No.33862 of 2008\n          ------------------------------------------------\n         Dated this the 17th day of November, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>    Petitioners        are       defendants              in a suit<\/p>\n<p>filed by the respondents for recovery of a<\/p>\n<p>portion of the property allegedly encroached<\/p>\n<p>upon by the petitioners. The suit was decreed.<\/p>\n<p>Appeal filed by them was dismissed by the<\/p>\n<p>first appellate court and finally by Ext.P1<\/p>\n<p>judgment in RFA.1028\/03 the concurrent verdict<\/p>\n<p>was upheld and this Court dismissed the RFA in<\/p>\n<p>limine. The matter is not taken to the Apex<\/p>\n<p>Court. On the other hand, petitioners have<\/p>\n<p>filed  Ext.P5     suit        before           the       Sub Court,<\/p>\n<p>Ernakulam and sought for an injunction by<\/p>\n<p>filing  Ext.P6       application               restraining     the<\/p>\n<p>respondent\/decree holder in O.S.1203\/97 of the<\/p>\n<p>Munsiff&#8217;s Court, Ernakulam from enjoying the<\/p>\n<p>plaint &#8216;B&#8217; schedule property as according to<\/p>\n<p>the   petitioners,              the           respondent       has<\/p>\n<p><span class=\"hidden_text\">W.P.C. No.33862 of 2008          -2-<\/span><\/p>\n<p>      unauthorisedly encroached and occupied plaint<\/p>\n<p>      &#8216;B&#8217; schedule property. The claim so advanced<\/p>\n<p>      over &#8216;B&#8217; schedule property is submitted to<\/p>\n<p>      have been not advanced in O.S.1203\/97 and the<\/p>\n<p>      petitioners have lost their case up to this<\/p>\n<p>      Court as evidenced by Ext.P1. The petitioners<\/p>\n<p>      cannot        be  heard  to   contend  against  the<\/p>\n<p>      adjudication which has gone against them and<\/p>\n<p>      restrain execution of the decree obtained by<\/p>\n<p>      the respondent after a long legal fight up to<\/p>\n<p>      this Court in O.S.1203\/97 aforesaid. There is<\/p>\n<p>      hence,        no  merit  and  the   Sub  Judge has<\/p>\n<p>      appropriately ordered only notice on Ext.P6<\/p>\n<p>      injunction        petition.   The  prayer  not  to<\/p>\n<p>      demolish the alleged illegal construction as<\/p>\n<p>      per judgment and decree in O.S.1203\/97 on the<\/p>\n<p>      file       of    the  Munsiff&#8217;s   Court,  Ernakulam<\/p>\n<p>      confirmed in Ext.P1 judgment and to declare<\/p>\n<p>      that petitioners are entitled to an ex parte<\/p>\n<p>      interim injunction as prayed for vide Ext.P6<\/p>\n<p><span class=\"hidden_text\">W.P.C. No.33862 of 2008           -3-<\/span><\/p>\n<p>      application is not at all reliefs which this<\/p>\n<p>      Court can countenance as the entire matter has<\/p>\n<p>      been adjudged concurrently up to this Court as<\/p>\n<p>      evidenced by Ext.P1 and the petitioners who<\/p>\n<p>      were defendants in the said suit and who<\/p>\n<p>      resisted         the suit  raising all  contentions<\/p>\n<p>      available to them cannot restrain execution of<\/p>\n<p>      the decree so obtained by the respondent, by<\/p>\n<p>      filing         a   fresh suit.   Counsel  for  the<\/p>\n<p>      petitioners submit that before the execution<\/p>\n<p>      court the case stands posted to tomorrow to<\/p>\n<p>      have the decree executed by deputing an Amin<\/p>\n<p>      demolishing the portion of land trespassed<\/p>\n<p>      upon by the petitioners as found in that suit<\/p>\n<p>      and to demolish the constructions effected<\/p>\n<p>      therein. He submits that an opportunity be<\/p>\n<p>      given       to    the petitioners to  demolish  the<\/p>\n<p>      unauthorised constructions by themselves. They<\/p>\n<p>      may do so if they so want but at the same<\/p>\n<p>      time, Amin or Commissioner may have to be<\/p>\n<p><span class=\"hidden_text\">W.P.C. No.33862 of 2008          -4-<\/span><\/p>\n<p>      deputed to ascertain that the entire property<\/p>\n<p>      allowed         to  be  got   recovered   from   the<\/p>\n<p>      petitioners is delivered over to the decree<\/p>\n<p>      holder        after demolishing  the   constructions<\/p>\n<p>      effected therein. However, to effectuate the<\/p>\n<p>      demolition        and  removal by   themselves   the<\/p>\n<p>      petitioners are granted two days time and<\/p>\n<p>      delivery shall stand adjourned to 21\/11\/08.<\/p>\n<p>      The petitioners shall produce a copy of this<\/p>\n<p>      judgment forthwith before the execution court<\/p>\n<p>      with notice to decree holder\/respondent as<\/p>\n<p>      this      writ    petition  is  being  disposed   of<\/p>\n<p>      without notice to the respondent.<\/p>\n<p>             2.
