi Rai, opposite<\/p>\n
                  party no. 1 has been acquitted for the offence<\/p>\n
                  punishable    under       Sections    427,   384,    307\/149<\/p>\n
                  I.P.C. and Section 27 of the Arms Act.<\/p>\n
                              The   prosecution        case,   in    brief,    is<\/p>\n
                  that the firm of the informant-petitioner was<\/p>\n
                  allotted     work    of     construction      of    Dewaria-<\/p>\n
                  Jafarpur-    Ambara       Road   in    the    district      of<\/p>\n
                  Muzaffarpur. While the work was in progress,<\/p>\n
                  the   accused       Tulsi     Rai     started      demanding<\/p>\n
                  Rs.50,000\/- . On 11.2.2001 while the work was<\/p>\n
                  going on accused Tulsi Rai along with Pappu<\/p>\n
                  Singh, Binod Singh, Sanjay Singh, Ashok Singh,
\n                     2<\/span><\/p>\n
Birendra     Singh,        Arun      Rai,         Pachu    Rai    and<\/p>\n
Chandrika Rai came there armed with firearms<\/p>\n
and explosive substance.                Tulsi Rai told the<\/p>\n
petitioner     to       pay     Rangdari          of     Rs.50,000\/-<\/p>\n
failing which the construction work will not<\/p>\n
proceed. Tulsi Rai threw ten drums of Coaltar<\/p>\n
on the road and set it on fire and fired from<\/p>\n
his gun which hit one of the workers of the<\/p>\n
petitioner. Thereafter,accused Pappu Singh also<\/p>\n
fired which hit the informant and his brother.<\/p>\n
All the accused persons indiscriminately fired<\/p>\n
and thereafter left the place of occurrence by<\/p>\n
threatening the informant.\n<\/p>\n
            On the basis of written information<\/p>\n
of the informant- petitioner,                     Paroo P. S. Case<\/p>\n
No.   22     of         2001     was        instituted.          After<\/p>\n
investigation charge-sheet No. 63 of 2002 was<\/p>\n
submitted against the accused Tulsi Rai showing<\/p>\n
investigation       pending       against          the    remaining<\/p>\n
accused     persons       of    the     FIR.       The    case     was<\/p>\n
committed     to        the    Court        of     Sessions       vide<\/p>\n
Sessions    Trial       No.    572     of    2002.       Charge   was<\/p>\n
framed    against       the    accused.          After    trial    the<\/p>\n
accused     opposite           party        no.     1     has     been<\/p>\n
acquitted.\n<\/p>\n
            The defence of the accused is total
\n                       3<\/span><\/p>\n
denial in participation of the occurrence. It<\/p>\n
has   been      submitted         that      Tulsi        Rai    has       been<\/p>\n
falsely implicated in this case. It is also<\/p>\n
submitted       that       as    a     matter       of    fact       he   was<\/p>\n
admitted in the Clinic of Dr. Birendra Kishore<\/p>\n
in Juran Chapra which has been supported by the<\/p>\n
I. O. of this case. During investigation I. O.<\/p>\n
got    information          that        Tulsi       Rai    was       in     an<\/p>\n
unconscious condition and was at the clinic of<\/p>\n
Dr. Birendra Kishore where his treatment was<\/p>\n
going on due to injury caused to him by bullet.<\/p>\n
             In       this           petition        it        has        been<\/p>\n
submitted that from the evidence of P. Ws. 8 to<\/p>\n
12    it   is     clear         that    all     the       witness         have<\/p>\n
supported the prosecution case beyond doubt but<\/p>\n
the evidence of the prosecution witnesses have<\/p>\n
not correctly been considered by the learned<\/p>\n
trial court.\n<\/p>\n
             Learned         A.P.P.         for      the       State       has\n\nsubmitted       that       the       learned      trial        Court       has\n\nconsidered         the           evidence           of     prosecution\n\nwitnesses       and       found      them     not     trustworthy           as\n\n<\/pre>\n
such their evidence has not been relied upon.<\/p>\n
No interference by this Court is required.<\/p>\n
             It    appears           from     the     impugned         order<\/p>\n
that the prosecution has examined altogether 14
\n                    4<\/span><\/p>\n
witnesses out of them P. Ws. 1 to 7 have been<\/p>\n
declared hostile by the prosecution and they<\/p>\n
have stated that they do not know about the<\/p>\n
alleged    occurrence         whereas       they     are   charge-<\/p>\n
sheeted    witnesses         in    this     cases.    It   further<\/p>\n
appears    that    P.W.       12,    Shivji      Singh      is   the<\/p>\n
informant in this case and he has stated that<\/p>\n
his construction work was going on the date of<\/p>\n
occurrence i.e. 11.2.2001. The                     accused Tulsi<\/p>\n
Rai along with others came there and demanded<\/p>\n
Randari. Altercation took place and the accused<\/p>\n
Pappu Singh ordered to fire, upon which the<\/p>\n
accused    Tulsi       Rai    fired.      He    sided      and   the<\/p>\n
bullet hit on the person of Dilip Mahto. He<\/p>\n
also stated that accessed persons turned down<\/p>\n
the drums of coal tar and Tulsi Rai lit fire on<\/p>\n
it. He has also stated that his brother Gaya<\/p>\n
Singh had died before one year and the injured<\/p>\n
Dilip Mahto was threatened by the men of Tulsi<\/p>\n
Rai, hence he left the village and went away.<\/p>\n
He has stated that the police brought three<\/p>\n
injured persons including himself for medical<\/p>\n
treatment at Sadar Hospital, Muzaffarpur. He<\/p>\n
has denied the suggestion that at the time of<\/p>\n
occurrence Tulsi Rai was not present. Injured<\/p>\n
Dilip     Mahto,       the        alleged      worker      of    the
\n                      5<\/span><\/p>\n
informant who had received firearm injury has<\/p>\n
not been examined in this case. It also appears<\/p>\n
that the learned trial Court has dealt with and<\/p>\n
considered the evidence of other prosecution<\/p>\n
witnesses     also.        It     also       appears    from     the<\/p>\n
evidence of P.W. 14, I. O. of this case that<\/p>\n
the   evidence       of    the    prosecution         witness    are<\/p>\n
full of contradictions regarding appearance and<\/p>\n
participation in the occurrence by the accused<\/p>\n
Tulsi Rai.\n<\/p>\n
             After        Considering         the    evidence     of<\/p>\n
prosecution      witnesses            and    after    hearing    the<\/p>\n
learned counsel for both the parties, learned<\/p>\n
trial court has come to the conclusion that the<\/p>\n
prosecution      has       miserably          failed    to     prove<\/p>\n
charge against the accused Tulsi Rai and his<\/p>\n
participation and complicity in the occurrence<\/p>\n
cannot be believed. The evidence of Ext. A. and<\/p>\n
B clearly indicates that no man in the name of<\/p>\n
Dilip   Mahto     of       village          Kuriya   P.S.    Pipra,<\/p>\n
Distt. East Champaran exist and he is alleged<\/p>\n
to    have     injured           of     the     occurrence       and<\/p>\n
accordingly the accused opposite party no. 1<\/p>\n
has been acquitted.\n<\/p>\n
              Considering               the          facts       and<\/p>\n
circumstances stated above, I do not find any
\n                          6<\/span><\/p>\n
          ground to interfere with the impugned judgment.<\/p>\n
                   In   the   result,   this   application   is<\/p>\n
          dismissed.\n<\/p>\n<\/p>\n
