Justice V.GIRI\n\n Dated :14\/07\/2008\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                  W.P ( C) No.19712 of 2008\n                      --------------------------\n                Dated this the 14th July, 2008\n\n                        J U D G M E N T\n<\/pre>\n<p>     Petitioner, who retired from service on 31.10.2004<\/p>\n<p>as an L.D. Clerk, is aggrieved that retirement benefits<\/p>\n<p>due to him have not been disbursed so far.<\/p>\n<p>     It is contended on behalf of the respondents that<\/p>\n<p>there is a vigilance case pending against the petitioner as<\/p>\n<p>C.CNo.35\/2001 before the Enquiry Commissioner and<\/p>\n<p>Special Judge, Thrissur, in which, the petitioner was<\/p>\n<p>Accused No.5. While so, petitioner retired from service.<\/p>\n<p>DCRG is withheld on account of the pendency of the<\/p>\n<p>vigilance case.    Apparently, loss by the petitioner is<\/p>\n<p>assessed at Rs.2,30,560\/-.\n<\/p>\n<p>     2.    Learned counsel for the petitioner submits that<\/p>\n<p>no notice has been received by the petitioner with regard<\/p>\n<p>to the said aspect and therefore liability was not fixed<\/p>\n<p>within a period of three years from the date of retirement.<\/p>\n<p>In circumstances where the liability has not been fixed<\/p>\n<p>W.P ( C) No.19712 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>within three years, it is not possible to withhold the DCRG<\/p>\n<p>due to the petitioner. It is further submitted that period of<\/p>\n<p>suspension of the petitioner is to be regularised.<\/p>\n<p>      3.      In so far as the prayer for regularisation of the<\/p>\n<p>period of suspension, in my view, vigilance case against the<\/p>\n<p>petitioner has to be completed and orders under Rule 56<\/p>\n<p>Part I of the K.S.R. could be passed only after completion of<\/p>\n<p>the vigilance case. But there is no justification to withhold<\/p>\n<p>the DCRG.\n<\/p>\n<p>      In the result, the writ petition is disposed of directing<\/p>\n<p>the 2nd respondent        to take steps to disburse     to the<\/p>\n<p>petitioner the DCRG due to him within a period of six weeks<\/p>\n<p>from the date of receipt of a copy of this judgment.<\/p>\n<p>Obviously, the right of the Government to take appropriate<\/p>\n<p>steps to recover the loss, if any, by the petitioner will be<\/p>\n<p>unaffected by this Court&#8217;s order or the disbursal of the<\/p>\n<p>DCRG pursuant thereto.\n<\/p>\n<\/p>\n<p>                                             (V.GIRI, JUDGE)<br \/>\nma<\/p>\n<p>W.P ( C) No.19712 of 2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>W.P ( C) No.19712 of 2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.S.
