registered against the petitioner. There is delay in lodging the<\/p>\n

and 13. A–1 forcibly had sexual intercourse with her anjdlh_’e.gla–lvso<\/p>\n
caused burn injuries with cigarette butt on her knee.’  <\/p>\n

\nCrime    At the first instance, on
\n07.04.2009;v’z’–RVVei<ha SliVoalg~ed'4~.l.\u00a7r\u00bb\u00bb:n1issing complaint before the
\ni.ingasugur_ Policeistating  06.04.2009 at 9.30 a.m., her
\nd\u00e9ijglltti-\ufb01jhaciy'-il:ef'\u00e9itheilhousevto attend 10"' Standard examination<\/p>\n
and"s.h'eA.d'i'd   to the house. Thereafter, the victim was<\/p>\n
jg'-~\u00bbi;raced  her statement was recorded on the same<\/p>\n
 The statement of the victim discloses that she belongs to<\/p>\n
\u00e9j\ufb01ingawyatyh.rcomhnunity. She was studying in 10*" Standard. One<\/p>\n
.  belonging to scheduied caste was teasing her. She was<\/p>\n
<9;\/"\n<\/p>\n
attending X Standard annual examination from 30.03.2009 to<\/p>\n
O6.04.2009.0n 05.04.2009, after attending Science-r–.,.fp_a*p,er<\/p>\n
examination, when she came out of the school, GL:4’rura’jUan”d  <\/p>\n
six friends teased her and she got frig_htened.j'”Thain;it<\/p>\n
near her house and found her mother’:.wa’s*not'”presen,t <\/p>\n
house. At that time, the accusedl._broVught” the car’and’*vGL{ruraj”r0<\/p>\n
caught hold of her hand and.made,_.he’r._to”..sit  ‘thgcafr when it
\nwas 2.00 pm. When she  ‘4c’ry:,:(\u00a7ururaj threatened
\nher that he would kill_:he_r if ;kept quiet. Then
\nthe victim was     lnullitaichur where they
\nstayed for   had sexual intercourse
\nwith the victim.  threatened her saying that
\nshe should liste*n,_’_4to_’h’E’s:  he also burnt her knee by
\nmeans ofagcigarette’  on 07.04.2009, Bheemanagouda<\/p>\n

 to Andhra–..Pra’des\u00bbh  they stayed for four days. From there,<\/p>\n
VV7″they wenltto Karadakal Village. There they stayed for two days.<\/p>\n
 the \\V\/Victim stayed with the sister of the accused for two<\/p>\n
 i”‘n_!”i\u00a5<a'radal<al Village. Then they went to Kamaldinni in<\/p>\n
 V  Taluk. Then they went to Bombay. From there, they<\/p>\n
R.\/'<\/p>\n
returned to Gulbarga. When they went to Surpur bus–stand on
\n10.05.2009, police apprehended the victim as weii'*V..ajs'_:"t,he<\/p>\n
accused.\n<\/p>\n
6. The main allegation against the”petitio*n_er_.:<\/p>\n
kidnapped the victim and took her,to different piaclelsand <\/p>\n
forcible sexual intercourse with  yi’ctin1:.\u00a7s aged more
\nthan 16 years. Therefore, ithye  the age of
\nconsent. It is the contentionv’~of’ iapvrii\/i.}F,’%_f;’:l..’counsel for the
\npetitioner that the;’~vi’cti\u00a79ia and   known to each

\nthe victim  discloses that they
\nwent to Raichuuri\u00aband* went to Andhra Pradesh

\ngrounds to  accused has committed
\nthe offence ofarapei. alieged against the petitioner is<\/p>\n

 charg’esheetV”has.,_ filed. Therefore, the presence of the<\/p>\n
petitioneri\u00e9fore’-Ttgh\u00e9’jpurpose of investigation is not required. The<\/p>\n
4, .foetitiorier.,_is  judicial custody. It is weii settied law that pre-<\/p>\n
‘V’*,V..:tr’ial_-dietention is bad in law. In the instant case, the accused is<\/p>\n
bermanent resident of Lingasugur Taluk. Therefore, the<\/p>\n
e\/<\/p>\n
question of petitioner absconcling or fleeing from justice is quite
\nuniikeiy. Therefore, considering the facts and circumstances of
\nthe case, I am of the view that this is a fit case to gra.:fi~t’.,:b\u00aba’i’i~~.at
\nthis stage.  if in<\/p>\n
