Justice ANTONY DOMINIC\n\n Dated :11\/01\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ===============\n                  W.P.(C) NO. 1453 OF 2008\n               =====================\n\n          Dated this the 11th day of January, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>      This writ petition has been filed by the petitioner on receipt<\/p>\n<p>of Ext.P5 demand notice issued under the provisions of the<\/p>\n<p>Revenue Recovery Act.      Petitioner submits that aggrieved by<\/p>\n<p>Exts.P1 to P3, P4 appeal has been filed before the 1st respondent<\/p>\n<p>and that it is pending consideration of the appeal that coercive<\/p>\n<p>action has been taken.\n<\/p>\n<p>     2.   Standing counsel for the respondents objects to the<\/p>\n<p>request of the petitioner for deferring Ext.P5 on the ground that<\/p>\n<p>the appeal filed by the petitioner is belated. However, petitioner<\/p>\n<p>contends that the copy of the final determination order was not<\/p>\n<p>served on him and he had collected it only recently and<\/p>\n<p>immediately thereafter appeal has been filed.<\/p>\n<p>     3.   In view of the contentions raised as above, I feel the<\/p>\n<p>WPC 1453\/08<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>appropriate course is to direct that Ext.P5 demand notice be<\/p>\n<p>deferred for a short while in order to enable the petitioner to seek<\/p>\n<p>appropriate orders from the Appellate Authority.<\/p>\n<p>     4.    Therefore, I dispose of this writ petition with the<\/p>\n<p>following directions.\n<\/p>\n<p>     That further proceedings pursuant to Ext.P5 demand notice<\/p>\n<p>will be deferred for a period of four weeks from today.
