With<br \/>\n                                          Meeta Sinha, Adv.\n<\/p>\n<p>                   For the State:       Mr. R.P.Singh.\n<\/p>\n<p>                   For the Informant: Mr. Ramesh Kumar Singh, Adv.\n<\/p>\n<p>                                      &#8212;\n<\/p>\n<p>2\/   15.06.2010             Heard the parties, including learned counsel<\/p>\n<p>                  appearing on behalf of the informant\/ complainant.<\/p>\n<p>                              In a criminal prosecution for offence under<\/p>\n<p>                  sections 323, 386, 387, 420 , 448 and 504\/34 of the<\/p>\n<p>                  Indian Penal Code as also under section 27 of the Arms Act<\/p>\n<p>                  the petitioner and his other family members have been<\/p>\n<p>                  arrayed in the category of the accused . From perusal of<\/p>\n<p>                  the F.I.R., vide Annexure-1, it appears that both sides are<\/p>\n<p>                  claiming their right, title and possession over the lands in<\/p>\n<p>                  question.\n<\/p>\n<p>                              It is submitted by learned counsel for the<\/p>\n<p>                  petitioner that it appears to be a case of civil dispute.<\/p>\n<p>                              Learned   counsels    for   the   State   and   the<\/p>\n<p>                  informant have strongly opposed the prayer for bail.<\/p>\n<p>                  Petitioner is stated to be in judicial custody since<\/p>\n<p>                  06.04.2010.\n<\/p>\n<p>                              In the aforesaid facts and circumstances let the<\/p>\n<p>                  above named petitioner be enlarged on bail on furnishing<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>           bail bonds of Rs. 10,000\/- with two sureties of the like<\/p>\n<p>           amount    each   to   the   satisfaction   of   Chief   Judicial<\/p>\n<p>           Magistrate, Khagaria in connection with Pasraha P.S.Case<\/p>\n<p>           No. 08 of 2010, subject to the conditions :<\/p>\n<p>            (A)             one of the bailors must be government<\/p>\n<p>                            servant or close family members of the<\/p>\n<p>                            petitioner, who will file an affidavit in the<\/p>\n<p>                            court below showing his\/her relationship<\/p>\n<p>                            with the petitioner and<\/p>\n<p>            (B)             if the petitioner is found involved in same<\/p>\n<p>                            and similar nature of cases in future, then<\/p>\n<p>                            in that case the informant\/ prosecution<\/p>\n<p>                            shall be at liberty to file a petition for<\/p>\n<p>                            cancellation of the bail of the petitioner,<\/p>\n<p>                            and if such a petition is filed, the court<\/p>\n<p>                            below would be obliged to dispose of the<\/p>\n<p>                            same in accordance with law after giving<\/p>\n<p>                            opportunity of hearing to all concerned<\/p>\n<p>                                    ( Birendra Prasad Verma, J )<\/p>\n<p>BTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Mukesh Yadav vs State Of Bihar on 15 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
